Document overview

The first in Russia original textbook "ABC for consumers of housing and communal services" is presented.

In particular, it provides answers to frequently asked questions. Everything is stated in simple language.

This is necessary to improve consumer literacy, the formation of an economic attitude towards common property in the house.

The ABC contains a detailed analysis of housing legislation in terms of the composition of common property in an apartment building, its maintenance and current repairs; holding a general meeting of owners; provision of utilities; overhaul. Separate chapters are devoted to the protection of rights in this area, accounting for the consumption of utility resources.

In the textbook, in particular, a three-stage system of control over the work of organizations providing housing and communal services is noted. The first (closest to the tenants) is a house advice. The second is the municipal control services. The third is state housing supervision and licensing control.

There are 2 types of services: housing and utilities. The latter include hot and cold water supply, sewerage, power supply, gas supply, and heating. The resource supplying organization is always responsible for the supply of the resource to the border of the apartment building.

Clarified how the owner's property and common property in an apartment building are distinguished. The pros and cons of each of the methods of managing an apartment building (direct management, HOA, UK) are highlighted.

Consumers are given advice on how to improve the thermal insulation of an apartment and reduce heating bills, to reduce the cost of cold and hot water and electricity.

05/28/2015 | Changing the procedure for calculating and paying for the cost of corporate governance to ONE
We can say that the State Duma of the Russian Federation has already introduced a tradition to amend the Housing Code of the Russian Federation every summer. In the summer of 2014, numerous changes were made in relation to licensing activities for the management of apartment buildings, the requirements for the selection and implementation of management methods for apartment buildings changed, the concept of "TSN" appeared instead of "HOA", the requirements for multi-house TSN, requirements for the implementation of direct management, requirements to checks, etc. Summer 2015 The State Duma RF adopted the federal law"On amendments to the RF Housing Code and certain legislative acts of the RF (in terms of creating the necessary conditions for effective work and improvement of payment discipline in the housing and communal services industry) ”(bill 500410-6). This law has not yet entered into legal force, however, the author of the article has no doubts that this law will be in effect.

Thus, now the KU on the ONE is not a communal service, with the exception of houses under direct management (from 01.04.2015 these are houses with no more than 16 apartments, with the amendments to the Housing Code of the Russian Federation by bill 500410-6 these can be houses with no more than 30 apartments). Those houses that are managed by the UK, HOA, ZhSK, will not provide consumers with a utility service for ODN, but will provide a service for the maintenance of common property, which will consume heat, water, electricity, and waste water. It should be noted that domestic waste water is included in the cost of maintaining common property, whereas earlier, from 01.09.2013, the utility service “ sewerage at ONE»Was excluded from the list of utilities of clause 4 of the RF PP 354.

Also, an innovation is that instead of housing maintenance services in the form of "MSW removal" there is a new utility service " solid waste management", Now this service will be regulated by the state authorities of the constituent entities of the Russian Federation in terms of setting tariffs and consumption standards, the volume of consumption of the service (as well as other utilities) will depend on the number of people living in the premises). In order to provide an appropriate communal resource, it is proposed to create regional operators for the management of MSW, which will be selected by the state authorities of the constituent entities of the Russian Federation on a competitive basis.

In accordance with bill 500410-6, new parts 91 and 92 have been introduced into article 156 of the Housing Code "Amount of payment for residential premises", which determine General requirements to the calculation of payment for the maintenance of living quarters:

"91. The payment for the maintenance of a dwelling includes a payment for cold water, hot water, wastewater disposal, electric energy, thermal energy consumed in the maintenance of common property in an apartment building, provided that design features an apartment building provides for the possibility of consumption of the corresponding utility service for the maintenance of common property, determined in accordance with the procedure established by the Government Russian Federation.

92. Expenses citizens as part of the payment for the maintenance of a dwelling to pay for cold water, hot water, wastewater disposal, electrical energy, heat energy consumed when fulfilling the minimum list of services and works necessary to ensure the proper maintenance of common property in an apartment building, is determined based on the consumption standards of the corresponding types of communal resources in order to maintain common property in an apartment building, approved by the state authorities of the constituent entities of the Russian Federation in the manner established by the Government of the Russian Federation, according to the tariffs established by the state authorities of the constituent entities of the Russian Federation in the manner prescribed by federal law. "

These norms provide a stipulation that the calculation of the costs of citizens for the maintenance of living quarters in the part of the ODN will be made according to the standards, but when the IKU performs the minimum amount of services and works on the maintenance of common property (RF PP 290). In this case, it remains unclear how the payment will be calculated for the same resources consumed when performing other services by IKU that are not provided for in the minimum list, but are necessary for a specific apartment building, or consumed for major repairs.

Thus, to determine the formulas for calculating the fee for utilities and housing maintenance services, in the near future at least two Resolutions of the Government of the Russian Federation will be significantly changed, namely: RF PP 354 and RF PP 491.

And, despite the fact that at present the procedure for calculating the cost of housing maintenance (including KU on ODN), as well as the procedure for calculating utility services (including MSW) is not known, there are already many questions about how the relationship will develop. IKU with RNO in terms of settlements according to the readings of common house metering devices, to whom the difference between the sum of individual consumption and general house consumption will be attributed, how the IKU will report to consumers for consumption of CU on ODN according to standards for the maintenance of housing and for consumption in excess of the standard for real consumption , reflected on the general house metering device.

The author of the article hopes that the introduction of a new procedure for calculating housing maintenance fees and utility bills, even if it will be another revolution for law enforcement officers, will take into account all the problems of previous years, when the calculation of the in part of clause 44 of the RF PP 354, which set the maximum volume of KU for ONE, despite the large difference between the OPU and the amount of individual consumption of apartments) did not cover the costs of the IKU before the RNO for all services provided.
