1. By the decision of the federal executive body responsible for the development and implementation of state policy and legal regulation in the field of construction, architecture, urban planning, project documentation can be recognized as an economically effective design documentation for reuse, while observing following conditions:

1) compliance project documentation established by the Government Russian Federation criteria economic efficiency project documentation, confirmed by a positive conclusion state expertise project documentation;

2) the possibility of using design documentation in the preparation of design documentation for the construction of an object capital construction, similar in purpose, design capacity, natural and other conditions of the territory on which it is planned to carry out construction (hereinafter for the purposes of this article - a similar object);

3) whether the Russian Federation, a constituent entity of the Russian Federation, or municipality exclusive right to project documentation.

For the first half of 2017, the indicator of the number of social and communal infrastructure objects, during the construction of which re-use design documentation was applied, amounted to more than a third. The data were obtained based on the results of monitoring carried out by the Ministry of Construction of Russia in the context of the constituent entities of the Russian Federation.

What happened?

In September last year, 368-FZ entered into force, which introduced the mandatory application of cost-effective design documentation for reuse in the construction of facilities with the involvement of budgetary funds. The Russian Federation has exclusive rights to project documentation developed in accordance with the concluded state or municipal contracts.

“The Ministry of Construction has done a lot of work to create an efficient design system. The institute has already been launched, all the necessary regulations for the recognition of design documentation cost-effective reuse adopted. Today we are actively working with the regions in terms of expanding the scope of such project documentation, ”Deputy Head of the Department Khamit Mavliyarov said at a working meeting in the Ministry of Construction of Russia.

What do we end up with?

To date, 71 objects are included in the register of cost-effective design documentation for reuse, 68 of which are projects of preschool and educational institutions.

What are the selection criteria?

Projects are included in the register according to the criteria established by the Government of Russia.

Namely:

• the estimated cost of the project should not exceed the marginal cost of construction, determined using the estimated standards approved by the Ministry of Construction of Russia;
• the capital construction object provided for in the design documentation must have an energy efficiency class of at least class "C" confirmed by the conclusion of the state examination.

The procedure for recognizing re-use design documentation as cost-effective has also been approved by the Russian Government.

What is the purpose?

From the beginning of 2018, all documentation on reuse projects will be posted in the Unified State Register of Design Documentation Examination Conclusions (USRZ). "The use of re-use projects from the register will reduce the time and cost of both design and subsequent examination and construction," said Khamit Mavliyarov, Deputy Minister of Construction of the Russian Federation.

The deputy minister also noted that the register of standard design documentation, which was formed over the past two years (before the entry into force of 368-FZ), is also in demand today. It includes 552 objects. “Despite the fact that not all projects from the register meet the new requirements for economic efficiency, we will not liquidate this register, since there are objects that are currently being implemented,” said Khamit Mavliyarov.

From September 1, the procedure for designing capital construction facilities using re-use construction documentation will change. According to the amendments, the concept of "standard design documentation" will be replaced by the institute of reusable design documentation for reuse. In addition, it is envisaged to create a single state register conclusions of the examination of project documentation (hereinafter referred to as the register of expert opinions).

As conceived by the authors of the law, the re-application of project documentation by the developer in the design of a construction object will not require a repeated state examination of those sections of it that have not been changed. However, this procedure will relate exclusively to projects, information about the expert opinion on which is contained in the register of expert opinions. And for companies building on a government order, the use of reusable construction documentation will become mandatory, but only if information about it is contained in the register of expert opinions, and the project itself meets the requirements of economic efficiency. Otherwise, as emphasized in the Ministry of Construction of Russia, the construction will not be financed from the budget (, Federal Law No. 368-FZ of July 3, 2016 "On Amendments to the Urban Planning Code of the Russian Federation", hereinafter - Law No. 368-FZ) ...

How will the procedure for using reusable construction documents change?

According to the current edition, any design documentation for capital construction projects that has received a positive expert opinion is called standard design documentation. At the same time, it was established that in the case of using such documentation for the construction of similar objects, a re-examination of the project documentation is not carried out (). At the same time, despite the retention of the general principle of application of standard documents in construction in the new edition, the scope of application of design documentation for reuse will be somewhat clarified and narrowed - developers will be able to reuse projects without an expert examination only in the case of construction of facilities similar in purpose and design capacity. In other words, it will no longer be possible to attach an additional entrance to the building being erected within the framework of a standard project without conducting a comprehensive examination of the project, and the project documentation, to which the changes have been made, is subject to examination in the prescribed manner.

It will not be prohibited to make some changes to the re-use documentation, as now, if the structural and other safety characteristics of the capital construction facility are not affected as a result. For example, such changes may be required to "link" the project documentation to a specific land plot.

Save money on state and municipal projects

A special object state regulation in the field of standard construction will be state and municipal developers. For them will act separate order use of re-use design documentation. So, in addition to the mandatory use of standard documentation that meets the requirements of economic efficiency, non-commercial developers are obliged to ensure economic efficiency in the preparation of project documentation in the absence of standard documentation. At the same time, the criteria for such efficiency have yet to be formulated by the Government of the Russian Federation.

Note that developers participating in the implementation of state or municipal projects will be able to deviate from this rule only in the case of designing especially dangerous, technically complex and other capital construction projects determined by the president or the government. Also, without regard to economic efficiency, they will be able to develop projects for the reconstruction and overhaul of buildings and structures, as well as when carrying out work to preserve cultural heritage sites ().

The press service of the Ministry of Construction of Russia told the portal GARANT.RU about the preparation of a draft order, which defines the criteria for assessing the economic efficiency of project documentation. Now the document is undergoing the approval procedure. In particular, such indicators as the optimality of technical and economic characteristics, the cost of construction work and operation, etc. will be considered as criteria.

In addition, the new rules of the Civil Code of the Russian Federation and the Federal Law of April 5, 2013 No. 44-FZ "" (hereinafter referred to as Law No. 44-FZ) will help state developers to save money. According to the changes, these entities will have the right to use the developed project documentation of the capital construction object repeatedly and without the consent of the author of the project. However, this will become possible only if the construction project was developed within the framework of a state or municipal order (Federal Law of July 3, 2016 No. 314-FZ "On Amendments to Article 1294 of Part Four Civil Code Of the Russian Federation and the Federal Law "On contract system in the field of procurement of goods, works, services to meet state and municipal needs ").

Information support for standard construction

The new register of expert opinions will include information and documents on:

• documentation submitted for examination;
• conclusions of the examination of project documentation and the results of engineering surveys;
• design documentation for reuse (including cost-effective) (Law No. 368-FZ).

Note that the exact list of information that will be included in the register has not yet been formed. Meanwhile, the authority to approve the rules for its formation and conduct has been transferred to the government. The register itself, according to the press service of the Ministry of Construction of Russia, will be posted on the official website of the FAU "Glavgosexpertiza of Russia". And the Ministry of Regional Development of Russia is entrusted to conduct it.

The press service of the ministry also added that the current register of standard design documentation will be replaced by a register of cost-effective design documentation for reuse. True, the legal status of this information resource not yet determined.

It should be noted that the register of standard design documentation, for the maintenance of which the Ministry of Construction of Russia is currently responsible, currently includes information on design documentation for 388 capital construction projects, including 108 kindergartens, 118 schools, 53 sports and recreational facilities, 20 cultural objects, 23 residential buildings, etc.

Forecasts and estimates: official and professional

According to experts of the Ministry of Construction of Russia, the economic effect of expanding the practice of using standard design documentation for each project will be individual. At the same time, the ministry emphasizes that the savings due to the funds that would be spent on payment for the development and creation of a new project from scratch will undoubtedly be tangible. So, when using design documentation for reuse, only the development of design documentation for the foundation, external engineering networks, landscaping, as well as the preparation of the estimated cost of construction and the examination will be financed.

Meanwhile, the builders themselves, on the whole, have a positive attitude towards innovations, however, they note that the existing regulatory framework for bringing complete clarity on this issue is not yet entirely insufficient. "The use of standard projects greatly simplifies the process of design and further construction of the same type of capital construction projects. It is very good that a definition of reuse documentation will be introduced and the main conditions for its use are listed. And in the case of modification of the standard design documentation - after all, it is almost impossible to do without this, you also need to obtain approval from the author of the standard project. “Experience shows that developers will probably have to recycle these sections every time,” the expert emphasizes.

Head of the Design Department of LLC "Morton - RSO" Tatiana Zvereva, in turn, notes a number of problems that arise when using standard projects in the construction of social facilities. “In the microdistricts where we work, it is almost impossible to reapply standard documentation for the construction of kindergartens and schools. This is mainly due to the special requirements for such facilities. on the ground, with insolation conditions, etc. In addition, the regulatory documentation is constantly changing, including those concerning the requirements for the accessibility of facilities for people with limited mobility, etc. All this complicates the use of standard projects, "the expert concludes.

Thus, for now, we can only hope to actively implement standard projects and while saving on additional construction expertise will be not only state and municipal customers, but also commercial developers. This means that the savings will be felt not only by the federal and regional budgets, but also the wallets of ordinary citizens and entrepreneurs.

The appeal is considered within 30 days from the date of registration. Electronic appeal, containing questions, the solution of which is not within the competence of the Ministry of Construction of Russia, is sent within seven days from the date of registration to the appropriate authority or to the relevant official, whose competence includes the solution of the issues raised in the appeal, with notification of this to the citizen who sent the appeal.

5. Electronic appeal is not considered when:
- absence of the name and surname of the applicant;
- indication of an incomplete or inaccurate postal address;
- presence of obscene or offensive expressions in the text;
- the presence in the text of a threat to life, health and property official as well as his family members;
- using a non-Cyrillic keyboard layout or only capital letters when typing;
- the absence of punctuation marks in the text, the presence of incomprehensible abbreviations;
- the presence in the text of a question to which the applicant has already been given a written answer on the merits in connection with the previously sent appeals.

6. The response to the applicant is sent to postal address specified when filling out the form.

7. When considering the appeal, it is not allowed to disclose information contained in the appeal, as well as information concerning privacy citizen, without his consent. Information about the personal data of the applicants is stored and processed in compliance with the requirements of the Russian legislation on personal data.

“Six projects were submitted by the Department of Urban Development Policy of the city of Moscow. They are optimal for construction in crowded urban areas and already have construction addresses in the capital. The objects fully meet the criteria of economic efficiency and are recommended for replication throughout the country, "said the head of the Department of Urban Development Policy Sergey Lyovkin.

This design documentation includes four designs for kindergarten buildings and two designs for school buildings. Space-planning decisions of all objects were made on the basis of the provisions of the current SNiP, SanPiN and SP, taking into account the needs of people with limited mobility.

The preschool educational institution project for six groups, designed for 150 children, has a reference in the Akademichesky district, on the street. Bolshaya Cheremushkinskaya, ow. 36-38. Object with an area of ​​2500 sq. m, has a building area of ​​971 sq. m, the customer was OOO "PremiumStroy". The coloristic and space-planning solution emphasizes its purpose. The façades cut into cubes remind of a child's play, create a chamber of the building. In the decoration of the facades, a combination of plaster and porcelain stoneware cladding with metal inserts was used.

The kindergarten for 200 children, housed in eight group cells, has a total area of ​​2,760 sq. M, and a building area of ​​1,195 sq. M. He received a building address in the Severny area, Dmitrovskoe sh., Vl. 165, bldg. 5, the customer was KP "UGS". The building is three-storey, irregular in shape, which is due to the configuration of the site, as well as regulatory requirements for insolation. The exterior decoration uses a ventilated facade using fiber cement panels, and the cladding of the basement part is made of porcelain stoneware. The planting zone of the object provides for a grass cover, as well as planting flower beds, shrubs and trees without the use of fruiting, poisonous and thorny crops.

Two more kindergarten projects ordered by KP UGS have been developed by OJSC Mosproekt-3. The preschool educational institution for 14 groups, designed for 350 children, is located on a site adjacent to the previous object on Dmitrovskoe highway, vl. 167, bldg. 14. The total area of ​​the object is 5024 sq. m, building area - 1992 sq. m.

On the Chelobityevskoe highway, ow. 4 received a "residence permit" Kindergarten for nine groups - 225 children. Children with health restrictions and children without such restrictions can be brought up together in it. The rectangular volume of the building consists of three three-story block-sections of group cells, united by a two-three-story administrative and economic block. The exterior decoration uses a system of ventilated facades. The total area of ​​the building is 3341 sq. m, building area - 1208 sq. m.

The designer CJSC "Terra-Auri" has created two projects for school buildings. A four-storey school building for 825 children with a total area of ​​15,726 sq. m will be located in the Zagorye microdistrict of the Biryulevo Vostochnoye district.

The school for 550 students will be located at 21, Horoshevskoe shosse, on the site of the demolition of the emergency building of school No. 643. The total area of ​​the new building is 9 425 sq. M, the building area is 2985 sq. M. m. The project takes into account the increase in the capacity of the school, which will solve the problem of lack of places and improve the conditions for the education of children. The architectural and planning solutions of the project provide for the possibility of teaching children with disabilities according to the inclusive education program. The configuration of the building of variable number of storeys (3-4 floors) and its location on the site create a cozy courtyard, protected from the noise of the surrounding highways. The decoration of external walls with ventilated structures and clinker tiles combines the severity of the finishing of the main planes of the facades with bright inserts and various light openings that create a unique look of the building.

The use of cost-effective design documentation for reuse in the construction of facilities at the expense of the budget is enshrined in law. For the design documentation to be recognized as economically effective for reuse, it must comply with the criteria approved by the Government of Russia, namely, it must contain: a positive conclusion from Mosgosexpertiza; complete information about the object, including the graphic part; confirmation of compliance with energy efficiency indicators not lower than class "C"; a document confirming the transfer of exclusive ownership of the re-use project documentation to the city. At the same time, the estimated cost of building a capital construction object should not exceed the estimated (marginal) cost of construction, determined using the consolidated standards for the construction price approved by the Ministry of Construction of Russia. After receiving complete information on the object, it is submitted for consideration by the regulatory and technical council under the Ministry of Construction.

The Regulatory and Technical Council under the Ministry of Construction of Russia on the recognition of project documentation as cost-effective approved the inclusion of 34 socially significant objects in the register. In total, 189 objects have been included in the register of cost-effective design documentation for reuse over the past four months.
