Mini auction. Law violation? Supplier Portal 2.0 contact phone

All small orders from state-owned companies in Moscow are carried out through the Supplier Portal, and without a tender, collateral and unnecessary bureaucracy. We have prepared a guide for working on the Portal, where we have analyzed everything: from placing an offer to winning a strategy in a mini-auction.

1.WHAT IS THE MOSCOW CITY SUPPLIER PORTAL?

This is the site zakupki.mos.ru, where Moscow state-owned companies conduct small-volume purchases from suppliers. That is, up to 400 thousand rubles for educational and cultural institutions (schools, theaters, museums, zoos, etc.) and up to 100 thousand rubles for everyone else. These limits are established by law 44-FZ (clauses 4, 5, part 1 of article 93).

Previously, the Supplier Portal looked like a marketplace a la Avito. After the introduction of quotation sessions, it is more like eBay - something in between trading platform and online auction.

As conceived by the Moscow Government, the portal should provide automation, transparency and efficiency of small purchases. Business is also in the black: even individual entrepreneurs can receive government orders, and without participation in the tender and without security. The terms are also encouraging: it happens that in just 1 week it is possible to conclude an agreement, fulfill it, and receive payment.

2.WHO CAN PARTICIPATE IN THE SUPPLIER PORTAL AND WHAT DOES IT NEED?

Any legal entity, individual and individual entrepreneur. Participation on the Portal is free, the region does not matter - what matters is the desire and ability to work with state-owned companies from Moscow. The only requirement is a valid digital signature (EDS). This is necessary because all contracts are signed electronically.

3.HOW TO WORK ON THE SUPPLIER PORTAL?

There are several ways, but they come down to two actions: publish offers and participate in quotation sessions (electronic mini-auctions).

4.OFFER ON THE PORTAL OF SUPPLIERS

An offer is a card of your product, service or work, sealed with a digital signature. This is how the offer looks in the search:

It used to be easy. Looking through the offers, the customer chose a suitable offer. Then a draft contract was automatically generated and sent to the supplier for approval. There was another way: the supplier could contact the customer himself, negotiate with him, place an offer for him, report its registration number and wait for the draft contract.

Now that won't work. Almost all purchases were transferred to simplified electronic auctions - in the system they are called quotation sessions or mini-auctions. However, you need to create offers on the Supplier Portal (at least in order to participate in mini-auctions). To do this is simple:

5.HOW TO INCREASE VIEWS AND OFFER EFFICIENCY?

If you work with mini-auctions (like almost all suppliers on the Portal) and only with government customers, this item is not for you.

The tips below will help if you offer goods to other suppliers on the Portal. Or if you work on services in which it is possible to conclude a government contract directly, without a mini-auction. At the time of writing, there are only a few such services.

When you create an offer, the system prompts you to enter from 3 to 10 tags - keywords describing the product. Enter all 10, so the offer will collect more views. Don't rely too much on search morphology: tags can only be selected from the drop-down list, you can't enter your own.

If there are few tags, get to 10 by experimenting with close and adjacent tags. For example, the tag "lock" can be added to the offer of a cylinder mechanism. Or even a door.

There are products for which different types and units of measurement are suitable. For example, office paper can be counted in sheets or packages. The cost in sheets will literally be a penny - this is an advantage, because customers often sort offers by price. In general, we recommend creating several offers for such products. True, the articles in them must be different, otherwise you can run into a blockage.

The rest of the recommendations are standard. When submitting an offer, indicate the price with a discount (if any), in the field "Additional characteristics" describe the product in detail, add an image, indicate the actual delivery time. In the "Files" tab, attach all certificates, licenses and other important documentation.

6.QUOTATION SESSIONS (MINI AUCTIONS)

A quotation session is a procedure for determining a supplier through an electronic mini-auction under 44-FZ. Previously, this mechanism did not exist - customers themselves chose a supplier and worked directly with him. At the time of writing, almost all small-volume purchases on the Moscow Supplier Portal go through mini-auctions.

There are different opinions whether this is a good move or not. Mayor of Moscow S.S. Sobyanin notes that the introduction of mini-auctions encourages fair competition ("their own" will not be able to buy from "their own"), giving equal chances to each supplier. It also reduces the price of public procurement. Sometimes almost twice.

Entrepreneurs have the opposite position: many consider this decision a spoke in the wheels of business. They see the threat of dumping and a direct inconsistency with 44-FZ in the transition (or rather, in translation) to quotation sessions. Recall: the law allows small purchases from sole supplier without electronic auction.

7.HOW TO PARTICIPATE IN THE MINI AUCTION ON THE SUPPLIER PORTAL?

Invitations to new auctions are sent out automatically. Recipients - all suppliers who have placed offers with a similar (according to the system rubricator) type of product.

You can also view all the mini-auctions yourself. This can be done in two ways: in the Quote Sessions section (available from home page; sometimes there are problems with the search) or on the Procurement Showcases tab of the same name (it works more stable, but there is no filter system). How to enter the electronic auction: select the session you are interested in → read the agreement that pops up and click "Yes" → read the information in the "Description" and "Specifications" → click "Bid" → confirm it by clicking "Yes".

8.HOW ARE THE ELECTRONIC AUCTIONS IN THE FORMAT OF QUOTATION SESSIONS?

Trades are conducted 24 hours and only on weekdays. That is, if they started on Friday at 13:00, they will end on Monday at 13:00 or a little later (see below).

The process looks like this: suppliers alternately make their offers, reducing the price of the contract by 0.5% with each bid. The winner is the supplier who is the last to offer the lowest price before the end of the auction. In this case, if the bid is made less than 5 minutes before the end of the auction, the auction is extended for another 5 minutes.

Note that participation in the auction is anonymous: neither the customer nor the suppliers know who participates in them. Only the name of the winner is revealed.

The winner of the mini-auction is obliged to sign and publish the offer within 24 hours after the end of the quotation session (except if the auction opened on Friday or the day before the holiday). The offer is formed automatically based on the conditions of the customer and the proposal of the winner. 3 working days are given for agreement and signing of the contract.

The system provides for sanctions. If the winner of the auction more than 3 times during the year refused to put up or sign an offer or delayed the signing of the contract, he will be blocked from access to quotation sessions for 1 year.

The responsibility of the state customer has not yet been spelled out, but the administration of the Supplier Portal is working on possible options sanctions. Basically, they will concern the artificial delaying of deadlines.

9.HOW TO GET MORE INVITATIONS TO MINI AUCTIONS?

Place at least one offer for each category of goods/services/works that suits you.

Why is it important? The fact is that customers work on unified system bidding (EAIST). Invitations to mini-auctions are generated automatically and not by the name of the product, but by the type of second-level product in the Product Directory. This guide is a thing in itself and may not match the specifier on the Supplier Portal. So the more offers under different categories you have, the more invitations you will receive. True, the offers must be for different goods/services/works. It is forbidden to create two or more offers for the same article.

Keep in mind that the specifier is very general, you can't avoid "garbage" prompts. For example, we, a manufacturer of door fittings, sometimes receive notifications about auctions for the purchase of blinds. We simply ignore them.

10.HOW TO WIN A MINI AUCTION ON THE MOSCOW SUPPLIER PORTAL?

Since the rate step is fixed (0.5%), the strategy is simplified as much as possible. The main thing is to track the course of trading and be online in the last minutes of trading. So, it was in the final of the auction that the fate of this auction was decided:

Perhaps it makes sense until the last moment not to indicate your presence on electronic auction and bet on the last minutes. In the screenshot above, participant No. 3 tried to do this by joining the fight in the final. But participant No. 2 was right there and a moment later he outbid, taking the state order for himself as a result.

P.S. WHAT ELSE IS THE SUPPLIER PORTAL USEFUL FOR BUSINESS, EXCEPT HUNTING FOR STATE ORDERS?

Market analysis. In the Suppliers section, enter the name, and preferably the TIN of your competitor. From the supplier's card you will find out what offers he makes. Here are his statistics on government contracts: how much was concluded and executed, with whom, when and for what amount.

Source of commercial orders. The Moscow government has repeatedly stated that it wants to turn the Supplier Portal into a giant electronic store. So far, it is used as a platform for interaction with government customers, but in the future, everything is possible.

Next comes the button "change product type" - the main field. This is where you need to specifically select the subject of the offer. It is worth noting that although a search is implemented in the product directory, it often does not work, so we recommend that you specify it manually.

HINT: Please note that individuals Only the "Products" category is available. Works and services are not available to them. This means that if you offer a service/work, then this value is not available to you.

The next step is to fill in the Article number form - you fill in this field yourself, it is only necessary to make it more convenient to manage your offers. The field must be unique and cannot be the same for two different offers.
Type of units of measure and units of measure - choose based on your subject of the offer. Currency - the only available choice is the Russian ruble.



TIP: The same service can be measured both in economic units, such as pieces, and in units of time. For example: advanced training courses, consisting of 10 lessons. They can be measured in pieces (the price for a full course of study or one lesson) or in hours of study. In this case, we recommend creating two offers for one service. When searching for suppliers, customers often sort by price, so the offer with the lowest price per hour will be seen first.



The last field on this tab indicates the minimum and maximum quantity of goods / services ordered and - the start date and end date of the offer. The standard offer period is one year.

This tab, the fields of which are optional. We are only interested in two fields on it - “Additional characteristics” and “Product image”. In the field of additional characteristics, you can indicate any qualities that may incline the customer in your favor: special conditions payment, additional advantages over competitors, etc.
Product image - select an image from a computer or from suppliers previously uploaded to the portal (if any)




The next tab is "Shipping Details"


Packing unit - depending on the product. If you offer a service - most likely, you will have "without packaging".


Number of units - you can not specify.
Delivery region - specify any region to which you can deliver. If you work throughout Russia, you can specify "Select all"
additional information– you can specify any information about the delivery: type of delivery, courier, transport company, without delivery, etc.

The field "Draft contract" is a mandatory field. It is necessary to upload the draft (fish) of the contract.



After the save was successful, additional buttons “sign”, “copy” and “delete” appear. It is also clear that the registration number of the offer has not yet been assigned, and its status is the input of information. In order for customers to see your offer, you need to transfer it to the “registered” status. To do this, click on the “sign” button and in the window that appears, select a certificate and click “sign all” - after successful signing, select “confirm”, after that you should see a message about successful registration of the offer

After that, we see our offer, and most importantly, its registration number. That's all!

TIP: remember or write down the registry number of your offer. In case you are the first to contact the customer, you just have to send a number to conclude a contract.

The big value of a small auction

Since March of this year, the capital has been using mini-auctions, which make it easier for entrepreneurs to participate in procurement. This is a fundamentally new mechanism for determining the supplier in small-volume purchases. Mini-auctions allow purchasing with the least organizational and financial costs, their duration is one day, which certainly saves time for both customers and suppliers. The annual volume of contracts that can be concluded through mini-auctions is estimated at about 5 billion rubles. - Gennady Degtev, head of the Moscow City Department for Competition Policy, spoke about this at the start of the project in March 2017. There is no doubt that this goal will be achieved. Already, more than a thousand purchases are being made on the Moscow Supplier Portal through mini-auctions.

How are mini-auctions different from regular ones? First, they are a fundamentally new mechanism for identifying a supplier in small volume purchases. Secondly, its simplified form allows you to optimize the costs of budgetary funds, because in this case, prices are formed according to real market offers and the initial maximum price of the contract is significantly reduced. Thirdly, the new mechanism makes it possible to significantly expand the range of suppliers, which leads to increased competition when purchasing from a single supplier.

The mini-auction provides for a clear response of the supplier to the customer's needs through the prompt formation of price offers, - explains Gennady Degtev, head of the Moscow City Department for Competition Policy. - Based on the results of the mini-auction, the supplier who offered the best price makes an offer and concludes a contract with the customer. The mini-auction differs from the classic one in the speed of filing an application and the procedure for concluding a contract.

The first city customer in the framework of the pilot project with mini-auctions was the Moscow Department of Education, namely 28 educational institutions of Moscow, which are members of the Association of Procurement Specialists in Education. Based on the results of the procedures carried out, the average number of suppliers exceeded five participants, and the initial maximum price was reduced by 20%. Professionals assessed the result of this work within the framework of the pilot project as optimal. Testing of an innovative supplier selection format in the city continues successfully.

The pilot project started two months ago, educational institutions during this time, 1,100 mini-auctions were held for the amount of about 180 million rubles, - said the Deputy Mayor of Moscow in the Moscow Government for economic policy and property and land relations Natalya Sergunina. - According to the results of the auctions, the average decrease in initial prices amounted to more than 20%. HOW IT WORKS

To participate in the mini-auction, the supplier must place public offer. From the offers selected by the customer, included in the approved type of products (145 types), a mini-auction is automatically formed in the EAIST electronic store. Further, all suppliers who have placed the selected offers of this category of products, including the higher group of the classifier, are sent a notification of their participation in the mini-auction. A mini-auction is held for several items of the same type of products from the classifier (2nd level), for example, "Food" or "IT products". Mini-auction step: 0.5%. The time allotted for the mini-auction is one working day, including weekends. The deadline for signing the offer by the winner is also one business day from the end of the auction. Based on the results of the mini-auction, the supplier - the winner, forms a draft contract. When signing a contract, the customer uses a unique "one-time" offer available to the customer who has passed the mini-auction.

Specialists also warn about incidents that may occur with suppliers working as part of a mini-auction pilot project. So, you may see a message: "The period for publishing an offer has expired and you need to extend the counter." V personal account there may be problems in change requests. Also, in the personal account of the supplier, there may be problems with changing the electronic digital signature- error "This certificate contains the TIN of another organization." The "Contract" section may not contain the "Sign" button. In the "Offer" an error is possible when saving - "The current user is not defined." The number of the offer may also not be displayed or a failure occurs based on the results (contract formation in UAIST 2). Here, experts advise not to panic, but to consult, try again. That's why the project is a pilot one, in order to work out the theory in practice, to debug the entire mechanism of interaction between participants in mini-auctions.

It should be noted that this is not the first time that Moscow has become an experimental platform for innovative ideas. And the way the capital copes with the tasks assigned to it affects the future fate of innovations. Most of the projects tested on the territory of our city were later successfully extended to the entire territory of the country. The authorship of many innovations belongs to Moscow itself.
