Article 77.1. Translation into electronic form of books state registration acts of civil status (act books)

1. When translating the books of state registration of acts of civil status (act books) into electronic form, each record of the act of civil status, collected in the book of state registration of acts of civil status (act book), is converted (converted) into the form of an electronic document.

2. The civil status record, converted (transformed) into the form of an electronic document, is drawn up in Russian. The list of information included in the civil status record, converted (converted) into the form of an electronic document, is determined by the Government Russian Federation.

3. The civil status record, converted (transformed) into an electronic document in accordance with this article, is signed with an enhanced qualified electronic signature of the head of the vital statistics body or an employee of the vital statistics body authorized by him and is recognized as equivalent to the civil status record drawn up in the form of a paper document.

4. The civil status record, converted (transformed) into the form of an electronic document, is stored in the information system of the civil status registry at the place of state registration of the civil status act, and (or) in the information system of the executive authority of the constituent entity of the Russian Federation, in the competence of which includes the organization of activities for state registration of acts of civil status on the territory of the corresponding constituent entity of the Russian Federation, and (or) in the Unified State Register of Records of Acts of Civil Status. The procedure for storing a civil status record converted (transformed) into the form of an electronic document is determined by the Government of the Russian Federation.

The basis of the legislation in the field of state registration of acts of civil status is the Federal Law "On acts of civil status", which in 2016 has undergone conceptual changes, the implementation of which is a large-scale and global activity not only of the registry office, but also of other executive authorities.

Over the period of 2016, Federal Law No. 143 was amended by 3 federal laws:

  1. F federal law No. 79-FZ "On Amendments to Certain Legislative Acts of the Russian Federation" According to these changes, in the record of the death act and in the death certificate, instead of the date of death of the deceased, the moment of death is indicated.
  2. the federal law No. 219-FZ "On Amendments to the Federal Law" On Acts of Civil Status ", who made significant changes to the current legislation in the field of acts of civil status.
    1. the federal law No. 361-FZ "On Amending Certain Legislative Acts of the Russian Federation and Recognizing Certain Legislative Acts (Provisions of Legislative Acts) of the Russian Federation invalid", which changes have been made regarding the vesting of the registry office with the duty
      to provide information on state registration of death to Rosreestr and its territorial bodies.

Today we will consider in more detail the changes introduced by the second Federal Law, which comes into force in 3 stages: from January 1, 2017, from January 1, 2018 and from January 1, 2020.

On September 12, 2016, by order of the Civil Registry Office, the Action Plan for preparation for the implementation of the Federal Law No. 219-FZ dated June 23, 2016 was approved.

BLOCK FIRST.

Normative activity of the Office of the Civil Registry Office of the Republic of Sakha (Yakutia).

In connection with the changes that came into force on January 1, 2017, the Office of the Civil Registry Office of the Republic of Sakha (Yakutia) in 2016 carried out next job according to the Action Plan:

  1. According to the changes introduced by Federal Law No. 361-FZ, the registry office must transfer information about the death of citizens to the Office Federal Service state registration, cadastre and cartography in the Republic of Sakha (Yakutia)(hereinafter - the Office of Rosreestr for the Republic of Sakha (Yakutia)) from January 1, 2017.

In order to implement this Federal Law, the Ministry of Justice of Russia has prepared appropriate amendments to the Rules for the transfer by civil registry offices of information on state registration of birth and death, approved by the Government of the Russian Federation of December 1, 2016 No. 1286 with entry into force from January 1, 2017.

On December 16, 2016, at the initiative of the Civil Registry Office, a working meeting was held at the Rosreestr Office to develop and sign an agreement on information interaction.

Based on the results of the working meeting, we received information mail from the Office of Rosreestr (dated December 23, 2016), which indicates that the conclusion of the Agreement at this stage is impossible for the following reasons.

The Rosreestr Office for the Republic of Sakha (Yakutia) does not provide for the conclusion of such an agreement by legal acts and, in addition, the transfer of information is not possible until the implementation of the relevant technical regulation.

In this regard, the following important fact should be noted.

Since Article 12 of the Federal Law "On Acts of Civil Status", which regulates the activities of the registry office for the transfer of information to the relevant authorities, is no longer in force from January 1, 2018, these changes are valid only until this period. That is, information about death will be submitted to Rosreestr until January 1, 2018.

2. As part of the activities of the Civil Registry Office for monitoring federal legislation and revising the regulatory legal acts of the Republic of Sakha (Yakutia) and in order to bring the republican legislation in line with the federal, the Civil Registry Office in accordance with the adopted Action Plan developed 2 draft laws of the Republic of Sakha (Yakutia):

  1. "On Amendments to the Law of the Republic of Sakha (Yakutia)" On the Endowment of Organs local government urban districts, urban and rural settlements Of the Republic of Sakha (Yakutia) by separate state powers for state registration of acts of civil status ”.

The project envisages amending Articles 4, 6, 7 and 10 of the current Law of the Republic of Sakha (Yakutia).

  1. “On Amendments to Articles 21 and 22 of the Law of the Republic of Sakha (Yakutia)“ On Languages ​​in the Republic of Sakha (Yakutia) ”.

On March 30, 2017, the bills were considered at a meeting of the Government of the Republic of Sakha (Yakutia) (Resolutions of the Government of the Republic of Sakha (Yakutia) No. 93 and 94 dated March 30, 2017) and submitted to the State Assembly (Il Tumen) of the Republic of Sakha (Yakutia).

BLOCK TWO.

AGS CONVERSION.

I .Main changes that come into force

  1. The main change is the introduction of a new article number 77.1, which provides for the translation into electronic form of books of state registration of acts of civil status (act books).

According to this article, the civil registry offices from January 1, 2017 must begin the translation of act books from 04/01/2015. depth up to 01/01/1926. in electronic form and complete it no later than December 31, 2019.

For the purposes of Article 77.1, the Government of the Russian Federation adopted an order, which approved the List of information included in the civil status act, converted (converted) into the form of an electronic document.

As part of this activity, the Ministry of Justice of the Russian Federation has developed a draft order “On approval of the procedure for determining the average coefficient of complexity of converting (converting) civil status records into an electronic document in a constituent entity of the Russian Federation or the city of Baikonur”.

In addition, the Ministry of Justice of the Russian Federation and the Federal Tax Service of the Russian Federation must approve the formats of information entered into acts of civil status in the form of an electronic document, as well as the procedure for submitting and using this information in order to form and maintain the USR registry office.

Act records in the form of electronic documents will be stored in the information system of the Civil Registry Office before entering them into the USR of the Civil Registry Office.

To implement the work on converting civil status acts into an electronic form, the Civil Registry Office needs to transfer 2 million 907 thousand 002 registration records in the form of an electronic document during 2017-2019 in compliance with the requirements established by the Government of the Russian Federation dated March 3, 2017 No. 254 " On the approval of the rules for transferring books of state registration of acts of civil status (act books) into electronic form "and a letter from the Ministry of Finance of the Russian Federation from 01 January 2017 to December 31, 2019

Currently working group Organizational work is being carried out by the Civil Registry Office for the translation into electronic form of books of state registration of acts of civil status.

BLOCK THREE.

FSIS USR REGISTRY OFFICE.

Major changes that come into force

  1. The main change is the introduction of a new article number 13.1, according to which, from January 1, 2018, the maintenance of the Unified State Register of Civil Status Acts begins.

The USR REGISTRY OFFICE will be a unified database containing act records in electronic form, compiled by the registry office throughout the Russian Federation.

Civil registration records will be stored in the USR registry office permanently and will not be destroyed.

To implement the changes introduced by Federal Law No. 219-FZ dated June 23, 2016, the relevant regulatory legal acts Russian Federation.

The federal tax service Of the Russian Federation, work is underway to create a federal state information system unified register records of acts of civil status (hereinafter - FSIS "USR REGISTRY OFFICE"). The Federal Tax Service of Russia is the operator of the FGIS "USR ZAGS".

Based on the state contract dated 05.10.2016. the executor of work on the design and creation of the FSIS "USR REGISTRY OFFICE" Joint-stock company"Main Scientific Innovation and Implementation Center" (JSC GNIVTs).

Preparatory activities are carried out in three areas and include :

  1. Providing the Office of the Registry Office availability of communication channels registry offices that meet the requirements established by the Ministry of Justice of the Russian Federation for work in the FSIS "USR registry office" (no later than July 01, 2017).
  2. Implementation of the Federal Tax Service of the Russian Federation deliveries computer equipment up to 35 departments of the Civil Registry Office for ulus (districts) and the city of Yakutsk and 376 local government bodies exercising powers for state registration of the AGS (from July 01 to August 15, 2017).
  3. Education JSC GNIVTs 69 employees of the Civil Registry Office and specialists of LSG bodies in the amount of 376 people with a separation of employees from their duties (from 01.07.2017 to 01.10.2017).

The trial operation of the FSIS "USR ZAGS" should begin on September 01, 2017, the system will be put into commercial operation on the territory of all constituent entities of the Russian Federation from January 01, 2018.

As part of the work on the implementation of organizational and preparatory measures, the Civil Registry Office faced the following problems :

  1. Ensuring standard requirements for communication channels provided by a communication operator to local authorities exercising state powers for state registration of acts of civil status, not fully within the competence Registry Office. The participation of the Ministry of Communications and Information Technologies of the Republic of Sakha (Yakutia) and local self-government bodies of settlements is required.
  2. In the case of delivery of computer equipment by the Federal Tax Service of the Russian Federation to the regional centers of the Republic of Sakha (Yakutia) according to the letter of the Federal Tax Service for the Republic of Sakha (Yakutia) addressed to the Chairman of the Government of the Republic of Sakha (Yakutia) E.A. Chekin from 04/26/2017, local government bodies do not have financial resources for the delivery of software and hardware complexes (PAC). It is necessary to provide local government bodies with additional means for the delivery of PAKs from regional centers to settlements.
  3. There are no provisions for training employees of civilian registry offices in the basics of work in the FSIS "USR registry office" financial resources for 69 employees of the Civil Registry Office and 376 LSG bodies (travel expenses, rent of premises, etc.).

Training of employees should be carried out on the territory of the constituent entity of the Russian Federation at the location of employees in specially designated rooms for conducting lectures and practical training with the use of elements of e-learning and distance educational technologies for 3 days in separate groups of no more than 25 people with technical, consulting and organizational support employees who have completed face-to-face training in an advanced course. It is necessary to provide additional funds for organizing training for employees of the Civil Registry Office of the Republic of Sakha (Yakutia) and local self-government bodies.

  1. Incompatibility of the printer equipment park of the registry office and local government authority for work in the federal state registry office "USR registry office", wear and tear of this equipment. The Federal Tax Service must additionally provide for the purchase and supply of printers to the registry office and local government bodies.

In order to solve these problems, the Office of the Civil Registry Office of the Republic of Sakha (Yakutia) carried out the following work:

  1. Via communication channels:

On April 24, 2017, a letter was sent to the Ministry of Communications about a request for information on the provision of local government bodies with communication services, in accordance with the established requirements. However, there was no clear answer on this issue from the Ministry of Communications.

On April 25, 2017, a letter was sent to the heads of the local self-government bodies on the creation of the USR registry office and preparatory measures.

2. On delivery of PAK:

April 25, 2017 a letter was sent to the Federal Tax Service of the Russian Federation for the Republic of Sakha (Yakutia) about the problems with the delivery of computer equipment to the departments of the Civil Registry Office and the local government bodies exercising state powers for state registration of the AGS;

Options developed road map for the delivery of computer equipment from the territorial departments of the Federal Tax Service to the departments of the Civil Registry Office and local government bodies;

On April 21, 2017, a joint meeting was held with the Federal Tax Service for the Republic of Sakha (Yakutia) on the delivery of computer equipment and problematic issues training of employees of the registry office in the FSIS "USR registry office" with the participation of representatives of the UML of the Russian Federation for the Republic of Sakha (Yakutia), relevant proposals were made to the Minutes of the meeting.

3. For training USR registry office:

In order to assist in conducting training in the basics of work in the USR registry office, letters were sent to the Ministry of Communications of the Republic of Sakha (Yakutia), to the GAU RS (Y) VSHIM under the Head of the RS (Y), the Federal Tax Service for the Republic of Sakha (Yakutia), the Ministry of Education of the RS (Y) and FGAU VO NEFU named after M.K. Ammosov.

Responses were received from the Ministry of Communications of the Republic of Sakha (Yakutia) about the temporary provision of a meeting room and 11 laptops, from GAU RS (Y) VSHIM under the Head of the Republic of Sakha (Yakutia) No. 267 dated 26.04.2017 about the presence of 2 computer classrooms for 20 AWPs and from the Federal Tax Service for the RS ( I) dated April 28, 2017 No. 12-18 / 07323 on the availability of a training class for 25 workstations.

Thus, at present there is an opportunity for the simultaneous training of 76 employees of civil registry offices and local self-government bodies in 4 classrooms in the city of Yakutsk that meet the requirements of the Ministry of Justice of the Russian Federation, which is not enough. There is a collection of information on the availability of classrooms in the uluses (districts) of the republic.

4. By printers:

In accordance with the letter of the Federal Tax Service of Russia, a partial testing of the printer fleet of the registry offices and the local government administration of the YAN was carried out, according to the results of which most printers are not compatible with the FSIS USR registry office.

In addition, on April 26, 2017, a list of problematic issues was sent to the Ministry of Justice of the Russian Federation for consideration by the working commission of the Ministry of Justice of the Russian Federation on April 26, 2017, as well as to the UMJ of the Russian Federation for the Republic of Sakha (Yakutia) by a letter dated 04/05/2017.

For solutions to the above problems, as well as on behalf of the Chairman of the Government of the Republic of Sakha (Yakutia) E.A. Chekina (from 28.04.2017) May 10, 2017 a meeting was held with the Deputy Chairman of the Government of the Republic of Sakha (Yakutia) M.D. Gulyaev, as a result of which it was decided:

1. Create a Unified interdepartmental commission on the coordination of work on the creation of a federal state information system of the unified state register of civil status acts (FSIS "USR ZAGS").

The draft of the corresponding order of the Government of the Republic of Sakha (Yakutia) is being approved by the interested ministries and departments.

  1. Submit for consideration a consolidated cost estimate for the implementation of measures to create the FGIS "USR ZAGS".

According to this protocol order, the cost estimate was sent for approval to the Ministry of Finance of the Republic of Sakha (Yakutia) and the Ministry of Economy of the Republic of Sakha (Yakutia) until May 30, 2017.

  1. Provide financial resources from the republican budget (Department personnel policy Of the Republic of Sakha (Yakutia), the Ministry of Finance of the Republic of Sakha (Yakutia)) for the following expenses:

Travel expenses - 2 84 thousand rubles for 6 employees of the UZAGS for training in the basics of work in the FSIS "USR ZAGS" in Moscow;

60 specialists structural units Office of the Registry Office of the Republic of Sakha (Yakutia) (for arrival in Yakutsk and departure to nearby centers of uluses (districts);

376 specialists of local self-government bodies in Yakutsk for arrival in Yakutsk and departure to nearby centers of uluses (districts).

4. To conduct training seminars, organize training classes in accordance with the necessary technical requirements(Ministry of Education, VSHIM, HR Policy Department, municipalities, NEFU).

5. To include in the state order training seminars for employees of the civil registry office of the republic, incl. 376 specialists of local self-government bodies, on the basics of work in the FSIS "USR REGISTRY OFFICE" (Ministry of Education, VSHIM, HR Policy Department, LSG Department).

6. Ensure the availability of communication services (channels) in 35 departments of the registry office and 376 local government bodies in accordance with the technical requirements (the Ministry of Communications, GBU RCIT).

7. Instruct the heads of LSG bodies to ensure the delivery of PAKs from regional centers to settlements, the introduction (installation, adjustment and training of specialists) of the FGIS "USR ZAGS" deadlines(Ministry of Transport, Department of LSG).

8. To initiate before the Federal Tax Service of Russia the purchase of new printers for the FSIS "USR REGISTRY OFFICE" (Office of the REGISTRY OFFICE of the RS (Y), the Federal Tax Service for the RS (Y)).

In addition, I would like to note that on all our problematic issues, corresponding letters were sent to the Ministry of Justice of Russia and the Department of the Ministry of Justice of the Russian Federation for the Republic of Sakha (Yakutia).

1. These Requirements for the formats of information entered into the civil status act, converted (converted) into the form of an electronic document:

determine the structure and composition of information used in the conversion (transformation) of civil status records into an electronic document using the information system of the civil status registry at the place of state registration of the civil status act and (or) the information system of the executive authority of the constituent entity of the Russian Federation, in whose competence includes the organization of activities for state registration of acts of civil status on the territory of a constituent entity of the Russian Federation or the administration of the city of Baikonur (hereinafter referred to as the information system);

establish requirements for XML transfer files in in electronic format information included in the civil status records from information systems for subsequent loading into the federal state information system for maintaining the Unified State Register of Civil Status Records (hereinafter referred to as the federal information system) in order to form and maintain the Unified State Register of Civil Status Records, including including for uploading to the federal information system the information of civil status records entered into information systems from April 1, 2015.

2. When converting (converting) civil status records into the form of an electronic document, a set of characters (UTF-8 encoding) for Cyrillic alphabets must be used.

3. Electronic document:

must conform to the XML specification;

signed with an enhanced qualified electronic signature of the head of the vital statistics body or an employee of the vital statistics body authorized by him;

must contain the root element (block) IId and nested elements (blocks, requisites) belonging to the namespace http: //www.____________________ and given in the description of the elements (blocks, requisites) contained in the information entered in the civil status records , converted (converted) into the form of an electronic document, provided for by Appendix No. 3 to these Requirements.

4. The list of electronic documents containing information about acts of civil status used in the conversion (transformation) of records of acts of civil status into the form of an electronic document (hereinafter referred to as electronic documents) is given in Appendix No. 1 to these Requirements.

5. The list of reference books used in the translation into electronic form of books of state registration of acts of civil status (act books) (hereinafter referred to as reference books) is given in Appendix No. 2 to these Requirements.

6. Formats of electronic documents are given in Appendix No. 3 to these Requirements.

Federal Law of June 23, 2016 No. 219-FZ "On Amendments to the Federal Law" On Acts of Civil Status "clarified the procedure for storing books of state registration of acts of civil status (act books), while at the legislative level the procedure for converting them into electronic form is described. The new provisions come into force on January 1, 2018.

In article 76. "Place of storage of books of state registration of acts of civil status (act books)" the procedure for their storage has been changed.

The books of state registration of acts of civil status, collected from records of acts of civil status on paper, will, as before, be stored in the registry office at the place of their state registration (clause 1). Storage of second copies of books is not provided (clause 2).

The procedure for the transfer of records drawn up by consular offices outside the territory of the Russian Federation for storage in the registry office on the territory of the Russian Federation is established by the federal executive body responsible for the development and implementation of state policy and legal regulation in the field of state registration of acts of civil status, and the federal body executive power, carrying out functions for the development and implementation of state policy and legal regulation in the field international relations RF (clause 3).

Article 77 "Terms of storage of books of state registration of acts of civil status (act books)" specifies that the transfer of documents to the state archives, as before, will be carried out in a hundred years, but its procedure will be established jointly:

  • The federal executive body responsible for the development and implementation of state policy and legal regulation in the field of state registration of acts of civil status;

  • The federal executive body in charge of legal regulation in the field of archiving ( earlier it was the prerogative of the Government of the Russian Federation - N.Kh.).
My comment: As soon as the new regulation on the Federal Archival Agency has been approved, it will now have to be amended.

The Law was supplemented with Article 77.1 “Transfer of State Registration Books of Civil Status Acts (Act Books) into Electronic Form”.

When translating books of state registration of acts of civil status into electronic form, each record collected in a book (act book) is converted (converted) into the form of an electronic document (clause 1).

My comment: If at first the record is made on paper, and then an electronic record is created on its basis, then in this case the paper act is the original, and the electronic record is an electronic copy of the document on paper, but by law it is recognized as equivalent to the paper original. In this case, all other legally significant actions are carried out on the basis of an electronic copy stored in the information system.

Civil status record converted into an electronic document:

  • Compiled in Russian. The list of information included in the electronic record is determined by the Government of the Russian Federation (clause 2);

  • It is signed with a strengthened qualified electronic signature of the head or an employee of the registry office authorized by him and is recognized as equivalent to a record drawn up in the form of a document on paper (clause 3);

  • It is stored in the information system of the civil registry office at the place of state registration of the civil status act and (or) in the information system of the executive authority of the constituent entity of the Russian Federation, whose competence includes the organization of activities for state registration of acts of civil status in the territory of the corresponding constituent entity of the Russian Federation.
My comment: So, everything that will be converted into electronic form from paper carriers will be stored in information systems regions.

Federal executive body in charge of developing state policy and legal regulation in the field of budget, tax, insurance, currency, banking activities, in agreement with the federal executive body performing functions of developing and implementing state policy and legal regulation in the field of state registration of acts of civil status, and the federal executive body exercising functions of control and supervision over compliance with the legislation on taxes and fees approves (clause 5):

  • Requirements for the formats of information entered into the civil status record, converted into the form of an electronic document;

  • The procedure for the submission and use of information in order to form and maintain the Unified State Register of the Civil Registry Office.
Article 3. federal law dated June 23, 2016 No. 219-FZ establishes the procedure for organizing translation work paper books state registration in electronic form.

Books of state registration of acts of civil status, collected from the first copies of records compiled before April 1, 2015, and stored in the registry office at the place of their state registration, are subject to transfer to electronic form in the manner determined by the Government of the Russian Federation (clause 1).

The translation into electronic form of books of state registration must be completed no later than December 31, 2019 (clause 2).

The transfer to the state archives of books of state registration, collected from the first copies of records of acts on paper, compiled before the day of the entry of new legislative provisions, and registers of births is allowed only after entering the information contained in such books into the United State Register records of acts of civil status (clause 3).

My comment: That is, information from paper carriers, converted into electronic form, will not only be stored in regional information systems, but will also be included in the Unified State Register.

State registration books, collected from the second copies of records of acts on paper, compiled before January 1, 2018, stitched, numbered and sealed, are stored in the executive authority of the constituent entity of the Russian Federation, whose competence includes organizing activities for state registration of acts of civil status and territory of which they were drawn up (clause 4).

The creation of proper storage conditions for books of state registration of acts on paper, drawn up before January 1, 2018, is ensured by the executive authorities of the constituent entities of the Russian Federation (clause 5).

State registration books collected from the first and second copies of records of acts on paper, compiled before January 1, 2018, are stored for one hundred years from the date of their compilation (clause 6).

My comment: From my point of view, this is an unfortunate wording. In fact, we are talking about the period of departmental storage of books in the registry office. At the same time, it is not clear what terms of departmental storage will be for books compiled after January 1, 2018.

When making a correction or change to the entry, the head of the registry office is obliged to inform the registry office at the place of storage of the second copy within three days from the date of entry (clause 7).

If in the book of state registration, collected from the first copies of records of acts on paper, any record has not been preserved, then the book is supplemented with a corresponding record taken from the book collected from the second copies of records (clause 8).

State registration books collected from the second copies of the records of acts on paper are subject to destruction after the transfer of the books collected from the first copies to the state archives (clause 9).

If the book of state registration, collected from the first copies of acts on paper, has not been preserved, then the book collected from the second copies cannot be destroyed, but transferred to the state archive for storage (clause 10).

The Government of the Russian Federation establishes the procedure for the use of reinforced qualified electronic signatures when maintaining the Unified State Register of Civil Status Acts and transferring books of state registration of acts (act books) into electronic form (clause 12).

My comment: The law stipulates that only paper books of civil status records will be transferred to the state archives. It is not planned to transfer electronic databases to the archive. From my point of view, this is wrong. In any case, it is necessary to provide that archives have remote access to electronic information and can use it as a scientific and reference apparatus.

The Unified State Register of Civil Status Acts will generally be kept in electronic form at federal level... Its transfer to the state archives is also not provided.
