215. In the documentation about competitive procurement the requirements for goods, works, services supplied (performed, provided) within the framework of the execution of the contract concluded as a result of competitive procurement are determined.

216. Requirements for purchased goods, works, services are formed taking into account the following principles:

1) the legal requirements applicable at the time of purchase must be taken into account Russian Federation by types of goods on compulsory certification;

2) requirements for purchased goods, works, services should be acquisition-oriented quality goods, works, services that have consumer properties necessary for the customer and specifications;

3) the established requirements for the subject of the procurement should, if possible, ensure that the procurement participants submit proposals for the supply of innovative goods and energy-saving technologies (including electricity, heat energy, labor, time and other types of resources), the requirements for the supplier to comply with labor protection, industrial and environmental safety , as well as ensuring the safety of personnel and the safety of the customer's property;

4) the requirements of technical, technological regulations established by the legislation of the Russian Federation, as well as the requirements of local standards, must be taken into account, normative documents for the supply of goods, performance of work, provision of services operating at the customer:

Requirements for incoming inspection of materials used by the supplier (if necessary);

Other requirements for quality and timing.

217. In the requirements for the subject of procurement and other local legal acts approved in the implementation of all types of procurement in relation to programs for electronic computers and databases, implemented regardless of the type of contract on a tangible medium and (or) in in electronic format through communication channels, as well as the rights to use such software, including temporary, indicate the need to submit proposals that provide only such software, information about which is included in single register Russian programs for electronic computers and databases, created in accordance with the current legislation of the Russian Federation and the regulatory legal acts adopted in pursuance of it (hereinafter referred to as the register), with the exception of the following cases:

1) there is no information in the register about software corresponding to the same class of software as the software planned for purchase;

2) software, information about which is included in the register and which corresponds to the same class of software as the software planned for purchase, is not competitive (in terms of its functional, technical and (or) operational characteristics does not correspond to the requirements set by the customer for the planned for the purchase of software).

With respect to each purchase to which the above exceptions apply, publish on the customer's official website in the section on procurement activities information about such a purchase, justifying the impossibility of observing the restriction on the admission of software originating from foreign countries, no later than 7 calendar days from the date of publication of information about procurement on the official website of the customer or specialized sites on the Internet used by the customer for procurement.

218. Requirements for the quality of goods, works, services are to be stated in terms of reference with reference to technical regulations adopted in accordance with the legislation of the Russian Federation on technical regulation, documents developed and applied in the national standardization system, adopted in accordance with the legislation of the Russian Federation on standardization.

219. The requirement for the quality of the work performed or the services provided can be expressed in the achievement of the object capital construction(reconstruction) or repair (modernization) of certain technical and economic indicators and maintaining the achieved indicators during the warranty period.

220. Requirements for the warranty period of goods, work, services and (or) the scope of the provision of guarantees of their quality, warranty service of the goods, the costs of operating the goods, the obligation to carry out installation and adjustment of the goods, training of persons who use and service the goods, are established if necessary.

If the supplier of machinery and equipment is determined in the procurement documentation, if necessary, requirements are established for the warranty period of the goods and (or) the scope of the provision of guarantees of its quality, warranty service for the goods, the cost of servicing the goods during the warranty period, as well as for the installation and adjustment of the goods. ... If a supplier of new machinery and equipment is determined in the procurement documentation, the requirements for the provision of a manufacturer's and (or) supplier's guarantee for this product and the duration of such a guarantee are established, while the provision of such a guarantee is carried out together with the product and the period of validity of such a guarantee must be at least the duration of the manufacturer's warranty for this product.

The warranty period extends to the period of time during which the customer can extract the useful properties of the supplied goods (work performed, services rendered) without additional costs, except for the costs associated with proper operation, and is determined by the legislation of the Russian Federation.

221. The supplied goods must be new goods (goods that were not in use, repaired, including those that were not restored, for which the replacement of components was not carried out, consumer properties were not restored) unless otherwise provided by the requirements to the subject of the purchase.

222. It is not allowed to present to the purchased goods, works, services, terms of the contract performance requirements that are not specified in the procurement documentation. The requirements for purchased goods, works, services, as well as for the terms of the contract, apply equally to all participants, to the goods, works, services they offer, and to the terms of the contract.

223. When describing the procurement item in the competitive procurement documentation, the customer should be guided by following rules:

1) in the description of the subject of the procurement, the functional characteristics (consumer properties), technical and quality characteristics, as well as operational characteristics (if necessary) of the subject of the procurement are indicated;

2) the description of the subject of the procurement should not include requirements or indications in relation to trademarks, service marks, trade names, patents, utility models, industrial designs, the name of the country of origin of the goods, requirements for goods, information, works, services, provided that such requirements entail an unreasonable limitation of the number of participants in the procurement, unless there is another method that provides a more accurate and clear description of the specified characteristics of the procurement subject. At the same time, the parameters of the equivalence of goods, works, services, formed depending on the needs of the customer, are indicated in the documentation on competitive procurement.

20. Legal acts of customers, approving the requirements for certain types goods, works, services purchased by the customer himself, his territorial bodies (divisions) and subordinate organizations, must contain the following information:

a) the names of customers (territorial bodies (divisions) and organizations subordinate to them, in relation to which requirements are established for certain types of goods, works, services (including the marginal prices of goods, works, services);

b) a list of certain types of goods, works, services with an indication of the characteristics (properties) and their values.

Subparagraph "b" of paragraph 1 of this document may establish requirements for certain types of goods, works, services purchased by one or more customers (territorial bodies (divisions) and their subordinate organizations, and (or) standard costs to ensure the functions of a federal state body, the governing body of the state off-budget fund of the Russian Federation, determined in accordance with the Budget Code of the Russian Federation, the most significant institutions of science, education, culture and health (including, respectively, territorial bodies and subordinate state institutions), as well as the State Corporation for atomic energy"Rosatom", the State Corporation for Space Activities "Roskosmos" and their subordinate organizations.

24. Requirements for certain types of goods, works, services and standard costs are applied to justify the object and (or) objects of purchase of the respective customer, its territorial bodies and (or) subordinate organizations.

Article 19. Rationing in the field of procurement

1. Rationing in the field of procurement means the establishment of requirements for the goods, works, services purchased by the customer (including the marginal price of goods, works, services) and (or) regulatory costs to ensure the functions of state bodies, governing bodies of state extra-budgetary funds, municipal bodies (including, respectively, territorial bodies and subordinate state institutions, with the exception of state institutions, which, in accordance with the established procedure, form a state (municipal) task for the provision of state (municipal) services, performance of work).

2. For the purposes of this article, the requirements for the goods, works, services purchased by the customer are understood as requirements for the quantity, consumer properties (including quality characteristics) and other characteristics of goods, works, services that allow to meet state and municipal needs, but do not lead to purchases of goods, works, services that have excessive consumer properties or are luxury items in accordance with the legislation of the Russian Federation.

3. The Government of the Russian Federation establishes general rules for rationing in the field of procurement to meet state and municipal needs, including:
1) general requirements for the procedure for the development and adoption of legal acts on rationing in the field of procurement, the content of these acts and ensuring their implementation;
2) general rules for determining the requirements for certain types of goods, works, services purchased by customers (including the marginal prices of goods, works, services) and standard costs for ensuring the functions of state bodies, governing bodies of state extra-budgetary funds, municipal bodies (including, respectively, territorial bodies and subordinate state institutions).

4. The Government of the Russian Federation, the highest executive bodies state authorities of the constituent entities of the Russian Federation, local administrations, in accordance with the general rules of regulation provided for in part 3 of this article, establish the rules for regulation in the field of procurement of goods, works, services to meet, respectively, federal needs, the needs of the constituent entities of the Russian Federation and municipal needs (hereinafter - the rules of regulation ), including:
1) requirements for the procedure for the development and adoption of legal acts on rationing in the field of procurement, the content of these acts and ensuring their implementation;
2) the rules for determining requirements for procured by state bodies, governing bodies of state extra-budgetary funds, municipal bodies, respectively, by their territorial bodies and state institutions subordinate to these bodies, budgetary institutions and state, municipal unitary enterprises certain types of goods, works, services (including the marginal prices of goods, works, services) and standard costs for ensuring the functions of state bodies, governing bodies of state extra-budgetary funds, municipal bodies (including, respectively, territorial bodies and subordinate state institutions).

5. State bodies, governing bodies of state extra-budgetary funds, municipal bodies, on the basis of the rationing rules established in accordance with part 4 of this article, approve the requirements for the state institutions, budgetary institutions and state , municipal unitary enterprises for certain types of goods, works, services (including the marginal prices of goods, works, services) and (or) regulatory costs to ensure the functions of these bodies and their subordinate government institutions.

6. Rationing rules, requirements for certain types of goods, works, services (including the marginal prices of goods, works, services) and (or) standard costs for ensuring the functions of state bodies, governing bodies of state extra-budgetary funds, municipal bodies (including, respectively, territorial bodies and subordinate state institutions) are subject to placement in a single information system.

1. These General Rules establish the procedure for determining the requirements for certain types of goods, works, services purchased by customers (including the marginal prices of goods, works, services).

The State Atomic Energy Corporation "Rosatom" and the State Corporation for Space Activities "Roskosmos" approve the requirements for the certain types of goods, works, services purchased by them (including the marginal prices of goods, works, services) in the manner prescribed by these General rules.

The type of goods, works, services for the purposes of these General Rules means the types of goods, works, services corresponding to the 6-digit position code according to the All-Russian Classifier of Products by Economic Activity.

2. The Government of the Russian Federation, the supreme executive bodies of state power of the constituent entities of the Russian Federation and local administrations shall establish the rules for determining the requirements for procured them to certain types of goods, works, services (including the marginal prices of goods, works, services) to meet, respectively, federal needs, the needs of the constituent entities of the Russian Federation and municipal needs (hereinafter referred to as the rules for determining requirements).

3. Requirements for procured by state bodies, governing bodies of state extra-budgetary funds, municipal bodies, their territorial bodies (divisions) and subordinate state institutions, budgetary institutions and unitary enterprises for certain types of goods, works, services (including the marginal prices of goods, works , services) are approved by state bodies, governing bodies of state extra-budgetary funds and municipal bodies in the form of a list of certain types of goods, works, services for which consumer properties (including quality characteristics) and other characteristics that affect the price of certain types of goods are established , works, services (hereinafter - the departmental list).

4. The rules for determining the requirements provide:

a) a mandatory list of certain types of goods, works, services, their consumer properties and other characteristics, as well as the values ​​of such properties and characteristics (including the marginal prices of goods, works, services) (hereinafter - the mandatory list) and (or) the obligation of state bodies, governing bodies of state extra-budgetary funds and municipal bodies to establish the values ​​of the specified properties and characteristics;

b) the procedure for the formation and maintenance by state bodies, governing bodies of state extra-budgetary funds and municipal bodies of the departmental list, as well as approximate form departmental list;

c) the procedure for applying the mandatory criteria for the selection of certain types of goods, works, services specified in clause 11 of these General Rules, the meaning of these criteria, as well as additional criteria not defined by these General Rules and not leading to a narrowing of the departmental list, and the procedure for their application.

5. The rules for determining requirements may provide for the following information, additionally included by state bodies, governing bodies of state non-budgetary funds and municipal bodies in the departmental list:

a) certain types of goods, works, services not indicated in the mandatory list;

b) characteristics of goods, works, services that are not included in the mandatory list and do not lead to unreasonable restrictions on the number of participants in the procurement;

c) the values ​​of quantitative and (or) qualitative indicators of characteristics (properties) of goods, works, services that differ from the values ​​contained in the mandatory list, in the cases provided for by the rules for determining requirements. In this case, such values ​​should be justified, including using the functional purpose of the goods, which, for the purposes of these General Rules, means the purpose and conditions of use (application) of the goods, allowing the goods to fulfill their main purpose, auxiliary functions or determining the universality of the use of the goods (fulfillment relevant functions, works, provision of relevant services, territorial, climatic factors, and more);

d) other information concerning the procurement of goods, works, services not provided for by these General Rules.

6. Mandatory list and departmental list are formed taking into account:

a) the provisions of technical regulations, standards and other provisions stipulated by the legislation of the Russian Federation, including the legislation of the Russian Federation on energy conservation and energy efficiency and the legislation of the Russian Federation in the field of environmental protection;

b) the provisions of Article 33 of the Federal Law "On the contract system in the procurement of goods, works, services to meet state and municipal needs";

c) the principle of ensuring competition, determined by Article 8 of the Federal Law "On the contractual system in the procurement of goods, works, services to meet state and municipal needs."

7. The departmental list is formed taking into account the functional purpose of the goods and must contain one or more of the following characteristics in relation to each separate type of goods, works, services:

a) consumer properties (including quality and other characteristics);

b) other characteristics (properties) that are not consumer properties;

c) marginal prices of goods, works, services.

8. The departmental list approved by state bodies, governing bodies of state extra-budgetary funds and municipal bodies should allow meeting state and municipal needs, but not lead to the procurement of goods, works, services that have excessive consumer properties (functional, ergonomic, aesthetic, technological, environmental properties, properties of reliability and safety, the values ​​of which are not determined by their suitability for operation and consumption in order to provide state (municipal) services (perform work) and implement state (municipal) functions) or are luxury goods in accordance with the legislation of the Russian Federation.

9. The obligatory list is drawn up in the form according to the appendix and can be supplemented with information provided for by the rules for determining requirements.

10. Certain types of goods, works, services are included in the mandatory lists contained in the rules for determining requirements approved by the highest executive bodies of state power of the constituent entities of the Russian Federation and local administrations, in accordance with the mandatory criteria specified in paragraph 11 of these General Rules, the values ​​of which are calculated based on from payments under contracts and from the number of contracts concluded in order to meet the needs of the corresponding constituent entity of the Russian Federation, or municipality, and if additional criteria are established in accordance with subparagraph "c" of paragraph 4 of these General Rules, in accordance with such criteria. 11. Mandatory criteria for the selection of certain types of goods, works, services used in the formation of the departmental list are at the same time:

a) the share of payment for a particular type of goods, work, services (in accordance with payment schedules) under contracts, information about which is included in the register of contracts concluded by customers, and the register of contracts containing information constituting a state secret, by a state body, a state governing body off-budget funds of the Russian Federation, a municipal body, their territorial bodies and their subordinate state institutions, budgetary institutions and unitary enterprises in the total amount of payment under contracts included in these registers (according to payment schedules) concluded by the relevant state bodies, governing bodies of state off-budget funds of the Russian Federation, municipal bodies, their territorial bodies and state institutions subordinate to them, budgetary institutions and unitary enterprises;

b) the share of contracts for the purchase of certain types of goods, works, services of state bodies, governing bodies of state extra-budgetary funds, municipal bodies, their territorial bodies and state institutions subordinate to them, budgetary institutions and unitary enterprises in the total number of contracts for the purchase of goods, works, services , concluded by the relevant state bodies, governing bodies of state extra-budgetary funds, municipal bodies, their territorial bodies and state institutions subordinate to them, budgetary institutions and unitary enterprises.

12. The values ​​of consumer properties (including quality) and other characteristics (properties) of certain types of goods, works, services used in the formation of the mandatory list are established in quantitative and (or) qualitative indicators, indicating (if necessary) the units of measurement in accordance with the All-Russian classifier of units of measurement.

Quantitative and (or) qualitative indicators of characteristics (properties) of certain types of goods, works, services can be expressed in the form of an exact value, a range of values ​​or a ban on the use of such characteristics (properties).

The marginal prices of goods, works, services are set in rubles in absolute monetary terms (accurate to 2 decimal places).

13. Requirements for certain types of goods, works, services are determined taking into account the categories and (or) groups of positions of employees, if the costs of purchasing certain types of goods, works, services to ensure the functions of state bodies, governing bodies of state non-budgetary funds of the Russian Federation, state bodies constituent entities of the Russian Federation, governing bodies of territorial state off-budget funds, municipal bodies (including, respectively, territorial bodies, government institutions subordinate to them) in accordance with the rules for determining standard costs approved, respectively, by the Government of the Russian Federation, the supreme executive bodies of state power of the constituent entities of the Russian Federation, local administrations, are established taking into account the categories and (or) groups of positions of employees.

Requirements for certain types of goods, works, services purchased by state and municipal government institutions, budgetary institutions and unitary enterprises are delimited by categories and (or) groups of positions of employees of these institutions and enterprises according to the staffing table.

14. The unit price of goods, works, services planned for procurement cannot be higher than the marginal price of goods, works, services established in the departmental list.

15. The marginal prices of goods, works, services established by the Government of the Russian Federation, the highest executive bodies of state power of the constituent entities of the Russian Federation, local administrations may not exceed the marginal prices of goods, works, services established by these bodies when approving the normative costs of ensuring the functions of state bodies , governing bodies of state extra-budgetary funds of the Russian Federation, state bodies of the constituent entities of the Russian Federation, governing bodies of territorial state extra-budgetary funds, municipal bodies (including, respectively, territorial bodies, state institutions subordinate to them).

16. Values ​​of characteristics (properties) of certain types of goods, works, services (including the marginal prices of goods, works, services) included in the mandatory list contained in the rules for determining requirements and purchased for the heads of the State Atomic Energy Corporation "Rosatom" and the State Corporation for Space Activities "Roscosmos", institutions of science, education, culture, health, which are the most significant in accordance with the legislation of the Russian Federation, cannot exceed (if an upper limit value is set) or be lower (if a lower limit value is set) values characteristics (properties) of the corresponding individual types of goods, works, services (including the marginal prices of goods, works, services) established by the rules for determining requirements approved by the Government of the Russian Federation for a civil servant replacing the position of a head or deputy head of a federal agency, belonging to the highest group of positions civil service category "managers".

1.1. The rules for rationing in the field of procurement of goods, works, services to meet the needs of the administration of the Aminevsky rural settlement (hereinafter referred to as the Rules) determine the requirements for the procedure for the development, content, adoption and execution of legal acts on rationing in the field of procurement of local self-government bodies of the administration of the Aminevsky rural settlement, which are the main manager of the budgetary funds of the rural settlement, performing the functions and powers of the founder, in the jurisdiction of which is the corresponding customer (hereinafter - the main managers of budgetary funds).

1.2. Funding for the development of legal acts of the main administrators of budgetary funds on rationing in the field of procurement is carried out at the expense of budgetary funds.

1.3. The following terms and definitions are used in these Rules:

1.3.1. Legal act on rationing in the field of procurement - a legal act that establishes requirements for purchased certain types of goods, works, services (including the marginal prices of goods, works, services) and (or) regulatory costs for ensuring the functions of state bodies;

1.3.2. Customers are local government bodies, their territorial bodies (divisions), subordinate state and budgetary institutions, as well as autonomous institutions and state unitary enterprises, which are subject to the provisions of the Federal Law of April 5, 2013. No. 44-FZ "On the contractual system in the field of procurement of goods, works, services to meet state and municipal needs";

1.3.2. End consumers - individuals, in order to meet the needs of which customers purchase goods, works, services, if such needs are satisfied in the process of execution by customers state functions, provision of state and other (medical, educational, etc.) services in accordance with the legislation of the Russian Federation and the Chelyabinsk region.

II ... Requirements for the development of legal acts on regulation in the field of procurement

2.1. The development of draft legal acts on rationing in the field of procurement is carried out in accordance with the rules established for the development of draft legal acts.

2.2. The development of a legal act on rationing in the field of procurement is carried out by a commission. The composition of the commission and the procedure for its work are determined by the main manager of the budgetary funds of the municipal district. The commission includes representatives of customers subordinate to the main manager of budgetary funds. If the development of a legal act on regulation in the field of procurement requires special knowledge, experience, qualifications, including in the field of science, technology, art or craft, the commission has the right to involve experts, expert organizations.

2.3. The draft legal act on regulation in the field of procurement, as well as a set of other documents justifying the adoption of the relevant legal act, are subject to mandatory public discussion. The set of documents justifying the adoption of the draft legal act on rationing in the field of procurement includes explanatory note containing the following information:

information about the developer of the draft legal act on rationing in the field of procurement;

normative justification for the development of a legal act on rationing in the field of procurement;

goals and objectives of the development of a draft legal act on regulation in the field of procurement;

information on the mechanisms of rationing in the field of procurement in the relevant industry, the implementation of which is aimed at the development of a draft legal act;

information on the procedure for monitoring the implementation of the legal act on rationing in the field of procurement;

information on the relationship of the developed draft legal act with other regulatory legal acts;

other information (at the discretion of the main manager of budgetary funds).

2.4. Public discussion of the draft legal act on rationing in the field of procurement is carried out in accordance with the procedure established by the legislation on mandatory public discussion of procurement to meet the needs of the administration of the Aminevsky rural settlement, taking into account the following features:

2.4.1. Public discussion of the draft legal act on rationing in the field of procurement at the first stage is carried out within thirty days from the date of placement by the chief manager of budgetary funds, responsible for the development of the corresponding draft legal act on rationing in the field of procurement, at the forum for conducting a mandatory public discussion of procurement (hereinafter - forum) of the draft legal act on regulation in the field of procurement, as well as a set of documents justifying the adoption of the relevant legal act.

2.4.2. Public discussion of the draft legal act on rationing in the field of procurement at the second stage is carried out through a face-to-face meeting, organized by the main manager of budgetary funds, responsible for the development of the draft legal act on rationing in the field of procurement. The face-to-face meeting must be attended by members of the commission participating in the development of a draft legal act on rationing in the field of procurement. An in-person meeting must be scheduled on a working day and held no later than seven working days from the end of the first stage of public discussion of the draft legal act on rationing in the field of procurement.

2.4.3. Based on the results of public discussion of the draft legal act on rationing in the field of procurement at the second stage, the main manager of budgetary funds responsible for the development of the relevant draft legal act, no later than the day following the day of the in-person meeting, draws up and posts on the forum a final protocol, which should contain all received comments and suggestions of the meeting participants, answers of the main manager of budgetary funds, as well as information on the need to finalize the relevant draft legal act on rationing in the field of procurement.

2.4.4. If, based on the results of public discussion of a draft legal act on rationing in the field of procurement, a decision is made to revise it, such revision must be made within a period of no more than ten working days. The revised draft legal act in the field of procurement is subject to repeated public discussion in the manner prescribed by clauses 2.3 - 2.4 of these Rules. At the same time, public discussion of the revised draft legal act on rationing in the field of procurement at the first stage is carried out within ten days from the date of placement by the main manager of budgetary funds responsible for the development of the corresponding draft legal act on rationing in the field of procurement, at the forum of the revised draft legal act on rationing in the field of procurement, as well as a set of documents justifying the adoption of the relevant legal act.

2.5. Legal acts on rationing in the field of procurement are approved by the main administrators of budgetary funds in accordance with their competence and taking into account these Rules.

2.6. Approved legal acts on rationing in the field of procurement are subject to placement in a unified information system in the field of procurement in accordance with part 6 of article 19 of the Federal Law of April 5, 2013 No. 44-FZ "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs "And on the website of the information and telecommunications network" Internet ".

2.7. If, by the decision of the main manager of budgetary funds, the legal act on rationing in the field of procurement requires a change, then such a change is carried out in the manner prescribed by this section of the Rules.

III ... Requirements for the content of a legal act on regulation in the field of procurement

3.1. The legal act on rationing in the field of procurement must contain requirements for certain types of goods, works, services purchased by customers. The list of certain types of goods, works, services, in respect of which legal acts on rationing in the field of procurement are adopted, is approved by the main manager of budgetary funds.

3.2. Requirements for purchased goods, works, services include requirements for quantity, quality, consumer properties and other characteristics of goods, works, services, allowing to meet the needs of customers, but not leading to the purchase of goods, works, services that have excessive consumer properties or are luxury goods in accordance with the legislation of the Russian Federation.

3.3. When establishing requirements for the quantity of goods, works, services to be procured in a legal act on rationing in the field of procurement, the following shall be taken into account:

the number of similar goods, works, services purchased by the main manager of budgetary funds and subordinate customers (based on their proposals) for the previous two-year period;

the presence (absence) of the fact of additional, in comparison with the planned at the beginning of the financial year, procurement of goods, works, services, due to the fact that the amount of previously purchased goods, works, services did not fully satisfy the need for the specified goods, works, services ;

presence (absence) of the fact of purchasing surplus goods, works, services for the previous two-year period;

the presence (absence) of prerequisites for an increase (decrease) in the quantity end consumers ordered goods, works, services;

the presence (absence) of the need to form a permanently available stock of a specific product, work, service (if the need for goods, works, services is permanent and additional procurement procedures can lead to a threat to the life and health of people, disruption of the production process.

3.4. A legal act on rationing in the field of procurement may contain other requirements for determining the number of goods, works, services and needs for them, depending on the scope and specifics of the activities of the main manager of budgetary funds and subordinate customers.

3.5. When establishing requirements for the quality of purchased goods, works, services in a legal act on rationing in the field of procurement, such requirements should be established on the basis of an analysis of consumption by the main manager of budgetary funds and subordinate customers (based on their proposals) for the previous two-year period of a specific product, work, services, and projected production (functional) needs for the subsequent period.

3.6. When establishing requirements for the quality of purchased goods, works, services, consumer properties and other characteristics of goods, works, services subject to procurement in a legal act on rationing in the field of procurement, the following shall be taken into account:

the degree of conformity of the quality, consumer properties and other characteristics of goods, works, services purchased by the main manager of budgetary funds and subordinate customers (based on their proposals) over the past two years, with the production (functional) needs of the customer and end consumers (if any);

presence (absence) of claims to quality, consumer properties, other characteristics of goods, works, services caused by insufficient elaboration or specification of requirements for quality, consumer properties and other characteristics of goods, works, services established by the procurement documentation;

the presence (absence) on the market of goods, works, services that more satisfy the needs of the customer in the process of implementing their functions or to end consumers, including if the cost of such goods, works, services exceeds the cost of previously purchased goods, works, services similar in quantity , quality, consumer properties and other characteristics. In this case, such properties of goods, works, services should be taken into account that ensure the most effective result of using the goods, work, services in the customer's activities, but do not lead to the presence of additional properties in the product, work, service that are not related to their intended purpose.

3.7. The legal act on rationing in the field of procurement should contain references to regulatory legal acts, the requirements of which the purchased goods, works, services (technical regulations, national standards, rules, regulations (standards), and other documents stipulated by the Federal Law of December 27 2002 № 184-ФЗ "On technical regulation".

3.8. A legal act on rationing in the field of procurement may contain other requirements for determining the requirements for quality, consumer properties and other characteristics of goods, works, services, depending on the scope and specifics of the activities of the main manager of budgetary funds and subordinate customers.

3.9. When establishing requirements for quality, consumer properties and other characteristics of certain types of goods, works, services, requirements or instructions in relation to trademarks, service marks, brand names, patents, utility models, industrial designs, the name of the place of origin of goods or the name of the manufacturer should not be included ...

3.10. The legal act on rationing in the field of procurement must contain the maximum prices of goods, works, services or information on the procedure for forming the maximum price of goods, works, services.

3.11. When forming the maximum price of goods, works, services, the following can be used:

data from state statistical reporting;

data from the register of contracts;

information on producer prices;

publicly available results of market research, market research carried out by the main manager of budgetary funds both independently and with the involvement of third parties;

other sources of information.

3.12. The procurement regulation regulation may contain the normative costs of providing customer functions.

3.13. The standard costs for ensuring the functions of customers are formed, inter alia, on the basis of data on the number of employees participating in the performance of the functions of customers, the nomenclature and quantity of goods, works, services required to perform the functions of customers.

3.14. The formation of normative costs for ensuring the functions of customers is carried out taking into account the planned number of end users for the next financial year if the volume of costs of customers for performing the function depends on the number of end users.

3.15. The legal act on rationing in the field of procurement must contain a provision on the responsibility of the customer's officials for failure to comply with the requirements contained in the specified act.

IV ... Final provisions

4.1. In case of failure to comply with these Rules, officials customers are responsible in accordance with the legislation of the Russian Federation.

2. 3. The criteria for the selection of certain types of goods, works, services purchased to meet federal needs, the requirements for which are established by this decree, are:

goods, works, services, the share of expenses for the acquisition of which to meet federal needs according to the corresponding code of the All-Russian Classifier of Products by Types of Economic Activity (OKPD) in the total amount of expenses of authorities and customers for the purchase of goods, works, services is at least 20 percent;

goods, works, services, the share of the number of contracts for the purchase of which to meet federal needs according to the corresponding OKPD code in the total number of contracts for the purchase of goods, works, services concluded by the authorities and customers is at least 20 percent.

4. When forming the Departmental List, the authorities have the right to include in it additionally:

certain types of goods, works, services not specified in the Mandatory List;

characteristics of goods, works, services not included in the Mandatory List;

establish, in the cases established by these Requirements, the values ​​of quantitative and (or) qualitative indicators of characteristics that differ from the values ​​contained in the Mandatory List. In this case, such values ​​must be justified (performance of relevant functions, works, provision of relevant services, territorial, climatic factors, etc.).

5. When the authorities are included in the Departmental List of certain types of goods, works, services that are not specified in the Mandatory List, they apply the criteria established in paragraph 3 of these Requirements as a percentage of the volume of purchases carried out by them and their customers.

6. The requirements established by the authorities should allow meeting federal needs, but not lead to the procurement of goods, works, services that have excessive consumer properties (functional, ergonomic, aesthetic, technological, environmental properties, reliability and safety properties, the values ​​of which are not determined by them. suitability for use and consumption in order to provide state (municipal) services (perform work) and implement state (municipal) functions) or are luxury goods in accordance with the legislation of the Russian Federation.

7. Requirements for certain types of goods, works, services included in the Departmental List may be established taking into account the categories or groups of positions of employees.

8. In order to include in the Departmental List of certain types of goods, works, services not specified in the Mandatory List, the authorities have the right to apply the criteria established by paragraph 3 of these Requirements in relation to the volume of expenses and the number of contracts of the authority and customers, as well as determine additional criteria, including the rules for their application.

9. Goods, works, services additionally included in the Departmental List must differ from those specified in the Mandatory List of Goods, Works, Services by the code of goods, works, services in accordance with the OKPD.

10. Maximum prices for certain types of goods, works, services are established by the authorities in the requirements for the specified goods, works, services on the basis that the determination of the maximum price is aimed at limiting the purchase of goods, works, services with excessive consumer properties, if such the limitation is not established when determining the requirements for quality, consumer properties and other characteristics of goods, works, services.

In the field of procurement, the definition of requirements for certain types of goods, works, services for state needs is actually the second stage in the implementation of the standardization tool. This article analyzes the provisions of regulations governing this type of regulation.

Standard costs and requirements for goods, works, services are two interrelated and complementary types of rationing in the field of procurement. After determining the specific product (and its quantity) that must be purchased to ensure the performance of state and municipal functions, it is necessary to identify consumer properties (including quality characteristics) and other characteristics individual types of goods, works, services that have an impact on the price of certain types of goods, works, services required for state and municipal needs. This is necessary to exclude excessive consumer properties that are not conditioned by the suitability of products for use and consumption in order to provide state (municipal) services, to perform functions of government bodies. This thesis is easy to confirm by illustrating it with a simple example.

By establishing standards for the quantity and price within the framework of determining the standard costs, it becomes possible to determine the reasonable volume and maximum cost (in the “no more” format) of goods, works, services planned for procurement. It is obvious that in order to ensure the performance of its functions, a state body needs a service light vehicle. Excess of the actual number of cars Vehicle above the normative will not allow to justify and, therefore, to carry out their purchase.

At the same time, one should pay attention to the fact that the establishment of the maximum cost for the specified products does not in itself mean the possibility of purchasing it exclusively at such a price, since in fact it is the limit for a group of goods, and not the price of a specific model with known characteristics, due to the fact that any product has different consumer properties that affect its price. In the case under consideration, the establishment of appropriate restrictions in relation to the complete set of a car will ensure the purchase of vehicles in the required volume (if the need itself is justified), but without excessive consumer properties. Otherwise, it would be necessary to overpay for consumer properties that are not necessary, although the total cost of the purchased goods would remain within the established marginal price.

Basic provisions for the establishment of requirements for products

As mentioned above, the second type of rationing is the establishment of requirements for the goods, works, services purchased by the customer (including the marginal price of goods, works, services) in order to exclude purchases of products with excessive consumer properties or luxury goods. As in the case of regulatory costs, regulatory legal (legal) acts regulating the establishment of requirements for certain types of goods, works, services, in fact, represent a three-tier system ( picture 1). Unlike standard costs, which apply only to state bodies, governing bodies of state extra-budgetary funds and municipal bodies (including their territorial bodies and subordinate state institutions), requirements for goods, works, services also apply to budgetary institutions.

In accordance with the General Rules, the Government of the Russian Federation, the highest executive bodies of state power of the constituent entities of the Russian Federation, local administrations establish the rules for determining the requirements for certain types of goods, works, services (including the marginal prices of goods, works, services) to ensure, respectively, federal needs, the needs of the constituent entities RF and municipal needs applicable to customers specified in part 5 of article 19 of Law No. 44-FZ.

Further, in pursuance of clause 2 of part 4 of Article 19 of Law No. 44-FZ, the specified rules for federal needs are established by Decree of the Government of the Russian Federation of September 2, 2015 No. 927 (hereinafter referred to as the Rules, Resolution No. 927). Federal state bodies and governing bodies of state non-budgetary funds of the Russian Federation (hereinafter referred to as bodies), on the basis of the Rules, approve requirements for certain types of goods, works, services purchased by them, their territorial bodies and subordinate state and budgetary institutions, including a list of certain types of goods, works, services, their consumer properties (including quality) and other characteristics (including the marginal prices of goods, works, services) (hereinafter referred to as the Departmental List). Thus, the requirements for certain types of goods, works, services are established in the form of a Departmental List. It should be noted that the establishment of requirements for the entire range of goods, works, services purchased for public needs is an ineffective measure, therefore, only certain types of products should be subject to rationing.

To meet federal needs, the Government of the Russian Federation has identified certain types of goods, works, services for which rationing is mandatory (hereinafter referred to as the Mandatory List) ( Table 1). Specified species required for inclusion by the authorities in the Departmental List.

In addition to mandatory certain types of goods, works, services, certain types of products that are not included in the Mandatory List, which are determined by the authorities independently in accordance with the Rules, are additionally subject to inclusion in the Departmental List. These types of goods, works, services to meet federal needs are subject to inclusion , if the arithmetic mean sum of the values ​​of the following two criteria, determined by the Government of the Russian Federation, exceeds 20%, namely:

the share of expenses of the body, its territorial bodies and subordinate government and budgetary institutions for the purchase of a certain type of product for the reporting financial year in the total volume of their expenses for the purchase of products in the same period;

the share of contracts of the body, its territorial bodies and subordinate government and budgetary institutions for the purchase of a certain type of product, concluded in the reporting financial year, in the total number of their contracts concluded in the reporting financial year.

It should be noted that the highest executive bodies of state power of the constituent entities of the Russian Federation, local administrations independently establish such threshold. And it may differ from the value by 20%. It should be borne in mind that the higher the specified value, the fewer certain types of goods, works, services will be subject to mandatory requirements.

Also, in order to form the Departmental List, bodies have the right to determine additional criteria for the selection of certain types of goods, works, services and the procedure for their application. At the same time, these additional criteria and the procedure for their application should not lead to a reduction in the value of the criteria established by the Government of the Russian Federation. In addition, the bodies, when forming the Departmental List, have the right to include in it additionally certain types of goods, works, services that do not meet the criteria established the Russian government... Thus, the Departmental List consists of certain types of goods, works, services ( picture 2):

  • included in the Mandatory List;
  • determined by the authorities in accordance with the criteria and the procedure for their application established by the Government of the Russian Federation and the authorities themselves (if established);
  • determined by the authorities at their own discretion and do not meet the criteria set by the government.

In relation to certain types of goods, works, services, consumer properties (including quality) and other characteristics (including the marginal prices of goods, works, services) and their value are indicated.

The Government of the Russian Federation in the Mandatory List has established the corresponding characteristics, which are subject to mandatory regulation, and their values. Moreover, this list contains certain types of goods, works, services, the values ​​of the characteristics for which have not been established. In this case, the authorities independently determine the values ​​of such characteristics and have the right to supplement the characteristics (properties) of goods, works, services included in the mandatory list. However, such actions should not lead to unreasonable restrictions on the number of participants in the procurement. The authorities also have the right to change the values ​​of quantitative and (or) qualitative indicators of characteristics (properties) of goods, works, services established by the Government of the Russian Federation. In this case, the indicated values ​​must be justified in the Departmental List.

When forming the Departmental List, the authorities should take into account the following requirements of clause 16 of the General Rules:

the values ​​of the characteristics (properties) of certain types of goods, works, services (including the marginal prices of goods, works, services) included in the Mandatory List and purchased for the heads of state and budgetary institutions may not exceed (if an upper limit value is set) or be below (if a lower limit value is set) the values ​​of the specified characteristics (properties) established by the Rules for a civil servant who replaces the position of the head (deputy head) of a structural unit of a federal state body, which belongs to the highest group of civil service positions in the category of “managers”;

the values ​​of the characteristics (properties) of certain types of goods, works, services (including the marginal prices of goods, works, services) included in the Mandatory List and purchased for employees of state and budgetary institutions who are not their heads cannot exceed (if the upper limit value) or be lower (if a lower limit value is set) of the specified values ​​of characteristics (properties) established by the Rules for a civil servant filling a position in a federal government agency belonging to the category of "specialists".

The departmental list is formed taking into account the functional purpose of the goods and must contain one or more of the following characteristics in relation to each separate type of goods, works, services:

  • consumer properties (including quality and other characteristics);
  • other characteristics (properties) that are not consumer properties;
  • marginal prices of goods, works, services.

For the type of product specified in Table 2, The Government of the Russian Federation has established the characteristics and their meaning. The bodies, taking into account the Rules, can:

  • change the characteristic values ​​established by the government with the justification for the specified change;
  • establish other (additional) characteristics of this type of product and determine their values.

Similarly, the body has the right to act in relation to the obligatory type of goods, works, services "Furniture for seating with a wooden frame", code according to OKPD 36.11.12.

As seen from table 3, in relation to the type of product specified in it, the Government of the Russian Federation has established two characteristics, while the values ​​have been established for only one of them. Therefore, the body:

  • is obliged to establish the values ​​of the characteristic "Material (metal)";
  • has the right to change the values ​​of the characteristic "Upholstery" established by the Government of the Russian Federation with the justification for the specified change;

With regard to contained in table 5 type of product The Government of the Russian Federation has established two characteristics without specifying their values. Therefore, the body:

  • is obliged to establish the values ​​of both characteristics determined by the government;
  • has the right to establish other (additional) characteristics of this type of product and determine their values.

The types of goods, works, services that need to be included in the additional list can be conditionally divided into two groups.

Group one. Certain types of goods, works, services not specified in the Mandatory List, determined in accordance with the criteria approved by the Government of the Russian Federation and additional selection criteria (if determined by the body).

In order to comply with the requirements for the application of the criteria determined by the Government of the Russian Federation, the body must have information on the volume of expenses it incurs for the purchase of goods, works, services and on the number of contracts it has concluded in the reporting financial year, taking into account its territorial bodies and government and budgetary institutions subordinate to it. The specified information should be structured according to certain types of goods, works, services, that is, according to six-digit position codes according to OKPD.

The example shows that from the entire list of goods, works, services purchased by the network of this body, two separate types of products fall into the Departmental List (highlighted in color), since the arithmetic average of the criteria determined by the government for these types exceeds 20%. At the same time, certain types of goods, works, and services additionally included in the Departmental List must differ from those indicated in the Mandatory List by a code in accordance with the OKPD.

For certain types of goods, works, services defined in accordance with the above criteria, the body determines the characteristics that will be standardized and / or the maximum price. In our opinion, only those characteristics that significantly affect the price of products should be normalized. According to such characteristics, the body sets values.

Group two. Certain types of goods, works, services that are not specified in the Mandatory List and do not meet the criteria approved by the Government of the Russian Federation.

The authorities, at their discretion, may additionally include in the Departmental List certain types of products that do not meet the mandatory criteria. For such products, the authority likewise establishes characteristics and / or price caps and their meaning.

Types of rationing: connection of regulatory legal acts

When establishing the values ​​of consumer properties and other characteristics (including marginal prices) of certain types of goods, works, services included in the Departmental List, the following should be taken into account. In accordance with clause 5 of the Requirements for determining standard costs for ensuring the functions of federal state bodies, governing bodies of state extra-budgetary funds of the Russian Federation, including state institutions subordinate to them (hereinafter referred to as the Requirements for determining standard costs), the bodies develop and approve individual (established for each employee) and (or) collective (established for several employees) formed by categories or groups of positions(based on the specifics of the functions and powers of the federal state body, job duties his employees) standards:

  • the number of subscriber numbers of user (terminal) equipment connected to the mobile network;
  • prices for mobile services;
  • the number of SIM cards;
  • prices and quantities of printers, multifunctional devices and copiers (office equipment);
  • the quantity and price of mobile communications;
  • the number and prices of tablet computers;
  • the number and prices of information carriers;
  • quantities and prices of consumables for various types of printers, multifunctional devices, copiers (office equipment);
  • a list of periodicals and reference books;
  • the number and prices of vehicles;
  • the quantity and price of furniture;
  • the quantity and price of office supplies;
  • the quantity and price of household goods and accessories;
  • quantities and prices of material stocks for the needs of civil defense;
  • other goods and services.

The specified standards should be used when determining the costs of purchasing such goods, works, services.

The Rules establish that if the Requirements for the determination of standard costs provide for the determination of the corresponding costs taking into account the categories and (or) groups of positions of employees, then the values ​​of consumer properties and other characteristics (including marginal prices) of certain types of goods, works, services included in the Departmental list, it is mandatory to establish also taking into account the categories and (or) groups of positions of employees of the body, its territorial bodies and subordinate government and budgetary institutions.
