GUIDELINES FOR THE DEVELOPMENT OF DRAFT STANDARDS FOR WASTE GENERATION AND LIMITS FOR THEIR DISPOSAL

I. General provisions

1. Guidelines for the development of draft standards for the generation of waste and limits for their disposal (hereinafter referred to as the Guidelines) are intended for individual entrepreneurs and legal entities(hereinafter referred to as business entities), as a result of their economic and other activities, waste is generated, and the territorial bodies of the Federal Service for Supervision in the Sphere of Natural Resources Management (hereinafter referred to as the territorial bodies of Rosprirodnadzor), which decide on the approval of waste generation standards and limits on waste disposal.

2. Guidelines establish a unified approach to the development and General requirements to the content and design of the draft standards for the generation of waste and limits for their disposal (hereinafter referred to as PNWLR), which substantiates the proposed handling of all waste generated in the course of economic and other activities of an economic entity, through their use, neutralization, disposal, as well as transfer to others business entities in order to further use, neutralization, placement.

3. The Guidelines do not apply to relations in the field of radioactive waste management, biological waste and medical waste<1>.

4. If an economic entity has a branch (s) and separate subdivisions located within the same subject of the Russian Federation, the PNOOLR is developed for the economic entity as a whole or separately for each branch and separate subdivision.

If an economic entity has a branch (s) and separate subdivisions located on the territory of several constituent entities of the Russian Federation, the PNOOLR is developed separately for each branch and separate subdivision.

5. The main tasks in the development of PNOOLR are:

determination (calculation) of waste generation standards;

determination (calculation) on the basis of waste generation standards and the volume of products produced (services rendered, work performed), the amount of waste generated annually;

justification of the amount of waste proposed for use and (or) neutralization;

justification of the amount of waste proposed for disposal in specific waste disposal sites.

6. When the territorial bodies of Rosprirodnadzor make a decision to approve the standards for the generation of waste and limits for their disposal, the following information is taken into account, contained in the PNOLR:

the presence on the production area and the capacity of equipped places (sites) for the accumulation of waste intended for the formation of a batch of waste for the purpose of their further use, neutralization, disposal, transfer to other business entities;

available technical capabilities for the use and (or) disposal of generated waste by an economic entity independently or through transfer to other economic entities;

the amount of waste offered for disposal;

the presence of waste disposal facilities operated by an economic entity or third-party organizations, as well as the available technical capabilities for placing in them the proposed amount of waste of each type and their hazard class;

the presence of waste disposal facilities operated by an economic entity or third-party organizations, in state register waste disposal facilities, formed Federal Service on supervision in the field of nature management in accordance with the Procedure

7. In order to confirm compliance with the approved waste generation standards and limits on their disposal generated during the reporting period, economic entities (their branch(s) or separate divisions) annually compile and submit to notification procedure to the relevant territorial bodies of Rosprirodnadzor a technical report on waste management.

8. A technical report on waste management is drawn up in order to:

confirmation of the types, hazard classes and amounts of wastes declared in the PNRLR, generated during the reporting period;

confirmation of the actual use, neutralization, disposal, transfer to other economic entities of waste generated during the reporting period.

II. Methods for determining (calculating) waste generation standards

9. The NWLR provides justifications for the proposed norms for the generation of specific types of waste on average per year based on the norms for waste generation. The proposed norms for the generation of specific types of waste on average per year are indicated in tons per year.

The proposed norm of waste generation on average per year is determined on the basis of the norm of waste generation.

The waste generation standard determines the established amount of waste of a particular type in the production of a unit of production. For the unit of account of products (works, services), depending on the source of waste generation, the following is accepted:

a unit of manufactured products, a unit of used raw materials - for production waste;

unit of distance (e.g. kilometer) - for service waste Vehicle;

area unit - for waste when cleaning the territory;

people - for waste generated in residential premises;

unit of place - for hotels, canteens and other organizations and institutions.

The standard for waste generation, on average per year, is determined by the formula N 1:

where - the proposed standard for the generation of waste on average per year in tons;

Waste generation standard, tons per unit of account;

Q - the proposed annual volume of manufactured products, processed raw materials, services performed, in relation to which the waste generation standard is calculated.

The calculation of the proposed norms for the generation of waste on average per year, resulting from the wear of materials and products for which limitations on the service life are established in the technical documentation, can be determined without first determining the norm for the formation of waste according to formula No. 2:

Weight of materials, products recognized as waste;

T - the service life of the material, product.

10. Waste generation standards, depending on the nature of waste-generating processes and the possibility of obtaining initial data for calculation, are determined using following methods:

method of calculation according to the material and raw materials balance;

calculation method according to specific industry standards for waste generation;

calculation and analytical method;

experimental method;

calculation method based on actual volumes of waste generation (statistical method).

11. The material and raw material balance is the basic one when rationing the formation of production waste. The calculation of the material and raw material balance is used in determining the standards for waste generation in industries using different types raw materials or products. The initial data for the calculation are:

the amount of raw materials and materials used per unit of time;

the amount of raw materials and materials converted into products;

the number of products produced;

norms of natural loss;

the amount of substances emitted into the atmospheric air and discharged with wastewater.

Technological maps, descriptions of recipes, technological regulations and other documentation regulating the use of raw materials and materials, materials for accounting for the consumption of raw materials and materials, obtaining products, the results of an inventory of sources of emissions, discharges of pollutants, sources of waste generation, control data are used as initial data for the calculation. emissions, discharges and waste generation. The initial data are recorded in tabular form (Appendix N 1 to the Guidelines).

Depending on the available set of initial data, the calculation of waste generation standards can be carried out according to several options.

If there is data on the amount of waste and output per unit of time, the standard for waste generation is determined by formula N 3:

Waste generation standard, tons per unit of production;

O is the amount of waste generated per unit of time in tons;

q - the volume of products produced per unit of time.

In the absence of data on the amount of waste per unit of time, if there is information on the amount of raw materials and materials that go into products, the sum of all waste generated during a unit of time is calculated using formula No. 4:

The sum of all waste per unit of time, tons;

The total amount of raw materials and materials received in production per unit of time, tons;

The total amount of raw materials and materials used for the production of products per unit of time, tons;

The sum of the inevitable irretrievable losses of raw materials (materials) in the production process per unit of time, tons;

The total amount of pollutants in the composition of emissions into the atmospheric air per unit of time, tons;

The total amount of pollutants in the composition of discharges per unit of time, tons.

In this case, the waste generation standard is determined by the formula N 5:

In the absence of data on the amount of raw materials and materials used for the production of products, if there is information on the amount of output per unit of time, in formula No. 4, the value is replaced by , which is the total amount of output in tons per unit of time.

In the event of the formation of one type of waste in the production of several types of products, it is allowed to use the group standard for the generation of waste. To calculate the group standard for waste generation, the total volume of waste generation is first determined according to the formula N 6:

Total total volume of waste generation;

Waste generation standard in the waste-generating process in the production of each type of product, tons;

The volume of output of the i-th type of product;

i - index of the type of products produced (i = 1, 2, 3, 4 ... m).

The group standard for waste generation per unit of gross output is determined by formula N 7:

If the documentation specified in paragraph 7 of this paragraph does not contain the necessary data to calculate the waste generation standards, field measurements are carried out to obtain them.

12. The calculation method according to specific industry standards for waste generation is based on the use of reference tables of specific indicators of waste generation by types of economic activity.

Specific industry standards for waste generation are being developed:

by adopting, on average per year, individual values ​​of waste generation standards for industry organizations;

by calculating average specific indicators based on the analysis of reporting information for a certain (base) period, highlighting the most important (expert established) norm-forming factors and determining their impact on the value of standards for the proposed period.

13. The calculation and analytical method is applied in the presence of design and technological documentation ( technological maps, recipes, regulations, working drawings) for the production of products in which waste is generated. On the basis of such documentation, in accordance with the established norms for the consumption of raw materials (materials), the waste generation rate () is calculated as the difference between the consumption rate of raw materials (materials) per unit of production and their net (useful) consumption, taking into account the inevitable irretrievable losses of raw materials.

The calculation is carried out according to the formula N 8:

N - consumption rate of raw materials (materials) per unit of output, tons;

P - consumption of raw materials (materials) necessary for the implementation of the production process (work) per unit of output, tons;

Inevitable irretrievable losses of raw materials (materials) in the production process per unit of output, tons.

The standard for waste generation is determined by the formula N 9:

Coefficient of inevitable losses of raw materials (materials) ().

The standard for waste generation as a percentage or as a yield coefficient for secondary raw materials () is determined by the formula N 10:

where is the coefficient of use of raw materials (materials) in the production of products ().

According to formulas N 8 - 10, the standards for the formation of each type of waste are determined.

The amount (volume) of waste generation (), which is calculated as the product of the waste generation standard resulting from the use of raw materials (), by the volume (quantity) of raw materials used, materials (). The calculation is carried out according to the formula N 11:

The volume of raw materials used.

Waste generation standard.

Group standards for waste generation per unit of gross output are determined by formula N 12:

The volume of manufactured products of this type;

i - index of the type of manufactured products (i = 1, 2, ... m).

The results of calculations of waste generation standards by the calculation and analytical method are drawn up in tabular form (Appendices No. 2, 3, 4 to the Methodological Instructions).

14. The experimental method, which consists in determining the standards for waste generation based on experimental measurements in production conditions, is used to technological processes, allowing a certain range of changes in the constituent elements of raw materials (in foundry, chemical, food, microbiological and other industries), as well as with high labor intensity of analytical calculations. Initially, on the basis of statistical processing of experimental measurements of the mass of a useful product obtained from a unit mass of raw materials (materials), an indicator is determined that characterizes the share of a useful product in a unit of raw materials in percent (). Based on the value of this indicator and data on the mass of the useful product extracted from the raw material (), the mass of waste generation is determined () according to the formula N 13:

The standard for the formation of waste per unit of manufactured products () is determined by the formula N 14:

where is the quantity of products in the production of which waste is generated.

For products that are in the development stage, waste generation standards are determined experimentally based on measuring the mass of waste in the production of the most typical types of products and determining average indicators for this type of product.

15. The calculation method based on the actual volumes of waste generation (statistical method) is used to determine the standards for waste generation based on statistical processing of information on waste management for the base (at least 3 years) period, followed by data adjustment in accordance with the proposed measures to reduce material consumption of manufactured products.

The initial data for calculating the waste generation standard for raw materials or products and the results of calculating the standard are formed in tabular form (Appendix No. 5 to the Methodological Instructions). In this case, the specific amount of waste generation is first determined for each year for the period under consideration. The specific amount of waste generation is calculated by dividing the amount of generated waste (columns 13 - 15) by the amount of raw materials used (columns 3 - 5) or manufactured products (columns 8 - 10).

The standard for waste generation is determined by the formula N 15:

The specific amount of education in i-th year waste;

T is the number of years in the period under consideration.

II. Content and design of the draft standards for waste generation and limits for their disposal

In the electronic document, the numbering of paragraphs corresponds to the official source.

16. PNRLR is compiled on paper in two copies, one of which is kept by the economic entity, and the second, together with its electronic version on electronic media, is submitted to the relevant territorial body of Rosprirodnadzor.

PNOOLR can be submitted using electronic documents signed with a simple electronic signature in accordance with the requirements of the Federal Law of 04/06/2011 N 63-FZ "On Electronic Signature" (Sobranie Zakonodatelstva Rossiyskoy Federatsii, 2011, N 15, art. 27, item 3880; 2012, N 29, item 3988; 2013, N 14, item 1668; N 27, item 3463; N 27, item 3477; 2014, N 11, item 1098; N 26, article 3390).

17. The PNOOLR includes:

title page (Appendix No. 6 to the Guidelines);

structure of PNOOLR;

general information about the business entity;

information about economic and other activities;

calculation and justification of the proposed standards for waste generation on average per year;

information about the proposed generation of waste;

information about the places of accumulation of waste;

information on the proposed annual transfer of waste to other economic entities for the purpose of their further use, and (or) neutralization, and (or) disposal;

information on the proposed annual use of waste and (or) waste disposal;

information on the proposed disposal of waste at independently operated (own) waste disposal sites;

proposals for annual waste disposal limits;

list of sources used;

applications.

18. The section "General information about the economic entity" PNOOLR contains:

taxpayer identification number (hereinafter - TIN);

codes according to the All-Russian classifier of organizational and legal forms (OKOPF), the All-Russian classifier of fixed assets (OKOFS), the All-Russian classifier of types of economic activity (OKVED), the All-Russian classifier of objects of administrative-territorial division (OKATO), the All-Russian classifier of territories municipalities(OKTMO);

type of main economic and other activity;

a list of the branch(s) and separate subdivisions, information on which is included in the PNOOLR, and their locations;

list of self-operated (own) waste disposal facilities.

19. In the section "Information on economic and other activities" PNOOLR in text form is given a brief description of and indicators of economic and other activities in the course of which waste is generated.

For each structural unit(workshop, site and other facilities), information on which is included in the PNOOLR, are presented flowcharts of technological processes, including in the form of separate blocks:

used raw materials, materials, semi-finished products, other;

production operations (without detailing production processes);

manufactured products (rendered services, performed works);

generated waste (by origin or conditions of formation);

waste management operations, including their accumulation, use, disposal, disposal, as well as the transfer of waste to other structural units or other business entities.

20. In the section "Calculation and justification of the proposed norms for the generation of waste on average per year" PNOOLR presents calculations of the norms for the formation of waste, calculated (defined) for each type of waste using the methods for determining (calculating) the norms for the formation of waste, given in section II of these Guidelines .

Calculations of standards for each type of waste are drawn up in a separate subsection of the PNOOLR.

The initial data for calculations made by the methods of material and raw material balance, settlement-analytical and statistical, should be presented in tabular form (Appendix No. 1 to the Methodological Instructions). When using the method of calculation by specific indicators, it is allowed to present calculations and justifications in text form.

In text form, for each type of waste, links are given to the relevant sources of information, as well as to applications that certify quantitative indicators.

At the end of the section, based on the results of the calculations, a general list of generated waste is formed with an indication of the calculated proposed standards for the generation of waste on average per year (Appendix No. 7 to the Methodological Instructions).

21. In the section "Information on the proposed generation of waste" PNOLR in tabular form provides information on the proposed annual generation of waste separately for each structural unit (workshop, site and other facilities) of an economic entity, information on which is included in the PNRLR (Appendix No. 8 to the Methodological instructions) and summary information on the proposed total annual waste generation for the economic entity (its branch(s) and separate divisions), in general (Appendix No. 9 to the Methodological Instructions).

For all wastes included and not included in the federal classification catalog of wastes, formed by Rosprirodnadzor in accordance with the Procedure specified in paragraph 6 of the Guidelines, the hazard class is indicated, determined in accordance with the procedure for classifying wastes of I-IV hazard classes to a specific hazard class and ( or) criteria for classifying wastes as I-V hazard classes according to the degree of negative impact on environment approved by the Ministry of Natural Resources and Ecology of the Russian Federation<1>.

At the same time, Annexes No. 8 and No. 9 to the Methodological Instructions indicate the details of the letter on the direction by the economic entity to the appropriate territorial body of Rosprirodnadzor of documents confirming the assignment of the type of waste to a specific hazard class.

business entities, the main economic activity which is the collection of waste from individuals for the purpose of their further use, neutralization, disposal, transfer to other economic entities, in tabular form (appendices No. 8, 9 to the Methodological Instructions), information on incoming types of waste is provided.

22. The section "Information on Waste Accumulation Sites" of the PNWLR provides a list and capacity of waste accumulation sites (sites, containers, bunkers and other facilities) intended for the formation of a batch of waste for the purpose of their further use, neutralization, disposal, transfer to other economic entities in tabular form (Appendix N 10 to the Guidelines).

23. In the section "Information on the proposed annual transfer of waste to other economic entities for the purpose of their further use, and (or) neutralization, and (or) disposal" PNOLR provides data on the proposed annual transfer of waste to other economic entities for the purpose of their further use, neutralization , placement in tabular form (Appendix N 11 to the Guidelines).

This section also indicates the full name of the legal entity, last name, first name, patronymic of an individual entrepreneur (the last one - if any), location (residence) and TIN of economic entities accepting waste.

24. Economic entities that independently dispose of the waste generated by them through the use and (or) neutralization, include the section "Information on the proposed annual use of waste and (or) neutralization of waste" in the PNWLR.

This section of the NWLR provides justification for the amount of proposed annual use and/or disposal of waste.

To justify the amount of the proposed annual use of waste, the "Appendices" section includes (if any) documents (their copies certified by the economic entity) and materials that are the source of this justification.

To justify the amount of the proposed annual waste neutralization, the number and date of issue of the license for the activity of waste neutralization of I - IV hazard class are indicated.

Summary information on the proposed annual use and (or) disposal of waste of each type is given in tabular form (Appendix N 12 to the Guidelines).

25. Economic entities that dispose of generated waste at their own (own) waste disposal sites include in the PNWLR the section "Information on the proposed disposal of waste at independently operated (own) waste disposal sites".

This section of the NWLR provides the rationale for the proposed annual disposal of waste at self-operated (own) waste disposal sites. The rationale uses the results of the inventory of independently operated (own) waste disposal facilities, carried out in accordance with the Rules for the inventory of waste disposal facilities, approved by order of the Ministry of Natural Resources and Ecology of the Russian Federation dated February 25, 2010 N 49 (registered with the Ministry of Justice of the Russian Federation on June 8, 2010, registration N 17520) as amended by the order of the Ministry of Natural Resources and Ecology of the Russian Federation of 09.12.2010 N 541 (registered with the Ministry of Justice of the Russian Federation on 03.02.2011, registration N 19685).

To justify the amount of the proposed annual disposal of waste, the number and date of issue of a license for the disposal of waste of I - IV hazard class are indicated.

Summary information on the proposed annual waste disposal at independently operated (own) waste disposal facilities is presented in tabular form (Appendix No. 13 to the Guidelines).

26. In the section "Proposals on the limits of annual waste disposal" PNOLR indicates the list and amount of waste types intended for annual disposal in specific waste disposal facilities, in tabular form (Appendix No. 14 to the Methodological Instructions).

27. In the "List of sources used" section of the PNLR, a list of sources of information used is given, indicating the authors, publisher and year of publication.

28. The "Appendices" section of the PNOOLR includes:

copies of documents certified by the economic entity confirming the data of the material and raw material balance for the main production;

copies of contracts certified by the economic entity for the transfer of waste to specific economic entities for the purpose of their use, neutralization, placement of specific amounts of waste certain types and hazard classes;

map-scheme of the location of independently operated (own) waste disposal facilities;

map-scheme of the location of waste accumulation sites;

other documents and materials at the discretion of the business entity.

III. Content and design of the technical report on waste management

29. The technical report on waste management is drawn up on paper in two copies, one of which is kept by the economic entity, and the second, together with its electronic version on electronic media, is submitted to the relevant territorial body of Rosprirodnadzor.

Waste management technical report includes:

title page (Appendix N 15 to the Guidelines);

the structure of the technical report;

information about the business entity;

information on actually generated amounts of waste;

information on actually used, neutralized, disposed, as well as transferred for these purposes to other economic entities, generated waste during the reporting period.

30. The section "Information about the economic entity" of the technical report contains:

full and abbreviated name, including company name, organizational and legal form of a legal entity, its location, state registration number of the entry on the creation of a legal entity and data of a document confirming the fact of making an entry about a legal entity in the Unified State Register of Legal Entities - for legal entity;

surname, name and patronymic (the last name - if any) of an individual entrepreneur, his place of residence, details of his identity document, state registration number of the record of state registration as an individual entrepreneur and the data of a document confirming the fact of making an entry about an individual entrepreneur in the Unified State Register of Individual Entrepreneurs - for an individual entrepreneur;

phone numbers, telefax (if available);

the address Email(in the presence of);

surnames and initials of the head of the legal entity and persons responsible for waste management (with indication of positions);

a list of structural subdivisions (main and auxiliary workshops, sections and other facilities), as a result of economic and other activities of which waste is generated;

a list of branch(s) and separate subdivisions, information on which is included in the technical report on waste management, and their location.

31. In the section "Information on the actually generated amounts of waste" of the technical report, information is provided on the actual generation of waste for the reporting period separately for each structural unit (workshop, site and other facilities) of the business entity in tabular form (Appendix N 16 to the Guidelines) and actual summary information about the waste generated by the economic entity as a whole in tabular form (Appendix N 17 to the Methodological Instructions).

32. In the section "Information on the actually used, neutralized, disposed, as well as transferred for these purposes to other economic entities, during the reporting period of generated waste" of the technical report provides information for the reporting period on the actual use, neutralization, storage and disposal of waste on their own operated (own) waste disposal facilities, on the actual transfer of waste to other business entities in tabular form (Appendix No. 18 to the Methodological Instructions).

When actually transferring waste to other economic entities for the purposes of neutralization and (or) disposal, the number and date of issue of a license for the neutralization and (or) disposal of waste of I-IV hazard class of this economic entity are indicated.

33. An economic entity may attach other documents and materials to the technical report.

General provisions

1. The Guidelines are intended for individual entrepreneurs and legal entities, as a result of whose activities waste is generated, as well as for RTN bodies that decide on the approval of waste generation standards and limits on their disposal.

2. Guidelines define a unified approach to the development and general requirements for the content and design of draft standards for waste generation and limits for their disposal.

3. Operation of the Guidelines does not apply for questions of appeal radioactive waste, biological waste and medical waste.

Draft standards for waste generation and limits for their disposal (PNOOLR) under the new order:

PNOOLR is compiled on paper in two copies, one remains with the subject, and the second with an electronic version is submitted to the RPN.

PNOLR can be submitted with a simple electronic signature.

Composition of PNOOLR:

The "Appendices" section of the PNOOLR includes:

  • copies of documents certified by the subject, confirming the data of the material and raw material balance for the main production;
  • copies of contracts certified by the subject for the transfer of waste to specific economic entities for the purpose of their use, neutralization, placement of specific amounts of waste of certain types and hazard classes;
  • map-scheme of the location of independently operated (own) waste disposal facilities;
  • map-scheme of the location of waste accumulation sites;
  • other documents and materials at the discretion of the business entity.

In order to confirmation of compliance with approved standards waste generation annually compiled and presented by notification to the RPN authorities technical report to confirm the types, hazard classes and amounts of wastes declared in the PNRLR, generated during the reporting period and confirming the actual use, neutralization, disposal, transfer to other economic entities of the waste generated during the reporting period.

The technical report on waste management is also compiled on paper in two copies, one for the subject, and the second (with an electronic version) for the bodies of Rosprirodnadzor.

The technical report contains:

  • title page;

  • information on actually generated amounts of waste;
  • information on actually used, neutralized, disposed, as well as transferred for these purposes to other economic entities, generated waste during the reporting period.

On October 24, 2014, the Ministry of Justice of Russia registered the Order of the Ministry of Natural Resources of Russia dated 05.08.2014 No. 349, which approved new Guidelines for the development of draft standards for the generation of waste and limits for their disposal (hereinafter - the Guidelines, the new Guidelines). In this article, we have tried to highlight the main changes and innovations related to the development of draft standards for waste generation and limits on their disposal (hereinafter referred to as PNWLR) and the preparation of technical reports (hereinafter referred to as Tehotchet).

CHANGES IN THE RULES FOR THE DEVELOPMENT OF PNROL

The main changes in the Guidelines are associated either with changes in legislation that have occurred over 7 years since the appearance of the Order of Rostekhnadzor dated October 19, 2007 No. 703 (hereinafter referred to as RTN Order No. 703), or with changes in the very “ideology” of the Guidelines. It is from this angle that we will consider this issue.

1. Guidelines introduce a new term - « proposed . Moreover, in the tables given in the appendices to the Guidelines, instead of the specified term, others are used: « planned average waste generation standard per year”, « proposed annual education waste". All these concepts are analogues of the term "annual waste generation standard", which appeared in RTN Order No. 703. Let's hope that the word "proposed" combined with the design "average per year", as well as the lack of unity in the terminology of the Guidelines themselves will not allow representatives government agencies and the judiciary to confuse these concepts with . And it is necessary to distinguish between them, since only the standards for waste generation (and limits on their disposal) refer to the standards for permissible environmental impact in relation to waste.

2. Probably the developers normative act still understand the difference between waste generation standards and annual standards for waste generation. In any case, the Guidelines put more emphasis on the need to define . If earlier in some cases it was possible to do without the actual standards (specific values) in PNOOLR, now it is no longer possible. Thus, for the first time, it is recommended to present the values ​​of waste generation standards for each type of waste in a summary table (according to Appendix No. 8 to the Guidelines), which indicates the values ​​of waste generation standards in tons per unit of manufactured products (services rendered, work performed), as well as information about volumes of annually manufactured products (services, works) and, as a result, the proposed annual waste generation. In addition, the waste generation standards must now be indicated in the Technical Reports (we will talk about this later).

3. According to paragraph 3 of the Guidelines “the effect of the Guidelines does not apply to relations in the field of radioactive waste management, biological waste and medical waste”. From a literal reading of this requirement, it follows that if an enterprise generates “ordinary” waste, as well as biological and / or radioactive waste (this happens, for example, at some research institutes), then rationing should be carried out only for “ordinary” waste. With medical waste, the situation is even more complicated.

4. For a number of enterprises, the following novelties of the Guidelines (clause 4) will be relevant:

“If an economic entity has a branch (s) and separate subdivisions located within one subject of the Russian Federation , PNOOLR is being developed for the business entity as a whole or separately for each branch and separate subdivision.

If an economic entity has a branch (s) and separate subdivisions located on the territory several subjects of the Russian Federation, PNOOLR is being developed separately for each branch and separate subdivision» .

But only those organizations will be able to enjoy the opportunity to have one PNOOLR for several separate divisions (this is true for many "network" companies, banks and some other organizations), for which all branches and separate divisions without exception are located in one subject of the Russian Federation. In such cases, organizations can now decide for themselves whether to develop a common FRD or several projects.

However, please note that if a company owns several stores located in Moscow, and at least one store located in the Moscow region, then - following the logic and wording of the provisions of the new Methodological Guidelines - it will be necessary to develop a separate PNOOLR for each store.

5. It seems to us that many organizations will now be able to breathe more freely (we mean those organizations that provide territories and premises for rent and are forced to develop PNEOLR).

RTN Order No. 703 had the following provision: “ If an economic entity acts as a lessor of a part of the production areas, premises or equipment and grants the lessee the right to dispose of waste at its own facilities, then the lessee's waste should be included in the lessor's FWLR. In the event that the tenant independently carries out waste management activities, documents confirming these obligations of the tenant are attached to the PNOLR.. Availability this provision in practice, it often led to the fact that landlords were forced to include tenants' waste in their own PNRLR, especially when, for example, common containers (bunkers) were installed on the territory for the accumulation of solid waste. Moreover, representatives of Rosprirodnadzor sometimes ignored the fact that tenants' waste can only accumulate(and not stored!) and that other tenant waste may accumulate (or even be stored) not in the leased areas (in the premises). The position of Rosprirodnadzor boiled down to the following dilemma for the nature user: either to include all waste tenant, or don't include them at all(requiring the tenant to independently handle the waste).

ON A NOTE

In the new guidelines does not contain any obligations regarding tenants: the above provision is now missing from the document, and the recommendations for compiling the "General information about the economic entity" section of the PNEOLR no longer require the indication of tenants. And in general, the word “tenant” and references to any dependence on rental relations are excluded from the Guidelines.

6. In the Methodological Guidelines, the structure of the PNOOLR, the requirements for indicating this or that information related to (and sometimes not related to!) Waste management, as well as a list necessary applications significantly reduced. So, currently:

  • not necessary compose the "Summary" section with an additional number of tables, which (with some variations) previously had to be included in other sections of the PNELR;
  • from PNOOLR such sections are excluded, how:

- « Waste Information»;

- « Scheme of the operational movement of waste»;

- « Environmental monitoring natural environment on the territories of waste disposal facilities and within the limits of their impact on the environment»;

- « Plans of measures to reduce the amount of waste generation and disposal, ensure compliance with existing norms and rules in the field of waste management, information on emergency response measures»;

- « Characteristics of waste storage for up to 3 years and justification of the maximum amount of waste accumulation»;

- « Characteristics of waste storage for a period of more than 3 years and waste disposal»;

  • requirements excluded on the need to provide information and relevant tables with characteristics treatment facilities for domestic and industrial wastewater; water treatment equipment and installations; dust collecting and gas cleaning installations and equipment;
  • no need to present as attachments documents such as:

Copies of hazardous waste passports and materials justifying the classification of waste as a hazard class for the environment;

Copies of licenses for activities for the neutralization, disposal of hazardous waste;

Situational plan with drawing points of control measurements as part of monitoring the state of the environment in the territories of waste disposal facilities and within the limits of their impact on the environment;

List of used means of control and measurement.

Thus, in the new Guidelines:

1) the number of mandatory tables has been significantly reduced, and the tables themselves have generally become less time-consuming to fill out;

2) excluded sections of the PNOOLR and applications that are not directly related to standards waste generation and limits on their disposal.

Indeed, monitoring of the state of the environment, a situational plan with control measurement points, action plans to ensure compliance with norms and rules in the field of waste management can be attributed to industrial environmental control. The relevant documentation, of course, should be at the enterprise, but these sections have nothing to do with the calculation of waste generation standards and the determination of limits on their disposal.

With regard to the exclusion from the PEOLR section "Waste information" and the need to submit copies of hazardous waste passports (and materials justifying the assignment of waste to hazard classes), then, at first glance, this does not seem to be entirely logical. But, on the other hand, this section was compiled earlier on the basis of data from waste passports and relevant materials, and waste passports in themselves are self-sufficient documents that are independent of the PNWLR, as well as calculations of waste generation standards and limits for their disposal are not directly depend on waste passports (unless data on the composition of the waste is used to calculate the standards).

The exclusion of license copies from the list of required applications, in our opinion, is quite fair, because it is enough just to indicate the license number, and the representative of the regulatory authorities himself will be able to determine its reliability.

In a word, the compilers of the new Guidelines abandoned the desire to unite under one cover all documents that have at least some relation to waste management at the enterprise. Now PNOOLR is inherently more similar to what it should be: namely project exactly waste generation standards and limits on their placement. No more (but no less!). And information about the composition of waste, industrial environmental control, etc. let it be in the relevant documents. We do not undertake to judge whether the authors of the Methodological Instructions consciously sought this, but in terms of meaning it turns out that way.

7. The only partition (or rather, part of one of the partition tables), about disappearance which of the Methodological Instructions could be regretted is action plan to reduce the amount of waste generation and disposal. But it will not be the developers of the PNRLR who will regret this (why do they need additional responsibilities?), but those who really care about the growth in the volume of waste disposal. Moreover, they will regret not about the excluded table, but about the fact that the essence of setting limits on waste disposal has not changed with the adoption of new Guidelines.

The existing ideology of waste rationing, which is reflected in all versions of the guidelines for the development of PNRWL, does not imply mechanisms that would stimulate the reduction of limits on waste disposal. If, for example, when approving limits on waste disposal at MSW landfills, enterprises were required to carry out a phased reduction in the amount of waste transported to the landfill, then the action plan under consideration would make sense. With the current system of waste rationing, there is not much sense in such a plan as an integral part of the PNRLR. Moreover, if earlier in practice the enterprise constantly reduced the amount of waste disposed of at landfills, this could in some circumstances be a reason for Rosprirodnadzor to accuse this enterprise of violating production processes and limits on waste disposal and require the development of a new PNOLR.

It is no secret that the designated action plans in the FNRLR in most cases were reduced to a standard set of fulfilled requirements for compliance with environmental legislation - in this sense, the absence of requirements in the Methodological Guidelines for the inclusion of these plans in the FNRLR can even be welcomed.

8. New Guidelines More do not provide the possibility of compiling PNOOLR simplified form. Probably, this is due to the reduction of the necessary sections in the PNRLR (that is, with the simplification of the structure of the PNRLR itself).

9. At the time of the appearance of Order RTN No. 703, the concept "accumulation of waste" was not fixed by law, and after the accumulation of waste for a period of less than 6 months ceased to be considered waste storage (i.e., placement), many of the requirements of Order RTH No. 703 could be interpreted ambiguously. In the new Guidelines, of course, waste accumulation is considered as one of the waste management operations.

As before, RTN Order No. 703, the new Methodological Instructions prescribe the execution of PNOOLR in two copies on paper. Innovations are as follows:

1) is submitted to Rosprirodnadzor only one instance PNOOLR along with the electronic version;

2) one copy of the PNOOLR must be kept by an economic entity;

3) PNOOLR can be submitted using electronic documents signed with a simple electronic signature.

Curiously, in the Guidelines no pagination requirements. Earlier, in RTN Order No. 703, there was the following requirement: "The pages of the PNOOLR are numbered through numbering, including applications". Thus, the absence of page numbering in the PNRLR (or numbering other than through) in the future should not be considered a violation of the requirements of the Guidelines.

Let's take a closer look at structure (composition) PNOOLR, the requirements for which are set out in Sect. II "Content and design of the draft standards for the generation of waste and limits on their disposal" of the Guidelines.

For clarity, we presented the new structure of the PNOOLR in the form of a block diagram in Fig. one.

Sections that consist of one table or one text list are highlighted in green. Sections that include several tables and/or blocks of textual information and/or a block diagram are highlighted in gray and have a different form from other elements of the diagram. Each type of element of the PNOOLR structure (table, text, flowchart, separate sheet, applications) is represented for clarity by a specific figure (table - a rectangle; text - a rectangle with a wavy bottom side; a separate sheet - a rectangle with a curved right top corner; block diagram - parallelepiped; "compound section" - ellipse; applications - "stack").

According to the new Methodological Guidelines, the PNRLR now consists of a title page, the structure of the PNRLR, annexes, and also ten sections.

If the enterprise does not independently carry out activities for the use and disposal of waste and / or does not have its own waste disposal facilities, then the relevant sections 7 and 8 need not be drawn up.

Title page

The form of the title page of PNOOLR is presented in Appendix No. 6 to the Guidelines. Now on the title page it is not necessary to indicate the OKPO code, however, it is necessary to put down the number of the PNOOLR copy. Also, in addition to the signature of the head, the title page must contain the signature and surname of the responsible executor.

Structure of PNOOLR

The structure of PNOOLR, apparently, is what was previously called "Content" in Order No. 703 of RTN. Since there are no recommendations on the design of the structure of the POOLR, the project developers are free to present the structure at their discretion - as before, in the form of "Contents" (with a numbered list of sections, indicating the names of tables, etc.) or in any other form. It seems to us that it is also possible to use block diagrams (for example, like Fig. 1).

Section 1 "General information about the business entity»

Section 1 PNOOLR should contain the following information about the organization: name (full and abbreviated), legal form, location, PSRN, TIN, codes (OKOPF, OKOFS, OKVED, OKATO, OKTMO); types of main economic and other activities; surnames and initials of the manager and persons responsible for waste management; a list of structural units, as a result of economic and other activities of which waste is generated; a list of branches and separate subdivisions, information on which is included in the PNOOLR, their locations; list of self-operated waste disposal facilities; phone numbers, telefax, e-mail address (if available). Compared to RTN Order No. 703, now in " General Information» it is not necessary to provide data on the number of personnel, on the main production indicators of work, and also indicate the list of tenants, OKPO code, legal and actual addresses. At the same time, this section should present information about the manager and persons responsible for waste management(this requirement was not in RTN Order No. 703).

Section 2 "Information on economic and other activities”

Section 2, in contrast to the similar section of RTH Order No. 703, should now contain significantly less information. There are only two requirements in the Guidelines:

1) in text form must be given a brief description of and indicators of economic and other activities in the course of which waste is generated;

2) for each structural unit (workshop, section, etc.), information on which is included in the PNOOLR, must be compiled process flow diagrams, including in the form of separate blocks:

  • used raw materials, materials, semi-finished products, other;
  • production operations (without detailing production processes);
  • manufactured products (rendered services, performed works);
  • generated waste (by origin or conditions of formation);
  • waste management operations (including accumulation, use, neutralization, disposal, transfer of waste to other structural units or business entities).

And it's all! No tables, nothing extra! Instead of a whole page of requirements, just a few lines.

Section 3 "Calculation and justification of the proposed standards for waste generation on average per year”

The requirements for the content of Section 3 are almost identical to the requirements of Order RTH No. 703, except that at present it is no longer necessary to tabulate the characteristics of treatment facilities, water treatment equipment, dust collection and gas treatment plants. This section consists of the actual calculations of waste generation standards and proposed waste generation standards on average per year (in text form and / or using tabular forms), presented for each waste item in a separate subsection, and - as a result of calculations - a general list of waste in the form of a table in accordance with Appendix No. 7 to the Guidelines.

The methods for calculating the waste generation standards themselves were almost “carbon-copied” transferred from RTN Order No. 703, and their description is given in sec. II "Methods for determining (calculating) waste generation standards" of the Guidelines.

Section 4 "Information about the proposed generation of waste»

According to the new Guidelines Section 4 consists of two parts. First, a table is drawn up (or several tables, depending on the number of structural units), containing information on the proposed annual waste generation separately for each structural unit(in accordance with Appendix No. 8 to the Guidelines), and then - pivot table(Appendix No. 9).

In accordance with the Methodological Guidelines, economic entities whose main activity is collection of waste from individuals for the purpose of their further use, neutralization, disposal, transfer to other economic entities, information and information on incoming types of waste should also be provided in tabular forms in accordance with Annexes No. 8 and 9.

Regarding the design of Section 4 in the Methodological Instructions, there are additional requirements:

« For all wastes included and not included in the federal classification catalog of wastes […], the hazard class is indicated, determined in accordance with the procedure for classifying wastes of I-IV hazard classes to a specific hazard class and (or) criteriaattribution of waste to I-V classes hazards according to the degree of negative impact on the environment, approved by the Ministry of Natural Resources and Ecology of the Russian Federation [...].

At the same time, Annexes No. 8 and No. 9 to the Methodological Instructions indicate the details of the letter on the direction by the business entity to the appropriate territorial body of Rosprirodnadzor of documents confirming the assignment of the type of waste to a specific hazard class ».

The scope of this article does not allow us to dwell on the complex and controversial issues of waste certification after the entry into force on August 1, 2014 of new normative documents and the appearance of numerous clarifications and interpretations in the letters of the Ministry of Natural Resources. But I would like to note that the requirement to indicate the details of the mentioned letter seems to us very strange. First of all, due to the fact that the waste certification procedure recommended by the Ministry of Natural Resources may be different for organizations developing waste passports for the first time, and for those enterprises that have already received hazard class certificates before 08/01/2014. And if such a letter was sent to Rosprirodnadzor, but it was given a negative answer (i.e., Rosprirodnadzor revealed incompleteness of documents or does not agree with how the enterprise classified waste as hazard classes), then what is the point of indicating the details of this letter in PNOOLR? In addition, according to the new waste certification requirements for waste not included in the federal classification catalog of waste (hereinafter referred to as FKKO), the enterprise has 90 days after the generation of waste to confirm that it is assigned to a specific hazard class. And some types of waste are rarely generated at all.

For instance, replacement of the filter load of treatment facilities can be done once a year or even less often. If the corresponding type of waste is not in the FKKO, then the appearance of the mentioned letter on classifying the waste as a hazard class can be expected for a year and a half!

What happens: without the aforementioned letter, the enterprise will not be able to submit the PNOLR for approval? But this is absurd!

In this regard, someone may be "rejoiced" by the fact that in the tables of appendices No. 8 and 9 to the Guidelines for specifying details this letter columns are not provided ... We have a suspicion that additional columns were planned for these purposes in the table of Appendix No. 9, because after columns 1-4, column 8 is immediately indicated. But be that as it may, the lack of clear instructions on where exactly in the tables the details of the letter should be indicated may not convince a hypothetical arbitration court that such an indication is possible in principle.

Section 5 "Information about places of accumulation of waste»

Table of Section 5 of the Guidelines containing information on places of accumulation waste (Appendix No. 10), has become much more compact. Now it specifies name only and number on the map, as well as capacity— general and for wastes of each of the five hazard classes.

Section 6 " Information on the proposed annual transfer of waste to other economic entities for the purpose of their further use, and (or) neutralization, and (or) disposal "

The task of compiling the table in Section 6 is to indicate what kind of waste and in what quantity is expected transfer to other business entities. This table (Appendix No. 11 to the Guidelines) indicates the amount (in tons) of the relevant waste; the purpose of the transfer (use, neutralization, storage, burial); name, TIN and location of the legal entity receiving the waste (all this in one column); date and number of the contract for the transfer of waste; contract time.

Here you should pay attention to the notes to the table of Appendix No. 11:

  • when the proposed annual transfer of waste of I-IV hazard classes to other business entities for the purpose of their neutralization and (or) disposal, the number and date of issue of a license for the neutralization and (or) disposal of waste of I-IV hazard classes are indicated;
  • data for the economic entity to which the waste is transferred for the purpose of their use and (or) neutralization, if necessary can be changed. Relevant information is reflected in the Technical Report.

Note that in the table of Appendix No. 11 there is no separate column for specifying the details of the license, but since this note is given for certain columns, it is probably in them that these details should be indicated.

As for the possibility of changing data on organizations that accept waste, the relevant notes apply to all data - not only to the names of economic entities, but also to the details of contracts. That is, from a literal reading of these requirements, it follows that if the waste is transferred not for use or neutralization, but for accommodation, then change the details of the contract it is forbidden. However, this requirement does not correspond to the established practice - contracts for waste disposal are usually concluded for a period of not more than one year.

Section 7 "Information on the proposed annual use of waste and (or) disposal of waste"and Section 8 " Information on the proposed waste disposal at self-operated (own) waste disposal facilities”

As we noted earlier, sections 7 and / or 8 (tables of appendices No. 12 and 13 to the Guidelines, respectively) should be developed by enterprises that independently carry out activities for the use and disposal of waste and / or have their own waste disposal facilities. When using waste, the purpose of use is indicated (production of products, provision of services, performance of work), and when neutralizing - the name of the process.

In accordance with the guidelines to justify the number proposed annual use waste in applications are included documents and materials that are the source of this justification, and for substantiation of the number proposed annual neutralization waste are indicated number and date of issue of the license for waste disposal activities of I-IV hazard classes. There is no information in the Guidelines about which documents and materials are the sources of justification for the amount of waste proposed for use, so enterprises will be forced to choose them at their own discretion (and Rostekhnadzor, at its discretion, will accept or not accept these justifications). But how the details of the license will help justify the amount of waste offered for disposal remains a mystery.

Section 9 "Proposals for limits on annual waste disposal”

The table of Section 9 (Appendix No. 14 to the Guidelines) is almost identical to the similar table from the RTH Order No. 703.

Section 10 "List of used sources»

In Section 10, as before, it is required to list the sources of information used, indicating the authors, publisher and year of publication. In RTN Order No. 703, this section was called "List of Used Literature".

Applications

Scroll required documents v applications concise like never before. So, applications should include:

1) copies of documents certified by an economic entity confirming the data of the material and raw material balance for the main production;

2) copies of contracts certified by the economic entity for the transfer of waste to specific economic entities for the purpose of their use, neutralization, disposal specific quantities of waste of certain types and hazard classes;

3) a map-scheme of the location of independently operated (own) waste disposal facilities;

4) a map-scheme of the location of waste accumulation sites;

5) other documents and materials at the discretion of the economic entity.

The second requirement on this list looks very odd. Firstly, waste transfer agreements do not always indicate their quantity. The contract may only provide for the frequency of waste removal or specify the condition that the waste is removed upon request. Secondly, contracts may specify total waste accumulated in the mixture. According to paragraph 4 of Art. 421 Civil Code Russian Federation " the terms of the contract are determined at the discretion of the parties, except when the content of the relevant terms is prescribed by law or other legal acts". We don't know the laws legal acts requiring, when concluding contracts for the transfer of waste, to indicate a specific amount of waste of certain types and hazard classes. Thus, the mentioned requirement of the Guidelines, in our opinion, contrary to the Civil Code.

The list of required attachments is not fully exhaustive, since there is an indication that other documents may be included in the attachments at the discretion of the business entity. turnover "at your look" allows the enterprise to include anything in the PNOOLR. But, generally speaking, the text of the Guidelines contains more two mandatory application requirements(the first of them was mentioned earlier):

  • to justify the number of proposed annual use waste, the annexes include documents and materials that are source of this justification;
  • in Section 3 "Calculation and justification of the proposed standards for the generation of waste on average per year" in text form, references should be made to the relevant sources of information, as well as to applications, certifying quantitative indicators and. Which documents should confirm quantitative indicators is left to discretion enterprises.

It seems to us that the new requirements for the composition of the materials included in the appendices to the PNOOLR can significantly simplify the design of projects (not to mention saving paper!). But we have a strong suspicion that the employees of Rosprirodnadzor, who are reviewing the PNOLR, will not really like such a sharp reduction in the list of required documents, as well as the right of organizations to include additional documents in the annexes at their own discretion.

Recall that in RTN Order No. 703, at the end of the list of requirements for applications, it was indicated “ other”, which was freely interpreted by the regulatory authorities.

For instance, according to the “historical tradition”, Rosprirodnadzor, when reviewing the PNOLR, could require that land lease agreements, certificates of ownership, contracts for energy supply, a list of vehicles, orders for the appointment of those responsible for waste management, passports for equipment, etc. be included in the annexes. These requirements of Rosprirodnadzor were materialized in the notices of refusal to approve the PNOLR both explicitly ( “Electricity contracts not submitted”, "No information provided about ventilation systems» ), and in a more nebulous form ( “the absence of such and such waste is not justified”), which often turned the process of approving the PNOOLR into an endless proof that you are not a camel, with the application of all kinds of certificates and all the documentation available at the enterprise.

The new ideology of the PNRLR, with a certain solidarity of nature users, can put an end to this vicious practice. In the end, PNOOLR is signed by the head of the enterprise responsible for providing reliable information, and - in accordance with Art. 8.5 of the Code of the Russian Federation on Administrative Offenses (as amended on 04.11.2014) per « concealment, deliberate distortion or untimely communication of complete and reliable information[...]on sources of pollution of the environment and natural resources or other harmful effects on the environment and natural resources[…]».

NEW REQUIREMENTS FOR TECHNICAL REPORTS

The requirements for the Technical Reports are set out in Sec. III "Content and design of the technical report on waste management" of the Guidelines. It is important to note that the title of this document has changed. Now there is no mention of "process immutability" and "raw materials used". The title is short and to the point: "Technical Report on Waste Management". According to the Methodological Guidelines, the Technical Report should be drawn up annually and introduce yourself by notification in Rosprirodnadzor.

Like PNOOLR, the Technical Report is compiled on paper. in duplicate(the numbering of copies is provided), and the second copy, together with the electronic version on electronic media, is submitted to the appropriate territorial body of Rosprirodnadzor (the first copy must be kept by the business entity).

The new structure of the Technical Report is shown in fig. 2.

The report must consist of title page (drawn up in accordance with Appendix No. 15 to the Methodological Instructions), technical report structures (similar to the structure of PNOOLR) and three sections. There is also a phrase in the Guidelines that "by the economic entity to the technical report may be attached other documents and materials » .

Presentation of information about an economic entity ( Section 1 ) was not previously required as part of the Technical Report. Now this section should be drawn up, and the completeness of the information provided is only slightly less than in the corresponding section of the PNRLR. So, in the Technical Report it is not required to indicate statistics codes, types of main economic and other activities, however, as in the PNOOLR, it is necessary to provide data on the manager and persons responsible for waste management (probably because in the time after the approval of the PNOLR they could change ).

Section 2 The technical report consists of two tables in the same way as in Section 4 of the PNOLR. First, a table (or several tables) is compiled containing information on the actual generation of waste separately for each structural unit(in accordance with Appendix No. 16 to the Guidelines), and then - a summary table (Appendix No. 17).

It is important to note that in the table of Appendix No. 16 you now need to indicate waste generation standard(in tons per unit of products, services, works), the volume of products (services, works) and the amount of waste generated. There was no such requirement regarding information in the Technical Reports before! This innovation, of course, complicates the preparation of the Technical Report, but returns everyone to the meaning of the concept of waste generation standards how specific values in accordance with the provisions of the Federal Law of June 24, 1998 No. 89-FZ "On Production and Consumption Waste".

It seems to us that now enterprises will be given the opportunity not to remake the PNOLR when the annual amount of waste generated changes in cases where the waste generation standards remain unchanged and there are no excess waste disposal limits. This idea is also confirmed in Sect. I "General Provisions" of the Guidelines (clause 7), which says that the Technical Report should be drawn up in order to confirmation compliance with approved waste generation standards and limits for their placement. True, this provision comes into conflict with paragraph 8 of the Methodological Instructions, where several other goals preparation of the technical report: the confirmation types, hazard classes and amount of waste formed during the reporting period; confirmation of the actual use, neutralization, disposal, transfer to other economic entities of waste generated during the reporting period. How this contradiction will be resolved in practice - time will tell ...

V Section 3 The technical report provides data for the reporting period on waste, actually used, rendered harmless, placed, as well as transferred X for these purposes to other business entities (in tabular form in accordance with Appendix No. 18). If the waste is transferred to third parties, then it is necessary to indicate the name of the organization, TIN, its location and details of the relevant agreement. If waste is transferred for neutralization or disposal, then next to the name of the organization, you must indicate the details of the license for the relevant activity.

As for the inclusion of other documents and materials in the Technical Report, in accordance with the Methodological Instructions, they may be attached. That is, it seems to us that enterprises no obligation include copies of contracts, acts and licenses in the annexes to the Technical Report (which was previously prescribed by RTN Order No. 703).

CONCLUSION

How to evaluate the new Guidelines? It seems to us that in many ways their appearance is a significant step forward compared to the provisions of by-laws that have been in force so far. This is especially true of approaching the concept of waste generation standards as specific quantities, as well as simplifying the structure of the PNRLR and the requirements for its development and execution.

At the same time, the "core" of the Guidelines - the methodology for determining the standards for waste generation - was transferred from the previous regulatory act without any rethinking and taking into account reality. Probably, the developers of the Guidelines simply did not have time for this. It is curious that in the very first version of the document being prepared, there was no section on the methods for determining standards, but the requirements for PNOLR said: “ Waste generation standards are determined by specific indicators of waste generation for the corresponding type of economic activity or on the basis of calculation or experimental methods for determining the amount of waste generated in the production of a unit of output (rendering services, performing work). At the same time, the "Appendices" section includes materials for substantiating the methods used for determining waste generation standards and provides links to sources of information, as well as documents (their copies) and materials certifying the quantitative indicators and coefficients used in the calculations» . But then someone decided to abandon this idea - and the section "Methods for determining (calculating) waste generation standards" was returned to the Guidelines, copying it from Order RTN No. 703. Since in this Order it was indicated under the number "II", and in the original version of the new Guidelines there was already a section with the same number, this led to the fact that now we have two sections under the number "II"!

The haste in developing the Guidelines can also explain other oddities, contradictions and sometimes absurd things mentioned in the article. But if this is so, then it turns out that the procedure for preparing and adopting such important regulations in our country is not entirely effective.

It remains to be hoped that in practice it will be possible to apply all the progressive innovations of the Methodological Instructions, and all contradictions will not be used against users of natural resources.

Information about emergency measures (if we talk about waste generation standards) is, as they say, “from another song”.

In this case, the appropriate waste passports should be included in the annexes to the PWLR as data confirming the calculations.

For example, by introducing waste sorting technologies with the release of usable components or by switching to raw materials that generate less waste.

A certain analogy (with a stretch) can be drawn with emission rationing, when, when establishing temporarily agreed emissions, an enterprise must develop a program to reduce emissions.

This requirement can be welcomed: firstly, environmentalists will no longer carry an additional copy of the project (sometimes quite weighty) with them to Rosprirodnadzor; secondly, it will lead to paper savings - upon receipt of a notification of a refusal to approve the PNELR, it will not be necessary to throw away the second copy of the document.

And in general, of course, a huge number of enterprises would breathe a sigh of relief if the Methodological Guidelines provided for the procedure and procedure for changing the data on the landfill that accepts waste for disposal, without the need to re-register and re-approve the entire PNRLR (with unchanged waste generation standards and unchanged sizes limits on waste disposal). Such a procedure could consist in checking by Rosprirodnadzor of the landfill and its ability to accept for disposal the appropriate names and volumes of waste.

1. Guidelines for the development of draft standards for the generation of waste and limits for their disposal (hereinafter referred to as the Guidelines) are intended for individual entrepreneurs and legal entities (hereinafter referred to as business entities), as a result of economic and other activities of which waste is generated, and territorial bodies of the Federal Service on supervision in the field of nature management (hereinafter referred to as the territorial bodies of Rosprirodnadzor), which decide on the approval of standards for the generation and limits on waste disposal.

2. The Guidelines establish a unified approach to the development and general requirements for the content and design of the draft waste generation standards and limits for their disposal (hereinafter referred to as PNWLR), which substantiates the proposed handling of all waste generated in the course of economic and other activities of an economic entity, through their use, neutralization, placement, as well as transfer to other economic entities for the purpose of their further use, neutralization, placement.

4. If an economic entity has a branch (s) and separate subdivisions located within the same subject of the Russian Federation, the PNOOLR is developed for the economic entity as a whole or separately for each branch and separate subdivision.

If an economic entity has a branch (s) and separate subdivisions located on the territory of several constituent entities of the Russian Federation, the PNOOLR is developed separately for each branch and separate subdivision.

Determination (calculation), on the basis of waste generation standards and the volume of products produced (services rendered, work performed), the amount of waste generated annually;

6. When the territorial bodies of Rosprirodnadzor make a decision to approve the standards for waste generation and limits for their disposal, the following information is taken into account, contained in the PNWLR:

Availability in the production area and capacity of equipped places (sites) for the accumulation of waste intended for the formation of a batch of waste for the purpose of their further use, neutralization, disposal, transfer to other business entities;

Available technical capabilities for the use and (or) disposal of generated waste by an economic entity independently or through transfer to other economic entities;

Availability of waste disposal facilities operated by an economic entity or third-party organizations, as well as available technical capabilities for placing in them the proposed amount of waste of each type and their hazard class;

The presence of waste disposal facilities operated by an economic entity or third-party organizations in the state register of waste disposal facilities, formed by the Federal Service for Supervision of Natural Resources in accordance with the Procedure for Maintaining the State Waste Cadastre, approved by Order of the Ministry of Natural Resources and Ecology of the Russian Federation dated September 30, 2011 N 792 (registered with the Ministry of Justice of the Russian Federation on November 16, 2011, registration N 22313).

7. In order to confirm compliance with the approved waste generation standards and limits on their disposal generated during the reporting period, economic entities (their branch(s) or separate subdivisions) annually draw up and submit, in a notification manner, to the relevant territorial bodies of Rosprirodnadzor a technical report on the handling of waste.

Confirmation of the actual use, neutralization, disposal, transfer to other economic entities of waste generated during the reporting period.

9. The NWLR provides justifications for the proposed norms for the generation of specific types of waste on average per year based on the norms for waste generation. The proposed norms for the generation of specific types of waste on average per year are indicated in tons per year.
