All activities of federal and municipal institutions are strictly structured. The work performed must be included in the extensive basic (industry) lists of state and municipal services. In the article we will analyze both their components and the order of formation and change.

Formation of lists

The basic (sectoral) lists of state and municipal services are formed by specialized executive authorities, whose function is the development of state policy and legal regulation in certain areas of activity, based on the theses of regulatory acts: federal, subject and municipal.

Defining legislative acts

Regulation of the procedure for granting both municipal and public works is carried out by Decree No. 151 of the Government of the Russian Federation, adopted in 2014.

The formation and maintenance of basic lists of state and municipal services is carried out in a comprehensive information system for managing public finances " Electronic budget". Lists of types of activities for which these industry lists are formed are determined by Order of the Ministry of Finance No. 49n, which was also adopted in 2014.

The procedure for the formation of lists

Consider the order of formation of the base:

The initiative comes from the executive authorities federal level.
The next step is to collect and generate data on new service or work for inclusion in the register.
A registry entry is created.
Further approval from the Ministry of Finance is required.
A decision is made to make a new entry in the basic list of municipal services or a refusal with an explanation of its reasons.
If the inclusion of a new entry in the list is approved, the federal executive authorities approve it and assign a unique identification number. A new item appears in the basic list of state, municipal services and works, as well as a similar departmental list.
If a refusal is received from the Ministry of Finance, then the entry will be canceled.
If the answer came about the need to make any changes to make an entry in the list, then the necessary changes are made, a new entry is created - return to step 4 of the algorithm.

Changes to the list

Changes are made to the basic list of municipal services and works according to the following algorithm:

The initiative can come from both federal authorities and municipal, regional.
The process of collecting and generating information for filing an application to change a record.
Creating an application for changing information in any item of the list.
In the case of municipal authorities and subjects: sending an application to the financial authorities of their level. Further, the situation can develop in two ways:

Application approved. Approval of the application, making changes to the list entry.
Application rejected. Cancellation of the application. Making a number of changes to the application according to the specified instructions. Cancellation of the old application, creation of a new one, taking into account all the changes and returning to the beginning of paragraph 4.

In the case of federal authorities: sending an application to federal financial authorities. Further similar scenarios for the development of events:

Application approved. This document is approved, resulting in a modified record of the basic list of municipal services.
Application rejected. Cancellation of the old application, editing according to the instructions sent. Creation of a new application for changing the registry entry, return to the beginning of paragraph 5.

Deciphering the identification number of the entry in the list

Each registry entry for the basic list of municipal services has its own unique type identification number:

1. Approve the attached:

Rules for the formation, maintenance and approval of federal lists (classifiers) of public services not included in the all-Russian basic (industry) lists (classifiers) of state and municipal services provided to individuals, and works, the provision and performance of which is provided for by regulatory legal acts of the Russian Federation (hereinafter - Rules for the formation, maintenance and approval of federal lists).

2. Establish that before the deadline for the formation of the state (municipal) task for the provision of state (municipal) services (performance of work) (hereinafter referred to as the state task) for 2020 and for the planning period of 2021 and 2022:

a) proposals for amending the all-Russian basic (industry) lists (classifiers) of state and municipal services provided to individuals can be sent by federal state authorities (state bodies) exercising the functions and powers of the founder of federal budgetary or autonomous institutions, chief administrators funds federal budget, which are in charge of federal state institutions, the financial authorities of the constituent entities of the Russian Federation and the financial authorities of municipalities (hereinafter, respectively - the authorities that sent proposals for amendments, the all-Russian basic lists) using the state integrated information system for managing public finances "Electronic budget" in the manner established by the Ministry of Finance of the Russian Federation, to the federal executive authorities that carry out the functions of developing state policy and legal regulation in the relevant area, which approved the all-Russian basic lists (hereinafter referred to as the relevant federal executive authorities);

b) the relevant federal executive authorities, within 10 working days from the date of receipt of proposals for amendments to the all-Russian basic lists, ensure their consideration and, based on the results of the consideration:

when deciding to make changes to the all-Russian basic lists - make changes to the all-Russian basic lists in accordance with paragraphs 12-15 in the manner established by the Ministry of Finance of the Russian Federation, send the said decision to the bodies that sent proposals for making changes;

when making a decision to refuse to amend the all-Russian basic lists in the absence of regulatory legal acts specified in paragraph 2 of the Rules for the formation, maintenance and approval of all-Russian basic lists, provisions that are the basis for the provision of public services and municipal services to individuals, or in case of failure to complete (incompletely) the information specified in paragraph 4 of the Rules for the formation, maintenance and approval of all-Russian basic lists - in the manner prescribed by the Ministry of Finance of the Russian Federation, send the said decision to the bodies that sent proposals for amendments, indicating the reasons for the refusal.

3. Determine that:

the rules approved by this resolution are applied starting from the formation of the state task for 2018 and for the planning period of 2019 and 2020;

the provisions established by paragraph 17 of the Rules for the formation, maintenance and approval of all-Russian basic lists and paragraph 17 of the Rules for the formation, maintenance and approval of federal lists shall apply from January 1, 2018;

the provisions established by paragraphs two and three of clause 18 of the Rules for the formation, maintenance and approval of all-Russian basic lists and paragraphs two and three of clause 18 of the Rules for the formation, maintenance and approval of federal lists shall apply from January 1, 2019;

With changes and additions from:

1. These Rules establish the procedure for the formation, maintenance and approval of all-Russian basic (industry) lists (classifiers) of state and municipal services provided to individuals (hereinafter referred to as the all-Russian basic lists).

2. All-Russian basic lists are formed and maintained by the federal executive authorities that carry out the functions of developing state policy and legal regulation in the established areas of activity (hereinafter referred to as the relevant federal executive authorities), the State Space Corporation "Roscosmos" (hereinafter referred to as the State Corporation "Roskosmos") in electronic form in the state integrated information system management of public finances "Electronic budget" (hereinafter referred to as the information system) based on the provisions of federal laws, regulatory legal acts of the President of the Russian Federation, the Government of the Russian Federation and the relevant federal executive authorities regulating the provision of state and municipal services to individuals (hereinafter referred to as state (municipal ) services), which are the basis for the inclusion of a state (municipal) service in the all-Russian basic list and (or) amendments to the all-Russian basic list (hereinafter - the acts that are the basis for the formation of the all-Russian basic list and (or) amendments to it).

3. The relevant federal executive authorities and the State Corporation "Roscosmos" form the all-Russian basic lists in accordance with the list

4. The all-Russian basic list for each state (municipal) service shall include the following information:

a) the name of the state (municipal) service;

b) an indication of product codes by type of economic activity corresponding to the state (municipal) service;

c) an indication of a public legal entity, the expenditure obligations of which, in accordance with the regulatory legal acts specified in paragraph 2 of these Rules, include the provision of state (municipal) services;

d) an indication of the free or paid state (municipal) service;

e) the name of the indicators characterizing the content of the state (municipal) service (when such indicators are established by the relevant federal executive authorities);

f) the name of the indicators characterizing the conditions (forms) for the provision of state (municipal) services (when such indicators are established by the relevant federal executive authorities);

g) the type (types) of the state (municipal) institution (budgetary, autonomous, state-owned), which is entitled to provide the state (municipal) service;

i) the names of indicators characterizing the quality (when establishing indicators characterizing quality by the relevant federal executive authorities) and the volume of state (municipal) services, as well as their units of measurement;

j) details (indicating articles, parts, paragraphs, subparagraphs, paragraphs) of the acts that are the basis for the formation of the all-Russian basic list and (or) making changes to it.

5. The information specified in paragraph 4 of these Rules, generated by the relevant federal executive authorities, the State Corporation "Roscosmos" for each state (municipal) service, forms a register entry.

8. Register entries are sent in electronic form for approval to the Ministry of Finance of the Russian Federation in the manner established by the Ministry of Finance of the Russian Federation.

9. The totality of register entries for one type of activity signed by a person duly authorized to act on behalf of the relevant federal executive body, the State Corporation Roscosmos, and approved by the Ministry of Finance of the Russian Federation, forms an all-Russian basic list for this type of activity.

10. The all-Russian basic list is approved by the relevant federal executive body, the State Corporation Roscosmos, by signing with an enhanced qualified electronic signature of a person duly authorized to act on behalf of the relevant federal executive body, the State Corporation Roscosmos.

11. Amendments to the all-Russian basic list are carried out by the relevant federal executive body, the State Corporation "Roscosmos" in connection with a change in the information specified in paragraph 4 of these Rules, including in connection with the adoption and (or) amendments to the acts that are the basis for the formation of the all-Russian basic list and (or) making changes to it.

12. The maintenance of the all-Russian basic list is carried out by the relevant federal executive body, the State Corporation "Roscosmos" by generating the information specified in paragraph 4

paragraph 8 of these Rules.

13. The totality of newly formed register entries, amended register entries and invalidated register entries (previous versions of the amended register entries) for one type of activity, signed by a person duly authorized to act on behalf of the relevant federal executive body, State Corporation Roscosmos, approved by the Ministry of Finance of the Russian Federation and not included in the approved all-Russian basic list, forms changes that are made to the all-Russian basic list for this type of activity.

14. Changes that are made to the all-Russian basic list are approved by signing with an enhanced qualified electronic signature of a person duly authorized to act on behalf of the relevant federal executive body, State Corporation Roscosmos.

15. In the event of a significant amount of changes being made to the all-Russian basic list (at least half of the existing register entries), it is allowed to approve a new version of the all-Russian basic list.

16. Amendments to the all-Russian basic list in the event of the adoption (change) of the act that is the basis for the formation of the all-Russian basic list and (or) amendments to it shall be carried out by the relevant federal executive body, the State Corporation "Roscosmos" within 30 working days from the date of adoption (change) of such an act.

17. Changes that are made to the all-Russian basic list (new version of the all-Russian basic list) approved in accordance with the procedure established by these Rules in the current financial year (with the exception of the changes specified in paragraphs 16 and these Rules) before being submitted for consideration to the Government of the Russian Federation draft federal law on the federal budget for the next financial year and planning period, are applied starting from the formation in accordance with the budgetary legislation of the Russian Federation of the state (municipal) assignment for the provision of state (municipal) services for the next financial year.

Changes that are made to the all-Russian basic list (new edition of the all-Russian basic list) approved in accordance with the procedure established by these Rules in the current financial year (with the exception of the changes specified in paragraphs 16 and these Rules) after the draft federal of the law on the federal budget for the next financial year and planning period, are applied starting from the formation, in accordance with the budgetary legislation of the Russian Federation, of the state (municipal) assignment for the provision of state (municipal) services for the first year of the planning period.

18. If technical errors (typos, misprints, grammatical errors or other similar errors) are found in the information included in the all-Russian basic list, they are corrected by the relevant federal executive authorities, the Roscosmos State Corporation within 5 working days from the date of detection of these errors by amending the all-Russian basic list in accordance with paragraphs 12 - 15

If the changes specified in paragraph one of this clause lead to a change in the unique number of the registry entry (unique version number), the relevant federal executive body, the State Corporation "Roskosmos" shall approve, in the manner prescribed by clause 14 of these Rules, the changes that are made to the national basic list.

If the changes specified in paragraph one of this clause do not lead to a change in the unique number of the registry entry (unique version number of the registry entry), the changes that are made to the all-Russian basic list are not approved.

20. All-Russian basic lists (changes that are made to the all-Russian basic lists, new editions of the all-Russian basic lists), approved in the manner prescribed by these Rules, as well as the register entries that form them, are posted on single portal budget system Russian Federation (www.budget.gov.ru) in the information and telecommunications network "Internet" in the manner prescribed by the Ministry of Finance of the Russian Federation.

With changes and additions from:

1. These Rules establish the procedure for the formation, maintenance and approval of federal lists (classifiers) of public services not included in the all-Russian basic (industry) lists (classifiers) of state and municipal services provided to individuals, and works, the provision and performance of which is provided for by regulatory legal acts of the Russian Federation (hereinafter - federal lists).

2. Federal lists are formed by the federal executive authorities that carry out the functions of developing state policy and legal regulation in the established areas of activity (hereinafter referred to as the relevant federal executive authorities), the State Corporation for Space Activities "Roscosmos" (hereinafter referred to as the State Corporation "Roskosmos" ) in electronic form in the state integrated information system for managing public finances "Electronic Budget" (hereinafter referred to as the information system) based on the provisions of federal laws, regulatory legal acts of the President of the Russian Federation, the Government of the Russian Federation, federal executive authorities regulating the provision of public services legal entities and the performance of work by federal state institutions, as well as the provisions of regulatory legal acts of federal executive bodies regulating the provision of public services to individuals by federal state institutions, with the exception of public services included in the all-Russian basic (industry) list (classifier) of state and municipal services provided individuals (hereinafter - the acts that are the basis for the formation of the federal list and (or) making changes to it).

3. The relevant federal executive authorities, the State Corporation "Roscosmos" form the federal lists in accordance with the list of activities approved by the Ministry of Finance of the Russian Federation.

4. The following information shall be included in the federal list for each public service or work:

a) the name of the public service or work;

b) an indication of the codes of the All-Russian classifier of products by type of economic activity corresponding to the state service or work;

c) an indication of the free or paid public service or work;

d) the name of the indicators characterizing the content of the public service (when such indicators are established by the relevant federal executive authorities), or indicators characterizing the content of the work;

e) the name of the indicators characterizing the conditions (forms) for the provision of a public service or the performance of work (when such indicators are established by the relevant federal executive authorities);

f) type (types) of a state institution (budgetary, autonomous, state-owned), which is entitled to provide a public service (perform work);

h) the names of indicators characterizing the quality (when establishing indicators characterizing quality by the relevant federal executive authorities) and the volume of the public service (work), as well as their units of measurement;

i) details (indicating articles, parts, paragraphs, subparagraphs, paragraphs) of acts that are the basis for the formation of the federal list and (or) amendments to it.

5. The information specified in paragraph 4 of these Rules, generated by the relevant federal executive authorities, the State Corporation "Roscosmos" for each state service or work, forms a register entry.

Each registry entry is assigned a unique number.

6. The rules for the formation of information for inclusion in the register entry, the procedure for the formation (change) of the register entry and the structure of the unique number of the register entry are established by the Ministry of Finance of the Russian Federation.

7. Register entries are signed with an enhanced qualified electronic signature of a person duly authorized to act on behalf of the relevant federal executive body, State Corporation Roscosmos.

8. Register entries are sent in electronic form for approval to the Ministry of Finance of the Russian Federation in the manner established by the Ministry of Finance of the Russian Federation.

The Ministry of Finance of the Russian Federation, within 10 working days from the date of sending the register entries, agrees on them or refuses to agree (with an indication of the reasons for the refusal). The decision to refuse approval is made by the Ministry of Finance of the Russian Federation in the absence of the regulatory legal acts specified in clause 2 clause 4 of these Rules.

10. The federal list is approved by the relevant federal executive body, State Corporation Roscosmos, by signing with an enhanced qualified electronic signature of a person duly authorized to act on behalf of the relevant federal executive body, State Corporation Roscosmos.

11. Amendments to the federal list are carried out by the relevant federal executive body, the State Corporation "Roscosmos" in connection with a change in the information specified in clause 4 of these Rules, including in connection with the adoption and (or) amendment of acts that are the basis for formation of the federal list and (or) making changes to it.

12. The federal list is maintained by the relevant federal executive body, the State Corporation "Roscosmos" by generating the information specified in paragraph 4 of these Rules for the formation of new register entries, amendments to existing register entries or invalidation of existing register entries.

Each newly formed (modified) registry entry is assigned a unique number (unique version number).

Newly formed (modified) registry entries are signed with an enhanced qualified electronic signature of a person duly authorized to act on behalf of the relevant federal executive body, State Corporation Roscosmos, and are subject to approval by the Ministry of Finance of the Russian Federation in accordance with clause 8 of these Rules.

13. The totality of newly formed register entries, amended register entries and invalidated register entries (previous versions of the amended register entries) for one type of activity, signed by the relevant federal executive body, State Corporation Roscosmos, approved by the Ministry of Finance of the Russian Federation and not included in the approved federal list, forms the changes that are made to the federal list for this type of activity.

14. Changes made to the federal list are approved by signing with an enhanced qualified electronic signature of a person duly authorized to act on behalf of the relevant federal executive body, State Corporation Roscosmos.

15. In the case of a significant amount of changes made to the federal list (at least half of the current register entries), approval of a new version of the federal list is allowed.

16. Amendments to the federal list in the event of the adoption (change) of an act that is the basis for the formation of the federal list and (or) amendments to it shall be carried out by the relevant federal executive body, the State Corporation "Roskosmos" within 30 working days from the date of adoption ( change) of such an act.

17. Changes to be made to the federal list (new edition of the federal list) approved in accordance with the procedure established by these Rules in the current financial year (with the exception of the changes specified in clauses 16 and these Rules) prior to the submission of a draft federal of the law on the federal budget for the next financial year and planning period, are applied starting from the formation in accordance with the budgetary legislation of the Russian Federation of the state task for the provision of public services (performance of work) for the next financial year.

Changes to be made to the federal list (new version of the federal list) approved in accordance with the procedure established by these Rules in the current financial year (with the exception of the changes specified in paragraphs 16 and these Rules) after the draft federal law on federal budget for the next financial year and planning period, are applied starting from the formation in accordance with the budgetary legislation of the Russian Federation of the state task for the provision of public services (performance of work) for the first year of the planning period.

The changes specified in paragraphs 16 and these Rules shall apply from the moment they are approved in accordance with paragraph 14 of these Rules.

18. If technical errors (typos, misprints, grammatical errors or other similar errors) are found in the information included in the federal list, they are corrected by the relevant federal executive authorities, the Roscosmos State Corporation within 5 working days from the date of detection of these errors by amending the federal list in accordance with paragraphs 12-15 of these Rules, taking into account the following features:

Registry entries changed in order to eliminate technical errors retain their previously assigned unique number (unique version number);

registry entries changed in order to eliminate technical errors are not subject to agreement with the Ministry of Finance of the Russian Federation in accordance with paragraph 8 of these Rules;

the effect of registry entries changed in order to eliminate technical errors begins from the date of entry into force of registry entries that previously contained these technical errors.

19. In the event of a change in the manner established by the Ministry of Finance of the Russian Federation in accordance with these Rules, the structure of the unique number of the registry entry or the unique number of the registry entry, codes and names of positions all-Russian classifiers technical, economic and social information, the structure and position codes of other reference information used in the formation of the information specified in clause 4 of these Rules, the registry entry is changed automatically by the information system and signed by an enhanced qualified electronic signature of the information system operator.

If the changes specified in paragraph one of this paragraph do not lead to a change in the information specified in subparagraphs "a", "d", "e" and "h" of paragraph 4 of these Rules, the previously assigned unique number (unique version number).

If the changes specified in paragraph one of this clause lead to a change in the unique number of the registry entry (unique version number), the relevant federal executive body shall approve, in the manner prescribed by clause 14 of these Rules, the changes that are made to the federal list.

If the changes specified in the first paragraph of this clause do not lead to a change in the unique number of the registry entry (unique version number), the changes that are made to the federal list are not approved.

20. Proposals to amend the federal list may be sent by federal state authorities (state bodies) exercising the functions and powers of the founder of federal budgetary or autonomous institutions, the main administrators of federal budget funds in charge of federal state institutions (hereinafter referred to as the bodies sent proposals for amendments), using the information system in the manner established by the Ministry of Finance of the Russian Federation, the relevant federal executive authorities, the State Corporation Roscosmos.

The relevant federal executive authorities, the State Corporation Roscosmos, within 10 working days from the date of receipt of proposals for amendments to the federal lists, ensure their consideration and, following the results of the consideration:
