Legislative base of the Russian Federation. Legislative framework of the Russian Federation Regional customs department for radio-electronic security of objects

Ensuring electronic security of customs infrastructure facilities is one of the important conditions in the organization of work on information security and technical protection of information customs authorities. In the system of the Federal Customs Service, this activity is carried out by the Regional Customs Administration for Radioelectronic Security of Customs Infrastructure Objects (RTU REBOTI).

“Whoever owns the information owns the world” is a phrase that is familiar to many. No one will dispute that the information in modern world is a significant factor influencing many events taking place in society, state, international relations.
It is no secret that hostile foreign states are waging an "information war" against Russia in order to weaken and destabilize the internal situation.
In these difficult conditions When the activity of various reactionary forces is constantly growing, it is necessary to be on the alert and in constant readiness.
Our country has had to go through hard times more than once. And many generations with honor came out as winners, showing high professionalism and steel endurance.
Now we are also passing the test of time, which obliges us to pass on the baton of loyalty to our Motherland before the future generation.
For nineteen years now, the Regional Customs Administration for the Radioelectronic Security of Customs Infrastructure Objects has been protecting the economic interests of the Russian Federation. For history, this is a short period, but for the staff of the Office, taking into account the success that it has achieved over the past years, this is a significant contribution to the development in areas of activity.
These were difficult years, years of formation and development: from several departments to several services. We can proudly say that the result of such development is a powerful structure from Kaliningrad on the western borders of our vast Fatherland to Vladivostok on the eastern borders, as well as the formation of new units in Sevastopol.
The fate of the Office is largely connected with the fate of those people who gave all their talent, patience, diligence to the implementation of the difficult tasks facing our units. These are, first of all, the heads of our Office, employees and federal civil servants, without whom it simply could not exist. Over the years, the composition of the Board has changed a lot.
Now a lot of young and promising employees, federal civil servants, as well as those who have been working since the founding of the Office, are serving. These are in many ways experienced specialists who know their business, who have earned honor and respect in the team. Young people listen to their authoritative opinion and gain experience, which is so necessary in our difficult work.
What is our work, what is its peculiarity, what is electronic safety? This is of interest to many.
The "art" of industrial espionage and espionage as such has existed since ancient times. Various tricks were used to get hold of the information. Moreover, with each time the development of technical means of intelligence forced the owners of confidential information to look for new ways to protect it. And now the time has come when the protection of information has become a professional "craft".
The twentieth century and the beginning of the twenty-first century were marked by the rapid development of electronic equipment and technologies that science fiction writers could not even guess about. The current century has given such a rapid development of electronic technical means that their use as a means of reconnaissance and espionage has reached almost the everyday level. Information has become a "commodity" for which those who are against the state and the law are willing to pay huge sums of money.
Losses and damage from such "actions" can exceed the cost of paid information many times over. And in some cases, when human life and the health of citizens, the security of the state become a bargaining chip, the losses can be simply catastrophic.
The task of the Department today is to protect the information of limited access of the customs authorities from any encroachment from the outside. Interest in obtaining such information is shown by foreign technical intelligence, various criminal groups, individual criminals, certain organizations and citizens who violate the laws of the Russian Federation. Many of them use technical means available for free sale. Usually these tools are multifunctional, have small dimensions.
In this regard, even the familiar cell phone can be considered.
With the development of technical means of reconnaissance, technical means of protection and methods used to protect information are constantly being improved. Work in the field of information security is a licensed activity. The department is accredited by the Federal Service for Technical and Export Control of the Russian Federation as a body for certification of informatization objects in terms of technical protection of information, has a number of licenses to carry out work on information protection.
One of the first licenses was received fifteen years ago. It was a step that allowed the Directorate to develop further. It was preceded by a lot of work in preparation for licensing. The necessary equipment was provided, special laboratories were created. But the most important thing in this difficult work was the training of personnel.
These were people with work experience, many were military personnel, had a wealth of service experience behind them. There were also young people who graduated from civilian technical universities.
Knowledge of physical laws, higher mathematics, programming languages, the ability to work with measuring equipment and software and hardware systems, carry out calculations, analyze the results obtained, and at the same time knowledge of the law and the leading regulatory framework - this is not a complete list of necessary components that made it possible to solve the set tasks. Every year, the experience of the personnel of the Department expanded. Professional training took place not only within the framework of the activities of the Department, but also at advanced training courses.
Now each region has its own branch, which performs the whole range of tasks at the highest professional and technical level. This led to the fact that many customs authorities began to refuse contract work on attestation of objects of informatization and control of the efficiency of information protection, carried out by third-party licensees, giving preference to the departmental licensee - RTU REBOTI. All this was preceded by a huge work carried out in the regions. It continues today. There is a constant exchange of accumulated experience between the Office and its branches in the field.
Representatives of the Office annually take part in meetings held by the Federal Service for Technical and Export Control of the Russian Federation for certification bodies of informatization objects for information security requirements. Such events are very important and relevant at the present stage of development of the Federal Customs Service of Russia to counter electronic intelligence and information protection. This work allows you to "keep abreast", and thus gives the Department the opportunity to be ready to counter threats in the customs authorities and ensures the security of our state.
Despite all the difficulties that the Department is experiencing, the team is successfully implementing the plans and at the same time the performance indicators are constantly growing. Of course, the growth of indicators is not a constant value. It changes both upwards and downwards. It can also be objective reasons, such as an increase or decrease. headcount departments, budget financing and some other subjective factors.
Such daily hard work, requiring constant attention, associated with business trips and a large turnover of reporting documents, responsibility for the result of the fulfillment of assigned tasks, requires serious training, good physical shape and good health from the personnel.
That is why the team of RTU REBOTI takes part in many competitions held by the FCS of Russia.
Competitors have repeatedly won prizes in service weapon shooting, relay races and cross-country skiing. Competitions are held in mini-football, volleyball, table tennis, chess. The management takes an active part in swimming competitions.
Cultural programs give the team an opportunity to show their talents. The Department often holds competitions for the best creative work on various topics. All this contributes to the improvement of the “climate” and mutual understanding within the team. We pay tribute to the veterans of the customs service, who served in the Department, holding gatherings, solemn meetings.
We express our gratitude to the leadership of the Federal Customs Service of Russia for providing assistance in the formation and development of electronic security of customs authorities.
In a dynamically changing economic and political environment affecting the FCS of Russia, the Department does not lag behind, but keeps pace with customs realities, promptly responds to external factors that affect performance.

REGULATIONS ON REGIONAL CUSTOMS ADMINISTRATION OF RADIO-ELECTRONIC SECURITY OF CUSTOMS INFRASTRUCTURE OBJECTS

I. General provisions

1. The regional customs administration for radio-electronic security of customs infrastructure facilities (hereinafter referred to as the Administration) is part of the unified federal centralized system of customs authorities of the Russian Federation (hereinafter referred to as the customs authorities) and is a specialized customs authority that ensures the implementation of the tasks and functions of customs authorities in the region of the Administration within competence established by these Regulations.

2. The region of activity of the Department is the territory of the Russian Federation.

3. The department reports directly to the head of the FCS of Russia. The functions of organizing, coordinating and controlling the activities of the Department are carried out by the Deputy Head of the FCS of Russia, who is entrusted with these duties by order of the FCS of Russia.

4. Management in its activities is guided by the Constitution of the Russian Federation, federal constitutional laws, federal laws, decrees and orders of the President of the Russian Federation, resolutions and orders of the Government of the Russian Federation, international treaties of the Russian Federation, regulatory legal acts Ministry of Economic Development of Russia, the Ministry of Finance of Russia and the Bank of Russia, regulatory legal acts in the field of customs, legal acts of the Federal Customs Service of Russia, as well as this regulation.

5. Management in its activities solves the following tasks:

1) performance in accordance with state licenses of the Russian Federation of functions state system protection of information from leakage through technical channels in customs authorities and certification of informatization objects according to information security requirements;

2) implementation within the competence of the Office of a unified technical policy in the customs authorities on issues of electronic security, information protection and certification, taking into account the current level of development information technologies and interactions with information systems public authorities of the Russian Federation;

3) carrying out measures to ensure the radio-electronic security of customs infrastructure facilities (hereinafter - EW measures<*>) using technical means to identify electronic devices designed to secretly obtain information<**>, as well as the performance of work to ensure the protection of information from leakage through technical channels (hereinafter referred to as information protection work) and certification of objects of informatization of customs authorities (hereinafter referred to as certification);

<*>EW measures are a set of measures to detect electronic devices designed to secretly obtain information in the premises and in the technical means of customs infrastructure facilities using special-purpose technical means.

Technical means for special purposes (TSSN) - technical means for detecting electronic devices intended for secretly obtaining information, namely special and control and measuring equipment, as well as computer equipment that allows you to search for electronic devices intended for secretly obtaining information in premises and technical means (Decree of the Government of the Russian Federation of February 12, 2003 N 95 "On Approval of the Regulations on Licensing the Activity of Identifying Electronic Devices Designed for Covert Obtaining Information in Premises and Technical Means (except for the case when the specified activity is carried out to ensure own needs legal entity or individual entrepreneur.").

<**>Electronic devices intended for secretly obtaining information - electronic devices hidden installed in places where information can be retrieved (Decree of the Government of the Russian Federation dated 12.02. premises and technical means (except for the case when the specified activity is carried out to meet the own needs of a legal entity or an individual entrepreneur ")

4) generalization and analysis of the practice of protecting information in the customs authorities;

5) development and implementation, within the competence of the Department, of measures to improve the information security system in the customs authorities;

6) implementation of measures to protect information, as well as compliance with restrictions and prohibitions regarding the processing, storage and dissemination of information belonging to the customs authorities, established in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation;

7) granting the powers provided for by the current licenses of the Office (in agreement with the organization that issued these licenses) to electronic security units (hereinafter referred to as electronic warfare units<*>) customs authorities for implementation certain types activities, as well as control over these activities;

<*>EW subdivisions are specialized subdivisions of the customs authorities, empowered to organize and carry out activities to identify electronic devices designed to secretly obtain information in the premises and technical means of customs infrastructure facilities using special-purpose technical means and specialized techniques.

8) management, including methodological, of the activities of the electronic warfare units of the customs authorities and its coordination and control in the part determined by this regulation and legal acts of the Federal Customs Service of Russia;

9) organization of training officials Departments and subdivisions of electronic warfare of customs authorities and improving their skills;

10) carrying out work related to the use of information constituting a state secret, carrying out, in accordance with the established procedure, measures to protect state secrets and ensuring compliance with the secrecy regime in their own divisions.

6. The Department carries out its activities in cooperation with the authorized representatives of the President of the Russian Federation in the federal districts, territorial bodies of federal executive bodies, executive bodies of the constituent entities of the Russian Federation, bodies local government, public associations and other organizations, individuals and legal entities.

7. The Department solves the tasks assigned to it independently, as well as through the electronic warfare units of the customs authorities.

II. Powers

8. The Department exercises the following powers in the established field of activity:

1) organization and implementation of a set of measures for the electronic security of customs infrastructure facilities<*>according:

<*>The procedure for organizing and conducting electronic warfare activities, information protection and certification work is determined by separate legal acts of the Federal Customs Service of Russia.

a) with plans for conducting electronic warfare activities;

b) with applications (tasks) of structural subdivisions of the Federal Customs Service of Russia with the involvement of forces and means of EW subdivisions of the customs authorities;

c) with plans to eliminate deficiencies identified during the implementation of electronic warfare activities;

2) organization and conduct of work on the protection of information and certification<*>customs authorities in accordance with plans and on the basis of requests from customs authorities;

<*>Work on information protection and certification is organized and carried out by a specialized division of the Office - an industry center for certification of objects of informatization of the customs authorities of the Russian Federation for information security requirements, created in accordance with the order of the State Customs Committee of Russia dated October 23, 2003 N 1186dsp and licensed by the State Technical Commission of Russia and the FSB Russia.

The electronic warfare units of the customs authorities are granted the authority of an industry center for certification of informatization objects of the customs authorities of the Russian Federation for information security requirements for the performance of certain types of work provided for by the licenses of the Office (in agreement with the state body that issued the license).

3) carrying out work related to the implementation of measures to protect information and the provision of services in this area to third parties;

4) providing the leadership of the FCS of Russia and customs authorities with information, including operational information, on issues within the competence of the Department;

5) development of tactics and methodology for the preparation and implementation of electronic warfare activities and work to protect information in the customs authorities;

6) implementation of measures aimed at improving the efficiency of EW activities, work on information protection and certification;

7) development of draft regulations and other legal acts on issues of electronic security, information security and certification for compliance with information security requirements in customs authorities, preparation and submission for consideration by the FCS of Russia of proposals for the publication, amendment and addition of legal acts of the FCS of Russia on issues related to competencies of the Department;

8) rendering practical help electronic warfare units of the customs authorities in the preparation and implementation of electronic warfare activities, work on information protection and certification;

9) collection, generalization and analysis of information on the results of the activities of the EW Department and subdivisions of the customs authorities, the study of methods, tactics and means of obtaining unauthorized information using technical means at customs infrastructure facilities;

11) interaction with the operational units of the bodies vested with the right to conduct operational-search activities, with the FSTEC of Russia on issues within the competence of the Department;

12) development of a system and program for equipping the Department and EW subdivisions of the customs authorities of the TSSN for carrying out EW activities and protecting information, organizing and maintaining a centralized special accounting of the TSSN used by the subdivisions of the Department and subdivisions of the EW of the customs authorities;

13) ordering and receiving TSSN and Supplies within the framework of the centralized delivery of the Federal Customs Service of Russia;

14) centralized equipping of the TSSN of the divisions of the Directorate and divisions of electronic warfare for carrying out electronic warfare activities, work on protecting information and attesting objects of informatization of customs authorities in accordance with the developed system and equipment program, as well as with the Table of Regulations approved by the Federal Customs Service of Russia;

15) ensuring, in accordance with the legislation of the Russian Federation, the protection of information provided to customs authorities exclusively for customs purposes and constituting state, commercial, banking, tax and other secrets protected by law and exclusively for customs purposes and constituting state, commercial, banking, tax and other protected secrets; secrecy and other confidential information by law, control of such activities in the customs authorities;

16) prevention of offenses among officials of the Department;

17) provision in the Office effective use, operation, Maintenance and repair of computer equipment, hardware customs control, technical means of protection, etc.;

18) metrological support of the activities of the Department and subdivisions of electronic warfare of customs authorities;

19) participation in the work to protect the rights, property and other interests of the customs authorities in the judiciary when considering claims, complaints in cases arising from administrative and legal relations;

20) consideration of complaints of legal and individuals and protests of prosecutors against decisions, actions (inaction) of officials of the Department, ensuring timely and complete consideration of complaints and protests;

21) carrying out, within the powers granted by the FCS of Russia, attestation of officials of the Office for compliance with the position held, organization and control of this work in the electronic warfare units of the customs authorities;

22) submission to the Federal Customs Service of Russia of materials for awarding officials of the Department of State Awards of the Russian Federation, conferring honorary titles of the Russian Federation on them;

23) international cooperation in accordance with the procedure established by the FCS of Russia;

24) work on the selection, placement, training and education of personnel, checking the information and documents submitted by citizens when entering the service ( civil service) in management, control personnel work in the electronic warfare units of the customs authorities;

25) organizing and conducting activities in the field of labor protection, civil defense, prevention and elimination of emergency situations, compliance with safety and fire safety, mobilization training of the Department;

26) analysis of the state of performance discipline in the Department, development and implementation of measures to control performance discipline;

27) organization and provision of professional, combat and physical training, retraining of officials of the Department, improvement of their qualifications and internships;

28) participation in the implementation of programs and plans for social development;

29) organization of medical support for officials of the Department and their families in accordance with the established procedure;

30) record keeping, as well as organization of work on the acquisition, storage, accounting and use of documents generated in the course of the activities of the Department;

31) exercising the functions of a manager and recipient of federal budget funds;

32) ensuring the execution of the approved cost estimate of the Department and reliable reporting on it;

33) conducting business activities;

34) ensuring the implementation of programs, plans and performance indicators of the Department;

35) determination of the consolidated need for material and technical support of the structural divisions of the Department in accordance with the tables of regulations approved by the Federal Customs Service of Russia for centrally and decentralized planned, purchased and distributed products;

36) acquisition on a competitive basis, storage, distribution and redistribution between structural divisions Management of material and technical means on the nomenclature of regionally planned and distributed products within the approved limits of budgetary appropriations;

37) adoption, in accordance with the established procedure, of decisions on putting on the balance sheet and writing off from the balance sheet of the Office of fixed assets, low-value and wearing items and other material assets.

9. Management for the purpose of exercising the powers established by this provision has the right:

1) represent the customs authorities in state bodies, organizations;

2) be a plaintiff, defendant and third party in court;

3) issue legal acts of an administrative and organizational nature;

4) to cancel or change on the basis of complaints of persons, protests of prosecutors, in the exercise of departmental control, the decisions of officials of the Department, as well as to take measures in relation to their illegal actions (inaction) provided for by the legislation of the Russian Federation;

5) carry out research and development work in accordance with the established procedure;

6) to involve scientific and other organizations, as well as experts and specialists, in accordance with the established procedure, to consider issues within the competence of the Department;

7) organize, within its competence, the conduct of the necessary studies, tests, examinations, analyzes and evaluations, as well as scientific research;

8) request and demand, in accordance with the legislation of the Russian Federation, the information necessary for making decisions on issues within the competence of the Department;

9) create advisory and expert bodies (councils, commissions, groups, colleges);

10) publish at least once a year an information collection on the areas of activity of the Department and subdivisions of electronic warfare of customs authorities;

11) enjoy other rights provided for by the Customs Code of the Russian Federation and regulatory legal acts of the Russian Federation.

10. Officials of the Department have the right to unhindered and unlimited access to all customs infrastructure facilities at any time of the day to carry out electronic security measures, information protection work and certification with the necessary TSSN and vehicles.

III. Organization of activities

11. The department is headed by a chief appointed and dismissed by the Minister economic development and trade of the Russian Federation on the proposal of the head of the Federal Customs Service of Russia.

The Head of the Department has deputies who are appointed and dismissed by orders of the Federal Customs Service of Russia on the proposal of the Head of the Department.

The Chief Accountant of the Office is appointed to the position and dismissed by orders of the Federal Customs Service of Russia.

During the absence of the head of the Department, the execution of his duties is entrusted to the first deputy head of the Department or to the deputy head of the Department.

Heads of divisions of the Directorate are appointed and dismissed by orders of the Directorate in agreement with the relevant functional divisions of the Federal Customs Service of Russia.

12. The Department was established by order of the State Customs Committee of Russia dated June 23, 1997 N 371 "On the Creation of a Regional Customs Department for Electronic Security of Customs Infrastructure Objects".

The department is created, reorganized and liquidated by the Federal Customs Service of Russia in agreement with the Ministry of Economic Development of Russia.

13. Head of Department:

1) manage the activities of the Department on the basis of the principle of unity of command;

2) distribute duties among his deputies;

3) issue, on the basis of legal acts of the Federal Customs Service of Russia and this regulation, administrative documents on issues within the competence of the Department, and organize control over their execution;

4) approves the staffing table within the limits of the number and payroll of officials of the Department established by the Federal Customs Service of Russia;

5) submit to the head of the FCS of Russia:

a) proposals on the number and payroll of officials, employees of the Department;

b) proposals for the appointment and dismissal of the Deputy Head of the Department and the Chief Accountant of the Department;

c) a draft annual plan of activities of the Department and forecasted indicators, as well as a report on their implementation;

6) ensures the implementation of programs, plans and performance indicators of the Department;

7) appoints and dismisses officials of the Department, with the exception of persons appointed to positions and dismissed from positions by orders of the Federal Customs Service of Russia;

8) cancel or change in the order of departmental control the decisions of officials of the Department;

9) takes the oath of the employees of the Office;

10) applies, within the limits of the powers granted to officials of the Department, incentives and disciplinary measures in accordance with the Disciplinary Charter of the Customs Service of the Russian Federation, the legislation of the Russian Federation on public service and the labor legislation of the Russian Federation;

11) ensures the creation of the necessary working conditions for officials of the Department, as well as their legal and social protection;

12) ensures that materials are sent to the Federal Customs Service of Russia for the assignment of special ranks to officials of the Department and class ranks in accordance with the established procedure;

13) ensures that materials are sent to the FCS of Russia when officials of the Department are presented for awarding departmental awards, state awards of the Russian Federation, as well as conferring honorary titles of the Russian Federation on them;

14) decides, in accordance with the legislation of the Russian Federation on public service, issues related to the passage public service Russian Federation in the Office;

15) organizes, in accordance with the established procedure, the circulation of military hand-held small arms and other weapons, ammunition and cartridges for it, as well as edged weapons and special means;

16) bears personal responsibility for the implementation of the powers assigned to the Department, for the implementation of programs, plans and performance indicators of the Department.

14. The Head of the Department performs other duties, enjoys other rights and bears responsibility in accordance with the legislation of the Russian Federation.

15. Financing of expenses for the maintenance of the Department is carried out at the expense of the federal budget, as well as funds from other sources established by the legislation of the Russian Federation.

16. All property of the Department is federal property and is assigned to it on the basis of the right of operational management. Ownership, use and disposal of the assigned property is carried out by the Department in accordance with the procedure established by the legislation of the Russian Federation.

17. The Department is a legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, other seals, stamps and standard forms, as well as accounts opened by credit institutions in accordance with the legislation of the Russian Federation.

Relevance of the research topic. In the 21st century, external and internal threats require the state to actively respond to them in order to increase the level of its national security. Particularly acute is the problem of ensuring economic security at the level of the entire national economy, its complexes, industries and regional economies.

Fast efficient system Ensuring economic security is a matter of life for any state striving to take its rightful place in the global geopolitical and economic space.

Economic security should be understood as one of the most important qualitative characteristics of the economic system, which determines its ability to maintain normal living conditions for the population, to sustainably provide resources to the national economy in the process of its development.

The levers of ensuring the economic security of the country are the state bodies, which, through their functions, ensure the economic well-being of the state.

Customs authorities are part of the system of state bodies of the Russian Federation. They regulate their activities with the help of federal laws and other regulatory legal acts related to the regulation foreign trade activities, currency regulation and currency control, law enforcement and others that create legal basis activities of the customs authorities. But besides this, special units are being created in order to facilitate the processes of customs control. One of these subdivisions is the Regional Operational Search Directorate (ROPU) and the Regional Customs Directorate for Radioelectronic Security of Customs Infrastructure Objects (RTU REBOTI).

The purpose of the study: to determine the role of the operational units of the Federal Customs Service (hereinafter referred to as the FCS) in ensuring the economic security of the country.

To do this, it is necessary to solve the following tasks:

    Determine the functions, tasks, rights of the operational units of the FCS;

    Define overall structure management of operational units of the FCS;

    Analyze the effectiveness of the operational units of the FCS and its impact on the economic security of the country.

The works of many Russian scientists are devoted to this issue, including: Agamagomedova S.A., Volkov V.F., Isaeva L.M., Ovsyannikov S.A., Ovchinnikova O.A., and others. The author made an attempt to analyze and integrate all available data and scientific developments, as well as the regulatory framework in this area, in order to conduct further scientific research.

The object of the study is the operational units of the Federal Customs Service in the framework of ensuring the economic security of the country.

Before getting acquainted with the activities of the operational units of the Federal Customs Service in more detail, I would like to pay attention to the statistics of the late 90s - before these services were introduced into the system of the customs authorities of the Russian Federation.

It is not difficult to see that every year the number of crimes increased, that is, the economic security of the country was increasingly threatened. That is why reforms were carried out in the field of customs control and operational units were introduced.

These operational units have a support function to assist other operational units in their full-scale tasks.

The main tasks of the ROPU are: detection, prevention, suppression and disclosure of crimes, the production of urgent investigative actions and inquiries on which the criminal procedural legislation of the Russian Federation is assigned to the jurisdiction of the customs authorities, the identification and identification of persons preparing, committing or committing them; the implementation of the search for persons hiding from the bodies of inquiry, investigation and court, evading criminal punishment, as well as the search for missing persons; collection of information about individuals and legal entities in order to prevent and solve crimes; participation in accordance with the legislation of the Russian Federation in activities aimed at combating terrorism; obtaining information about events or actions (inaction) that pose a threat to the economic security of the Russian Federation; implementation of activities aimed at revealing the facts of corruption in the customs authorities; ensuring the own security of the customs authorities, protecting officials of the customs authorities and their relatives from illegal actions.

An integral part of the law enforcement block of the customs authorities of the Russian Federation is the Canine Service, which includes the Canine Center of the Federal Customs Service of Russia, canine services of operational customs and canine departments of customs.

The main functions of the Cynological Service are to ensure the participation of officials of cynological units with service dogs in operational-search activities and investigative actions as specialists, as well as the implementation of effective customs control, which contributes to the suppression of the illegal movement of narcotic drugs, psychotropic substances, ammunition, weapons across the customs border, explosive devices and other goods with an individual smell.

At the level of regional customs administrations (hereinafter referred to as RTU), there are operational customs, which are specialized customs authorities that are part of the unified federal system of customs authorities.

Operational customs is law enforcement agency of the Russian Federation and a higher customs authority in relation to the customs authorities of the region of its activity, ensuring, within its powers, the implementation of the legislation of the Russian Federation on operational-search activities, criminal proceedings, the legislation of the Russian Federation on administrative offenses and the legislation of the Russian Federation on customs affairs.

Operational customs have the following main powers in the established field of activity: organization, methodological support and control of the activities of operational-search, operational-analytical, cynological units, inquiry units, units, administrative investigation units and accounting and registration units of customs located in the region of their activity, on issues within their competence; implementation of the operational-search activity in accordance with the legislation of the Russian Federation, regulatory legal acts of the Federal Customs Service of Russia; implementation of operational and analytical work and information support ORD; production of urgent investigative actions in accordance with the criminal procedure legislation of the Russian Federation; verification of the activities of law enforcement units of the customs of the region in accordance with the procedure and forms determined by the Federal Customs Service of Russia.

Operational customs are located territorially at the place of deployment of RTU, in the centers of federal districts. Currently, there are 8 operational customs offices operating in the Russian Federation:

1) Central operational customs;

2) North-West operational customs;

3) Volga operational customs;

4) Ural operational customs;

5) Southern operational customs;

6) North Caucasian operational customs;

7) Siberian operational customs;

8) Far Eastern Operational Customs.

The following law enforcement units operate directly in the customs themselves: administrative investigation departments; departments of inquiry; departments of cynological service; departments for combating especially dangerous types of smuggling; operational-search departments; departments for combating drug smuggling; operational and analytical departments. These divisions are subordinated to the deputy chiefs of customs for law enforcement.

    Regional Customs Administration for Radioelectronic Security of Customs Infrastructure Objects

The operational and technical subdivision is a structural subdivision of the customs (operational customs) and ensures the fulfillment of tasks and the implementation of the functions of the Regional Customs Administration for the Radioelectronic Security of Customs Infrastructure Objects (RTU REBOTI) in the region of customs operations within its competence.

The region of activity of the subdivision is the territory of the region of activity of the corresponding customs office. The division in its activities is guided by the "Constitution" of the Russian Federation, federal constitutional laws, customs legislation Customs Union and the legislation of the Russian Federation on customs affairs, federal laws, international treaties of the Russian Federation, acts of the President of the Russian Federation and the Government of the Russian Federation, "Regulations" on the Federal customs service, regulatory and other legal acts of the Federal Customs Service of Russia, Regulations on RTU REBOTI, legal acts of RTU REBOTI, instructions and instructions of the head of RTU REBOTI, Regulations on the operational and technical service - a branch of RTU REBOTI (hereinafter - OTS - a branch of RTU REBOTI), instructions and instructions of the head UTS - branch of RTU REBOTI.

The work of the subdivision is based on the work plans of the UTS - a branch of RTU REBOTI (for the customs subdivision of the region of operation of the CTU - RTU REBOTI) and the subdivision, a combination of the principle of unity of command in resolving issues of operational activities and the personal responsibility of each officer of the subdivision for the state of affairs in the assigned area and for the execution of individual orders. The work plan of the unit is approved by the head of the OTS - a branch of RTU REBOTI.

The subdivision is headed by the head of the subdivision, who is directly subordinated to the head of the UTS - a branch of the RTU REBOTI, on issues of operational and service activities, and on administrative and economic issues - to the head of customs.

The division solves the tasks assigned to it both directly and through the UTS - a branch of RTU REBOTI, in cooperation with structural divisions of customs, other customs authorities, as well as with territorial divisions of federal executive authorities, executive authorities of the constituent entities of the Russian Federation, local authorities, public associations, other legal entities and individuals.

Office work and measures to ensure the secrecy regime in the unit are carried out in accordance with the established procedure. In carrying out its activities, the subdivision complies with the requirements of the legal acts of the Federal Customs Service of Russia on information and economic security.

The unit solves the following main tasks: 1) carrying out operational-search activities within its competence in accordance with the legislative and other regulatory legal acts of the Russian Federation and individual regulatory and other legal acts of the Federal Customs Service of Russia regulating operational-search activities; 2) participation in the implementation of measures to ensure the electronic security of customs infrastructure facilities (hereinafter referred to as EW measures) carried out by the OTS - a branch of RTU REBOTI for the subdivision

The division performs the following functions:

1) participates in the conduct of electronic warfare activities in accordance with the instructions and instructions of the head of the OTS - a branch of the RTU REBOTI;

2) prepares and conducts operational-search activities (hereinafter referred to as ORM) on the instructions of operational-search units and anti-corruption units of the customs authorities (hereinafter referred to as initiators) of the customs region;

3) collects, processes and stores materials received in the course of the ORM;

4) organizes the access of initiators to the materials obtained during the ORM;

6) interacts with other structural subdivisions of customs, territorial subdivisions of the FSB of Russia and other subjects of operational-search activity;

7) ensures the functioning of the regional segment of the integrated information and transport network of operational and technical units (hereinafter - OPT) of customs authorities, including the means of collecting, accumulating, processing information obtained in the course of conducting operational search activities;

8) ensures the protection of information constituting a state secret, and the observance of the secrecy regime within the unit;

9) performs in deadlines activities of the work plan of the OTS - branch of the RTU REBOTI, referred to the competence of the unit;

10) prepares reports, applications, reference and analytical materials on issues within the competence of the unit, and sends them to the OTS - a branch of RTU REBOTI;

11) develops and sends to the OTS - a branch of RTU REBOTI proposals for equipping the unit with specialized technical means, participates in the study and evaluation of their new systems and types;

12) prepares proposals to the head of customs on financing and technical support of the unit’s activities, previously agreed with the UTS - a branch of RTU REBOTI, to include expenses in budget estimate customs for the next financial year.

The division, in order to implement the tasks and functions assigned to it, has the right to:

1) submit proposals for consideration to the management of the OTS - branch of RTU REBOTI on issues of operational and service activities of the unit;

2) to submit proposals to the head of customs on the issues of administrative and economic support for the activities of the unit;

3) request and receive from the structural subdivisions of the UTS - the RTU REBOTI branch of the customs authorities and institutions under the jurisdiction of the FCS of Russia, the necessary statistical, analytical and other data, documents, conclusions and other information necessary for making decisions on issues within the jurisdiction of the subdivision ;

4) use departmental information systems in accordance with the established procedure and create their own databases;

5) request according to the established procedure Required documents and information from state bodies, local governments and organizations;

6) prepare and send to the OTS - a branch of the RTU REBOTI proposals for conducting research and development work in the interests of the unit;

7) involve, in accordance with the established procedure, to assist the unit, specialists from other law enforcement and other state bodies, organizations, as well as experts;

8) participate in meetings, seminars and conferences held by the customs authorities, federal executive authorities, executive authorities of the constituent entities of the Russian Federation and organizations on issues within the competence of the unit;

9) enjoy other rights provided for by legislative and other regulatory legal acts of the Russian Federation.

Officials of the subdivision have the right to unhindered and unlimited access to all customs infrastructure facilities on any day and at any time of the day to carry out activities within the competence of the subdivision, including with the necessary technical and transport vehicles without inspection, upon presentation of an official certificate.

Objects of customs infrastructure - protected buildings, structures, structures, territories and water areas adjacent to them, vehicles, cargo and other property of the customs authorities of the Russian Federation and institutions under the jurisdiction of the Federal Customs Service of Russia.

In agreement with the territorial border department of the FSB of Russia, officials of the unit also have the right to access facilities located at checkpoints across the state border of the Russian Federation in the border zone behind the line of engineering structures.

The staffing of the unit is established within the framework of staffing customs. The change in the staffing of the unit is carried out in agreement with the head of the OTS - a branch of RTU REBOTI and RTU REBOTI.

The head of the subdivision is appointed to the post and dismissed from the post by the head of the Federal Customs Service of Russia on the proposal of the head of customs, agreed with the head of the relevant OTS - a branch of RTU REBOTI and the management of RTU REBOTI. For the period of temporary absence of the head of the unit (business trip, vacation, illness, and otherwise provided for by the legislation of the Russian Federation), his duties are performed by one of the employees of the unit, appointed by the head of customs in agreement with the head of the relevant OTS - a branch of RTU REBOTI.

Employees of the subdivision are appointed and dismissed by the head of the Federal Customs Service of Russia on the proposal of the head of customs, agreed with the head of the relevant OTS - a branch of RTU REBOTI and the management of RTU REBOTI.

Job Responsibilities, the rights and responsibilities of the employees of the unit are regulated job descriptions developed and approved in accordance with the procedure established by the Federal Customs Service of Russia.

The subdivision is provided with specialized technical equipment by OTS - a branch of RTU REBOTI and RTU REBOTI in accordance with the Equipment Table and applications of the established form. In order to carry out certain activities, the subdivision may, in accordance with the established procedure, be transferred for temporary use specialized technical equipment from the reserves of the RTU REBOTI or operational and technical units of other customs authorities, and it is also allowed to independently purchase or manufacture the necessary technical and other material means at the expense of financial resources allocated to the customs.

To ensure performance, the subdivision participates in the work of commissions and carries out other organizational actions on all issues of the subdivision's work.

The assignment of other functions to the unit is not allowed.

3. The effectiveness of the operational units of the FCS.

The work of these units makes a significant contribution to the economic security of the country. According to the results of work for the 1st quarter of 2017, the customs authorities of the Russian Federation initiated 763 criminal cases, which is 13% more than in the 1st quarter of 2016. The number of criminal cases initiated as a result of the operational-search activities of the customs authorities increased by 18% and amounted to 624 criminal cases. 521 criminal cases were initiated against specific persons.

The largest number of initiated criminal cases falls on the customs authorities of the North-Western (200), Siberian (155) and Far Eastern (138) customs departments.

Of the total number of criminal cases under Article 229.1 of the Criminal Code of the Russian Federation (hereinafter referred to as the Criminal Code of the Russian Federation) (smuggling of narcotic drugs, psychotropic substances, their precursors or analogues, plants containing narcotic drugs, psychotropic substances or their precursors), 98 cases were initiated; under article 226.1 of the Criminal Code of the Russian Federation (smuggling of potent, poisonous, poisonous, explosive, radioactive substances, firearms or their main parts, explosive devices, ammunition, weapons of mass destruction, their means of delivery, other weapons, other military equipment, strategically important goods and resources, cultural property or especially valuable wild animals and aquatic biological resources) - 277 cases.

Under article 200.2 of the Criminal Code of the Russian Federation (smuggling of alcoholic products and (or) tobacco products) - 10 cases; under article 200.1 of the Criminal Code of the Russian Federation (smuggling of cash Money and (or) monetary instruments) - 17 cases.

Share of smuggling from total initiated criminal cases for the first quarter of 2017 amounted to 53%.

Under article 194 of the Criminal Code of the Russian Federation (evasion of customs payments), 166 cases were initiated. The share of criminal cases of this category of the total number of cases initiated by the customs authorities amounted to 22%.

Under article 193 of the Criminal Code of the Russian Federation (evasion from fulfilling obligations for the repatriation of funds in foreign currency or the currency of the Russian Federation) - 37 cases; under article 193.1 of the Criminal Code of the Russian Federation (transfer of funds in foreign currency or the currency of the Russian Federation to the accounts of non-residents using false documents) - 41 cases.

Also, the customs authorities of the Russian Federation initiated 106 criminal cases under Article 173.2 of the Criminal Code of the Russian Federation (illegal use of documents for the formation (creation, reorganization) of a legal entity); under article 173.1 of the Criminal Code of the Russian Federation (illegal formation (creation, reorganization) of a legal entity) - 11 cases.

The value of illegally moved across the customs border of the Customs Union within the framework of the Eurasian economic union(hereinafter - the EAEU) or the State Border of the Russian Federation with the member states of the Customs Union within the framework of the EAEU of goods, including strategically important goods and resources (Article 226.1 of the Criminal Code of the Russian Federation), amounted to just over 9.6 billion rubles. The amount of unpaid customs payments (Article 194 of the Russian Federation) is 1.5 billion rubles. Not returned from abroad funds in foreign currency and the currency of the Russian Federation (Article 193 of the Criminal Code of the Russian Federation) in the amount exceeding 39 billion rubles. Transferred funds in foreign currency or the currency of the Russian Federation to the accounts of non-residents using forged documents (Article 193.1 of the Criminal Code of the Russian Federation) in the amount of more than 2.7 billion rubles. The amount of illegally transferred cash and (or) monetary instruments (Article 200.1 of the Criminal Code of the Russian Federation) amounted to more than 43 million rubles. The cost of alcohol products and (or) tobacco products illegally moved across the customs border of the EAEU amounted to more than 44 million rubles. (Article 200.2 of the Criminal Code of the Russian Federation).

291 kg of narcotic drugs and psychotropic substances, 6 kg of precursors, more than 7 kg of potent substances were seized from illegal circulation.

Conclusion.

As a result of measures aimed at compensating for the damage caused by crimes, before the initiation of criminal cases and during their investigation in federal budget in the first quarter of 2017, more than 112 million rubles were transferred.

The subjects of the crimes were mainly narcotic drugs, psychotropic and potent substances, foreign currency and the currency of the Russian Federation, consumer goods, vehicles. Customs officials detained 36 people on suspicion of committing crimes. 22 criminal cases were sent to the courts with indictments/decrees. The courts issued convictions in 12 criminal cases. The remaining cases have not yet been considered by the courts (in particular, the North-Western RTU (200 cases), the Siberian RTU (155 cases) and the Far Eastern RTU (138 cases).

Thus, we can conclude that special operational units on the basis of the Federal Customs Service of the Russian Federation successfully fulfill their tasks and make a tangible contribution to the economic security of the state.

II. The main tasks of the division

5) to request, in accordance with the established procedure, the necessary documents and information from state bodies, local governments and organizations;

6) prepare and send to the OTS - a branch of RTU REBOTI (for the customs department of the region of operation of the CTU - RTU REBOTI) proposals for conducting research and development work in the interests of the unit;

7) involve, in accordance with the established procedure, to assist the unit, specialists from other law enforcement and other state bodies, organizations, as well as experts;

8) participate in meetings, seminars and conferences held by the customs authorities, federal executive authorities, executive authorities of the constituent entities of the Russian Federation and organizations on issues within the competence of the unit;

9) enjoy other rights provided for by legislative and other regulatory legal acts of the Russian Federation.

13. Officials of the subdivision have the right to unimpeded and unlimited access to all customs infrastructure *2 on any day and at any time of the day to carry out activities within the competence of the subdivision, including with the necessary technical and transport vehicles without inspection, with presenting an official ID.

14. In agreement with the territorial border department of the FSB of Russia, officials of the unit also have the right to access facilities located at checkpoints across the state border of the Russian Federation in the border zone behind the line of engineering structures.

V. Final provisions

15. The staffing of the subdivision is established within the framework of the customs staffing table. The change in the staffing of the unit is carried out in agreement with the head of the OTS - a branch of RTU REBOTI and RTU REBOTI.

16. The head of the subdivision is appointed to the post and dismissed from the post by the head of the Federal Customs Service of Russia on the proposal of the head of customs, agreed with the head of the relevant OTS - branch of RTU REBOTI and the management of RTU REBOTI. For the period of temporary absence of the head of the unit (business trip, vacation, illness, and otherwise provided for by the legislation of the Russian Federation), his duties are performed by one of the employees of the unit, appointed by the head of customs in agreement with the head of the relevant OTS - a branch of RTU REBOTI (for the customs unit of the region of operation of the CTU - RTU REBOTY).

17. Employees of the unit are appointed and dismissed by the head of the Federal Customs Service of Russia on the proposal of the head of customs, agreed with the head of the relevant OTS - a branch of RTU REBOTI and the management of RTU REBOTI.

18. Employees of the structural unit are appointed from among the persons who meet the established qualification requirements.

19. The duties, rights and responsibilities of the employees of the unit are regulated by job descriptions developed and approved in accordance with the procedure established by the Federal Customs Service of Russia.

20. Head of department:

1) directs the activities of the unit on the basis of the principle of unity of command;

2) takes part in meetings held by the management of the OTS - a branch of RTU REBOTI and RTU REBOTI, when considering issues within the competence of the unit;

3) distributes duties among the employees of the unit;

4) participates in the selection, placement, training and education of personnel, in the verification of information and documents submitted by citizens upon entering the service in the unit;

5) creates conditions for increasing vocational training officials of the unit and the introduction of advanced techniques and methods of work;

6) submits, in accordance with the established procedure, submissions on the assignment of special ranks to employees of the unit, their appointment to a position, as well as submissions on the encouragement of officials of the unit, the imposition of disciplinary sanctions on them;

7) within its competence, take measures to ensure the necessary conditions of service for the officials of the unit, control their observance of official discipline;

8) organizes special, fire and physical training of the unit's employees;

9) organizes and plans the activities of the unit, interaction with the structural units of the UTS - a branch of RTU REBOTI (for the customs unit of the region of operation of the CTU - RTU REBOTI), customs authorities, government agencies, local governments and organizations;

10) bears personal responsibility for the implementation of the functions assigned to the unit, including the implementation of programs, plans and performance indicators of the unit;

11) enjoy the rights, perform duties and bear responsibility in accordance with the legislation of the Russian Federation.

21. Provision of the unit with specialized technical means is carried out by OTS - a branch of RTU REBOTI and RTU REBOTI in accordance with the Equipment Table and applications of the established form. In order to carry out certain activities, the subdivision may, in accordance with the established procedure, be transferred for temporary use specialized technical equipment from the reserves of the RTU REBOTI or operational and technical units of other customs authorities, and it is also allowed to independently purchase or manufacture the necessary technical and other material means at the expense of financial resources allocated to the customs.

22. In order to ensure performance, the subdivision participates in the work of commissions and carries out other organizational actions on all issues of the subdivision's work.

23. The assignment to the subdivision of functions not provided for by this Regulation, except for special (address) instructions of the head of the OTS - a branch of the RTU REBOTI and the head of the RTU REBOTI, is not allowed.
